HomeMy WebLinkAbout20100907 - VI-03To: Mayor Hicks & City Councilmembers From: Melanie Mesko Lee, Assistant City Administrator Date: September 1, 2010 Item: 2010 Oktoberfest Request Council Action Requested: To approve a request by Downtown Business Association for an Oktoberfest event on Saturday, September 25, 2010, designating the event as a "community civic festival and celebration ". As part of the request, also approve the following: • Close 2nd Street at RJ's east to Sibley Street, 2:00 p.m.to 1:00 a.m. Activities are proposed to end when the music ends at 11:00 p.m.; the additional time is to allow for site clean up and the road will be reopened by 1:00 a.m. • Close 2nd Street from Sibley Street east to Ramsey Street from 10:00 a.m. to 6:00 p.m. • Designate the one -day event as a "community civic festival and celebration" under the City Code 111.25. This designation would allow the City to issue a permit for a variance from the provision prohibiting consumption or possession of a liquor container on any street or other public property. The proposed beer garden parameters would be from RJ's east to Sibley Street, and will be under the Busted Nut's liquor license. • Music (DJ in the afternoon, band in the evening from 7:00 -11:00 p.m.) is proposed to end at 11:00 p.m. and approve an Outdoor Music Application • Staff s conditions regarding access, control, clean -up, etc. Background Information: The Downtown Business association has approached the City about hosting an Oktoberfest celebration on Saturday, September 25, 2010. • Serving liquor —there is a provision in City Code which allows the Citv to issue a permit for a variance from the prohibition of serving or consuming alcohol on City streets or public property. The request must come from a non - profit civic organization, having their principal place of business within the City of Hastings, and for the sole purpose of a community civic festival and celebration (City Code 111.25). Additionally, state statute allows that the governing body may authorize the holder of a retail on -sale liquor license to dispense alcohol at a "social affair" conducted on the premises owned by a municipality (MN Stat. 340A.404.subd.4). The request by the Downtown Business Association (a non - profit organization, located in Hastings) is to allow the Busted Nut (holder of an on -sale liquor license) to serve alcohol, via a beer trailer, on 2nd Street from Sibley Street, west one block. City staff Nvill not be involved in checking ID of attendees. • Public Safetv — Installation of a snow fence on the east and Nvest ends of the blocked off area to control access; snow fence installed in such a Nvay that emergency vehicles have easy access to the site in the event that is necessaiv. • Restroom access — provide Port -a- Potties Nvithin the fenced off area for patron use. • Insurance— provide proof of acceptable insurance coverage by both the DBA and the Busted Nut. • Garbage —the DBA Nvill be responsible for collecting and removing all garbage generated by the event. • Glass —no glass Nvill be alloNved • Monitoring —all patrons Nvould be checked for identification at the limited access points. The Friday event Nvould be limited to those who are 21 years of age or older. Wrist bands Nvould be required by all patrons Nvithin the alloNvable area. • Fire Ring —they are requesting a raised fire ring, similar to what Nvas approved last year. Staff recommends approval based on the information provided. Our purpose would be to hold activities pertaining to Oktoberfest during that time frame. We would also II* e to have a raised fire ring In the area similar to ghat we did last tear. The placement of this fire ring_ has not been decided yet. We are interested holding a beer garden d n*ng this same time frame and it will be located on the first block between RA and Sibley St. It would be with the street area that will be closed down and the beer garden area ill be fenced i. We are also having a Street Dance from 7 p rn to 11 pm. The committee is still working on the other details; Please find enclosed a neap of the evert.
