REQUEST
Mark and Tiffany Beer, owner of Wayne’s Auto Body, seeks approval of a Special Use Permit to
allow for an automobile service station at 3170 Red Wing Boulevard. An automobile service
station is a use by special permit in the C-4 Community Regional Commerce District.
BACKGROUND INFORMATION
The Planning Commission reviewed the Site Plan for the Auto Body shop at its August 9, 2010,
meeting and voted (7-0) to recommend approval.

Comprehensive Plan Classification
The 2020 Comprehensive Plan designates the property as C, Commercial. The proposed use is
consistent with the plan.
Zoning Classification
The property is zoned C-4, Community Regional Commerce in which automobile service
stations are allowed by special use permit.
Adjacent Zoning and Land Use
The property is surrounded on 3 sides by commercial uses including a veterinary clinic, hotel,
and restaurant.
Existing Condition
The site is 1.53 acres and vacant.
Proposed Improvements
The site will be developed with a new 4800 square foot building and a parking lot. A fence will
be installed to screen outdoor storage of vehicles. On the south side of the building, the fence
will be six feet tall and solid vinyl. On the west side of the property, the fence will be a six foot
tall chain link with privacy slats
SPECIAL USE PERMIT REVIEW
Special Use Permit Provisions
The Zoning Code defines and regulates special uses as follows:
Uses that would not be appropriate generally or without restriction throughout the zoning
district but, if controlled as to number, area, location, or relation to the neighborhood, would not
detract from the public health, safety, and welfare. Special uses may be permitted in a zoning
district if specific provision of such special uses is made in this Zoning Ordinance.
Access and Circulation
Vehicular access is adequate.

Trash and Recycling Enclosure
Awaste enclosure building must be constructed as follows:
1)Wall materials and colors shall be consistent with the main building
2)Outdoor storage such aswaste materials, palettes, boxes, debris, vehicles, and the like
shall be prohibited unless it is screened from public view with a fence. The applicant is
proposing to install afence that will screen outdoor storage of vehicles. On the south
side of the building, the fence will be six feet tall and solidvinyl. On the west side of the
property, the fence will be a six foot tall chain link with privacy slats.
Signage
All building signage will require a permit to be obtained from the Planning Department.
Oil Disposal and Gasoline
The applicant disposes of oil at Goodyear and the oil does not stayon the property for more than
twenty-four hours. The applicant has a hazardous waste generator’s license.
Paint and paint filters are disposed thru a company called Special Waste Disposal, Inc.
The paint filters are put in plastic bags and put in 55 gallon drums. The paint thinner is ran thru a
recycler and it is turned into sold waste, which is then put in a 55 gallon drum. SWDI picks the
drums up 2-3 times per year.
Neighborhood Comments
Notification was sent to property owners within 350 feet of the proposed activity. No comments
have been received at this time.
STAFF REVIEW
Staff believes this is a good location for a service station as there are no incompatible uses in the
area and the area is surrounded by commercial uses.
RECOMMENDED ACTION
Approval of the Special Use Permit is recommended subject to the following conditions:
1)All work to be performed on vehicles shall be conducted inside the building.
2)Adherence to the Drinking Waters Surface Management Area (DWSMA) requirements
for disposal of waste fluids including operational floor drains.
3)All waste fluids shall be contained within the building and disposed of in accordance with
state, county, and federal requirements.
4)Maintaining Waste Generators license.
5)A trash and recycling enclosure must be constructed for outside dumpster storage. The
enclosure must be enclosed on all four sides, and be constructed with materials to match
the primary building.
6)Approval may be subject to an annual review of conformance to the provisions of the
special use permit.
7)Approval is subject to a one year Sunset Clause; if significant progress is not made
towards the proposal within one year of City Council approval, the approval is null and
void.
8)A solid fence (vinyl or slated chain link) is required for parking and storage of
serviceable vehicles outside of the building.
