155.01(A) – Rezone –Properties located at 108 East 5 St & 504 and
506 Sibley St
REQUEST
The City of Hastings is requesting the following rezoning:

1) Rezone 108 East 5 Street (business) from residential (R-2) to commercial (C-3).
2) Rezone 504 and 506 Sibley Street (duplex) from commercial (C-3) to residential
(R-2).
No new development is proposed for the subject properties at this time; this action is to
fix incorrect changes that were previously made to the zoning map.
The Public Hearing was ordered on June 21, 2010.

HISTORY
In the late 1970’s, a request was made to rezone the properties at 504 and 506 Sibley
Street from C-3 to R-2. No change occurred to the zoning at 504 and 506 Sibley Street

and the business at 108 East 5 Street was inadvertently recorded as being rezoned
from C-3 to R-2. This error occurred due to the application having the wrong legal
description. As such, the City is asking to rezone the properties to their correct zoning
designations.

Street. At 504 and 506 Sibley Street, there is a side-by-side duplex with one property
owner.
Notification of Adjoining Property Owners
Notification was sent to adjoining property owners. No comments have been received
at this time.
RECOMMENDATION
Staff is recommending approval of the rezone request.

BE IT ORDAINED
by the City Council of the City of Hastings as follows:

Subdivision A. The following described property, also known as 108 East 5 Street, is hereby
R-2 Medium Density Residence to C-3 Community Regional Commerce:
rezoned from
Lot 3, Block 36, TOWN OF HASTINGS, Dakota County, Minnesota.
And
Subdivision A. The following described property, also known as 504 and 506 Sibley Street, is
C-3 Community Regional Commerce to R-2 Medium Density
hereby rezoned from
Residence to: Lot 1, Block 36, TOWN OF HASTINGS, Dakota County, Minnesota.
EFFECTIVE DATE: This Ordinance shall be in full force and effect from and after its passage
and approval and publication, as required by law and/or charter.
