Background Information: Council is requested to approve the first reading of an ordinance amendment relating to the City Ordinance Chapter 34, Section 34.03 (Fees) and Chapter 150, Section 150.01 (the State Building Codes Adopted). Fees: Recent legislative changes to Minnesota Statutes 326.148 regarding “Surcharge” fees, requires the City to charge a state-mandated surcharge on “Permits based on Fixed Fees.” This surcharge only applies to the “Permits based on Fixed Fees”. The minimum surcharge for a “fixed fee” permit will go from the present charge of $.50 to $5.00 for the period of July 1, 2010, until June 30, 2011. Code Changes: The changes in Chapter 150 of the City Code are to reflect newer additions to existing building codes that are mandated by state law to be enforced. The changes are being made to stay current with the State Building Code. ORDINANCE NO. _________ AN ORDINANCE OF THE CITY OF HASTINGS, MINNESOTA AMENDING Section III, CHAPTER 34, SECTION 34.03 AND SECTION XV – LAND USAGE, CHAPTER 150, SECTION 150.01 OF THE HASTINGS CITY CODE PERTAINING TO: FEES BE IT ORDAINED by the City Council of the City of Hastings as follows: Chapter 34, Section 34.03, Fee Schedule for the Department of Building Safety, of the Hastings City Code are hereby modified as follows: The minimum state surcharge fee for a “fixed fee” permit will go from $.50 to $5.00 as required by Minnesota Statutes 326B.148 beginning July 1, 2010 through June 30, 2011. This applies to all “fixed fee” permits listed on the Building Safety Department fee schedule. (A) Building Code. The 2007 Minnesota State Building Code, established pursuant to M.S. 16B.59 through 16B.73, as they may be amended from time to time, 1 copy of which is on file in '' the office of the City Clerk, is hereby adopted as the building code for the City of Hastings. The code is hereby incorporated in this chapter as completely as if set out in full. (B) Administration required. (1) There is hereby established in this jurisdiction a code enforcement agency which shall be under the administrative and operational control of the Building Official. (2) The Building Official is hereby authorized and directed to enforce all the provisions of this code. For such purpose, the Building Official shall have powers of law enforcement officers. Permits, inspections, and fees shall be as provided in accordance with the Minnesota State Building Code and as adopted by ordinance. In addition to the permit fee required by above, the applicant shall pay the required surcharge to be remitted to the Minnesota Department of Administration as prescribed by M.S. 16B.70, as it may be ' amended from time to time.
