REQUEST Hastings Automotive seeks approval of a Special Use Permit to operate a temporary auto sale at the Coborn's Grocery located at 225 33 Street West. The cars would be set up on Tuesday, July 13, 2010, in the late afternoon. The actual sale would run from Wednesday, July 14, 2010, through Saturday, July 17, 2010. The clean -up and removal of cars would occur on Saturday, July 17, 2010. Coborn's Grocery is in the C -4 District. Auto sales are allowed in the C -4 District by Special Use Permit. Hastings Automotive held a similar sale in 2006, which was a ten - day sale located at Westview Mall. PLANNING COMMISSION The Planning Commission voted (5 -0) to approve the Special Use Permit with an additional condition that the applicant be required to show proof of insurance for the temporary sales site. ATTACHMENTS • Resolution • Application • Location Map • Diagram of Coborn's parking lot Special Use Permit Hastings Ford City Council Memo — June 21, 2010 Page 2 BACKGROUND In August, 2006, City Council approved an amendment to 155.32, C -4 — Regional Shopping Center to allow temporary auto sales. During the five -day sale, 150 vehicles would be for sale at the Coborn's Grocery parking lot. The hours of operation will be 9:OOam - 8:OOpm Wednesday and Thursday, 9:OOam - 7:OOpm Friday, and 9:OOam - 5:OOpm Saturday. In addition, 18 employees would staff the lot. No other student fundraisers will be taking place in the parking lot. Hastings Automotive stated it will donate $25 from the sale of each vehicle to the Hastings Family Services. Depending on the volume of sales, they anticipate a donation of about $1,000, based on selling ten cars per day. In addition, they will be giving $5 per test drive to the test driver that will be a co -op with Coborn's Grocery. Comprehensive Plan Classification The 2030 Comprehensive Plan designates the property as C- Commercial. Zoning Classification The subject property is zoned C -4, Regional Shopping Center. Temporary auto sales are identified as a special use in the C -4 District. West Commercial C -4 — Regional Shopping Center C- Commercial SPECIAL USE PERMIT REVIEW Special Use Permit Provisions The Zoning Code defines and regulates special uses as follows: Uses that would not be appropriate generally or without restriction throughout the zoning district but, if controlled as to number, area, location, or relation to the neighborhood, would not detract from the public health, safety, and welfare. Special uses may be permitted in a zoning district if specific provision of such special uses is made in this Zoning Ordinance. Special Use Permit Hastings Ford City Council Memo — June 21, 2010 Page 3 ORDINANCE 155.32, C-4 — Regional Shopping Center C (5) (a) Temporary auto sales may be allowed to support the activities of a non - profit community organization (such as a fundraiser for a sports team or school). Each auto dealership may be allowed 1 sale per year, with the sale not to exceed 14 calendar days per year. Each parcel of land in the C -4 district is allowed 1 sale per year. If a business consists of more than 1 parcel, only 1 sale may be allowed. (b) The following shall be considered in granting a special use permit: 1. The effect on the total number of parking spaces at the business the sale is held. 2. The effect of the ingress and egress at the parking lot. 3. The effect on accessibility of emergency services. 4. The effect on neighboring businesses or residential areas from an increase in traffic. Parking Spaces The car sale will utilize the back portion of the parking lot. Approximately 125 to 135 parking spaces would be used. There appears to be adequate parking remaining for grocery store customers. Ingress and Egress Customers for the car sale will access the current ingresses and egresses for the grocery store parking lot. An increase in use is anticipated. Accessibility of Emergency Services Al Storlie, Fire Inspector, has requested that the front and back traffic corridors in the parking lot not be blocked. This will insure that emergency vehicles have proper access. Please see Condition #4. Affect of neighboring businesses and residential areas Neighboring businesses will most likely see an increase in traffic on the roads in front of their businesses. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HASTINGS GRANTING A SPECIAL USE PERMIT TO ALLOW FOR A TEMPORARY AUTO SALE IN THE C -4 DISTRICT FOR HASTINGS AUTOMOTIVE TO BE HELD AT 22533 r ' STREET WEST, HASTINGS, MN Council member moved its adoption: introduced the following Resolution and WHEREAS, Hastings Automotive has petitioned for approval for a Special Use Permit to conduct a car sale in the C -4 District to be held at 225 33 Street, legally described as follows: CROSSROADS CENTER EAST LOT 1, BLOCK 1 WHEREAS, on June 14, 2010, review was conducted before the Planning Commission of the City of Hastings, as required by state law, city charter, and city ordinance; and WHEREAS, The Planning Commission recommended approval subject to the conditions of this resolution; and WHEREAS, The City Council has reviewed the request and recommendation of the Planning Commission. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HASTINGS AS FOLLOWS: That the City Council hereby approves the Special Use Permit as presented subject to the following conditions: 1. Hastings Automotive shall donate $25 per vehicle sold during these 4 days to the Hastings Family Services. 2. This special use permit shall be good only for the dates listed in this temporary special use permit. Nothing in this Special Use Permit shall be interpreted or construed to give the applicant or the property owner any rights to hold a temporary auto sale on any dates other than those listed in the temporary special use permit 3. The location of the temporary auto sale shall be as shown on the drawing submitted by the applicant to the city and further subject to the approval of the city's fire inspector. 4. The front and back traffic corridors in the parking lot shall not be blocked during the temporary auto sale. 5. The applicant shall provide proof of insurance covering the parking lot in which the sale will occur.
