Council Action Requested:
Approve the attached request for outdoor music beyond 10 p.m. for American Legion
Post 47, 50 Sibley Street, Hastings.
Background Information:
Wendy Dodge -Agen of the American Legion Post 47 has requested an Outdoor Music
License for music on their patio for the Hastings Saturday Night Cruise -In Shows on
May 29; June 12 & 26; .July 10 & 24; August 7 & 21; September 4 & 18; and October 2,
2010 and for Rivertown Days July 16 and 17. Music is proposed to be playing 7 pm until
11:00 pm.
The City Council recently adopted a policy to guide requests for playing music outdoors
by establishments. Music that ends before 10 pm is permitted and requires no licensing
by the City. Outdoor music after 10 pm needs to be licensed by the City.
HPD Review:
According to the Police Department, there have been no formal complaints filed
regarding outdoor music at this location. Staff is not aware of any complaints received.

Businesses may offer outdoor music without a City permit until 10 p.m. Businesses wishing to
offer outdoor music after 10 p.m. through midnight must receive a City permit to do so.
Outdoor music after midnight is not permitted. Calls regarding loud music will be responded
to on a complaint basis and the City of Hastings reserves the right to direct changes to the
outdoor music as deemed necessary.
