Commissioners Present: Bullington, Peine, Rohloff, Slaten, Stevens, Vaughan, Zeyen Commissioners Absent: None Staff Present: Associate Planner Kari Barker, Associate Planner Justin Fortney Approval of Minutes 2. – April 12, 2010 Motion by Commissioner Stevens to approve the April 12, 2010, meeting minutes as presented. Seconded by Commissioner Vaughan. Upon vote taken, Ayes 7, Nays 0. Motion carried. OTHER ACTIONS Klotz, Andrew – 3.Variance #2010-14 – Sideyard Setback Variance to Expand Existing Garage th and OHDS Review- 514 West 5 Street. Associate Planner Barker presented a staff report. Commissioner Stevens inquired if staff wanted separate actions. Associate Planner Barker confirmed the request for two separate actions. Commissioner Slaten inquired if the applicant found the south pin. The applicant stated he found the two pins in the backyard along with the one of the right side of his property. He was able to locate the approximate location of the fourth pin, the front left side, using triangulation. Commissioner Vaughan asked if the sideyard setback in the zoning district for the home was seven feet. Associate Planner Barker confirmed it was seven feet. Commissioner Vaughan asked if neighbors had been notified. Associate Planner Barker confirmed they had been notified and no responses had been received. Commissioner Slaten inquired about the 8.5 foot setback from the neighboring garage. Associate Planner Barker showed pictures that illustrated the distance between the garages. Motion by Vaughan to approve the sideyard setback variance to expand an existing garage at 514 th West 5 Street. Vaughan stated his reason for approval was that the garage was designed to fit into City of Hastings Planning Commission Minutes – April 26, 2010 Page 2 of 2 the OHDS district and it was not possible to build the garage further back on the property. Seconded by Slaten. Upon vote taken, Ayes 3, Nays 4 (Bullington, Zeyen, Peine, Stevens). Motion failed. th Motion by Vaughan to approve the OHDS review for 514 West 5 Street. Seconded by Peine. Upon vote taken, Ayes 7, Nays 0. Motion carried. Dakota County – 4.License #2010-18 – Keeping of Chickens at LeDuc Estate – 1629 Vermillion Street. Associate Planner Justin Fortney presented a staff report. Commissioner Stevens confirmed that the LeDuc has four acres and, thus, can have sixteen chickens. Associate Planner Fortney confirmed the acreage and further stated the LeDuc was the reason the Chicken Ordinance initially came before the Planning Commission. Motion by Vaughan to approve the keeping of chickens at LeDuc Estate. Seconded by Stevens. Upon vote taken, Ayes 7, Nays 0. Motion carried. Other Business 5. Associate Planner Barker updated the Commission on upcoming items. Adjourn 6. Motion by Slaten to adjourn the April 26, 2010, Planning Commission meeting. Seconded by Bullington. Upon vote taken, Ayes 7, Nays 0. Motion carried.
