HomeMy WebLinkAbout20100607 - VI-04MEMO To: Honorable Mayor and City Council From: Nick Egger — City Engineer Date: May 27, 2010 Re: Approve Appeal for Stormwater Utility Fee — 2121 Glendale Road The Council is requested to approve an appeal to the stormwater utility computation for the property at 2121 Glendale Road. Currently, the entire parcel has been categorized as commercial use. Approximately 115 of the property is being utilized as commercial enterprise, with the remaining 4/5 being vacant space. For the purposes of computing the stormwater utility fee for this property, I am recommending that the area containing the commercial operation and driveway be categorized as commercial use, with the remaining space being re- categorized as open/vacant. The resulting fee would be a combination of a charge for a vacant lot for the undeveloped portion of the property, and a per acre charge for the developed portion. If approved, the annual charge would be reduced from $1,102.10 to $323.40 ($80.85 /quarter). The adjusted rate for the property would take affect for the next billing cycle (July 2010) as per the Stormwater Utility Ordinance, Chapter 51.10, Subd. F "No adjustments to the utility fee shall be made retroactive." Should the property be developed any further or redeveloped, a new analysis would be performed and any recommended adjustments to the fee would be brought before the Council at that time.
