REQUEST
Wallin Ltd Partnership seeks Final Plat approval of Wallin 14th Addition consisting of 11
single family lots located in the vicinity of General Sieben Drive and the Vermillion River.
PLANNING COMMISSION REVIEW
The Planning Commission voted 6 -0 to recommend approval of the plat at the May 10,
2010 meeting. Commissioners had the following comments:
• Concern over future erosion at the Vermillion River Bend adjacent to Lot 3, Block
3.
• Support driveway turnarounds for lots fronting General Sieben Drive.

BACKGROUND INFORMATION
Preliminary Plat & Master Development Agreement
The property is part of the Wallin Preliminary Plat and Master Development Agreement
approved by the City Council on July 8, 2002. The Plat and Agreement grant
development approvals for a ten year period. The Final Plat is consistent with the 2002
Preliminary Plat.
Comprehensive Plan Classification
The property is guided U -I, Urban Residential (1 -3 units per acre).
Zoning Classification
The property is zoned R -1 - Low Density Residence.

Sewer Interceptor Fees have been previously satisfied.
Private Roadways
Two private roadways are proposed to provide individual lot access as follows:
Chantrey Trail — Block 1, Lots 2 -4
Shoreline Trail — Block 3, Lots 1 -3
Utility easement documents shall be recorded against the properties to ensure access.
Construction of the private roadways must meet city standards for emergency access.
Chantrey Trail shall be 20 foot wide with bituminous surfacing and the ability to carry
larger maintenance equipment.
Public Utility Easements
The City requests public easement access be granted over private utility lines to serve
properties in emergency situations. If public easements are not granted, the City
requests a letter from the developer outlining emergency access rights.
Dakota County Plat Commission
The Dakota County Plat Commission will review the plan on May 10 prior to the
Planning Commission Meeting. Plat Commission recommendations will be brought
forward at that time. The Commission reviews subdivisions adjacent to county
highways for right -of -way and access purposes.
Vermillion River Watershed Joint Powers Organization - VRWJPO
The VRWJPO regulates certain land use along the Vermillion River. VRWJPO has
called for conservation buffers to be established along properties abutting the river. The
City contends that the 2002 Preliminary Plat and Grading Approval was granted prior to
adoption of the Vermillion River Rules (2007), and should be exempt. The developer
and City are working to resolve this issue with the VRWJPO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HASTINGS
APPROVING THE FINAL PLAT OF WALLIN 14 ADDITION CONSISTING
OF 11 SINGLE FAMILY LOTS

Resolution and moved its adoption:
introduced the following
WHEREAS, Wallin Limited Partnership has petitioned for Final Plat approval of
WALLIN 14 ADDITION, subdividing +/- 14.71 acres into 11 single family lots. The
property is generally located east and west of General Sieben Drive near the Vermillion
River; legally described as Outlots E, F, and K, WALLIN 10 ADDITION, Dakota
County, Minnesota; and
WHEREAS, on July 8, 2002 The City Council approved the Preliminary Plat,
and Master Development Agreement of said property, subject to the conditions of the
Staff Memorandum to the City Council; and
WHEREAS, on May 10, 2010, the Planning Commission of the City of Hastings
reviewed the Final Plat as required by state law, city charter and city ordinance; and
forwards to the City Council a recommendation of approval.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HASTINGS AS FOLLOWS:
That the City Council of the City of Hastings hereby approves the Final Plat of WALLIN
14 ADDITION subject to the following condition:
1) Adherence to the Preliminary Plat and Master Development Agreement as
approved by the City Council on July 8, 2002, including:
A. Private covenants, conditions, and restrictions shall be recorded against all
affected lots to address ponding areas, side yard and rear yard utility
easements, and private drives.
Council member moved a second to this resolution, and upon
being put to a vote it was unanimously adopted by all Council members present.

Chair Zeyen called the meeting to order at 7:00 p.m.
1. Roll Call
Commissioners Present: Bullington, Peine, Rohloff, Slaten, Stevens, Zeyen
Commissioners Absent: Vaughan

Associate Planner Justin Fortney
2. Approval of Minutes —April 26, 2010
Motion by Commissioner Slaten to approve the April 26, 2010, meeting minutes as
presented. Seconded by Commissioner Rohloff.
Upon vote taken, Ayes 6, Nays 0. Motion carried.
OTHER ACTIONS
Wallin Partnership — Final Plat 92010 -21 — Wallin 14 Addition — Creation of 11
New Single - Family Lots.
Community Development Director John Hinman presented the staff report.
Commissioner Peine asked if the proposed private road would continue one day as a
public road and if any public money will be used for the private road including utilities,
paving, maintenance, or plowing. Hinman said no public funds will be used for it and it
will not continue on as a public road.
Commissioner Stevens asked why one lot is being allowed direct access to General
Sieben when it is usually not allowed to collector roads. Hinzman said there are steep
grades in the area preventing access to the private road. Hinman added that the few lots
on the east side of Sieben with frontage also were granted preliminary approval in the
past and are also allowed under the present agreement.
Stevens asked if the Shoreland Ordinance applies to this plat_ Hinzman said the
Shoreland Ordinance in effect in 2002 would regulate the development.
Peine said the buffer would stop chemically treating manicured lawns right up to the
river. Even though the contract prevents the buffer can we still require the buffer because
conventional wisdom has changed since then. Hinzman stated that the agreement could
only be amended with the consent of the developer.
Peine asked if in future contracts there could be a clause written addressing
environmental regulatory changes. Hinzman said those could be included in future
contracts.
Stevens asked whose responsibility is the bank stabilization along the Vermillion River.
Hinzman said it would be the current property owner.
Greg Sjodin, agent, said they worked with Jim Davidson at the County to develop a
remediation plan, which we enacted. He added that the County periodically inspects the
stabilization work they did to make sure it holds -up.
Commissioner Rohloff asked if a trail will be located in this area. Hinzman said there
may be one in the future located in the right -of -way.
Commissioner Slaten asked if there would be a 45 -foot diameter turnaround or would it
be an in and out style. Hinzman said the applicant would work with the Fire Department
on their requirements.
Chair Zeyen asked if the lots fronting General Sieben Drive would be required to install
turnarounds in their driveways. Hinzman said that requirement may be in the agreement
from 2002.
Stevens said he would like to see an inspection done of the mitigated river bank.
Hinzman said he would pass that comment along.
Slaten said he wishes something more could be done to warn perspective buyers of the
possible maintenance responsibilities along the bank because buyers beware is not
enough.
Motion by Stevens to approve the final plat with the following comments. Seconded by
Bullington.
Upon vote taken, Ayes 6, Nays 0. Motion carried.
• Inspect bank for possible erosion.
• Lots directly accessing General Sieben Drive should have turnarounds.
