Re: Temporary Liquor License Amendment and Outdoor Music
Request for the Bierstube, 109 Il Street West
Date: May 11, 2010
Council Action Requested:
Approve the attached resolution approving outdoor music beyond 10 p.m. and a
temporary liquor license amendment for the Bierstube, 109 11 "' Street West.
Background Information:
Rob Groth of the Bierstube has requested an amendment to their liquor license to allow
for a tent on Saturday, June 5, and Saturday September 18, 2010. Beverages will be
served, and music is proposed to be playing 7:30 pin until 12:00 midnight on Saturday
June 5 and Saturday September 18, 2010. Staff has reviewed the request and will work
with the licensee on ensuring proper access and security are maintained.
The City Council recently adopted a policy to guide requests for playing music outdoors
by establishments. Music that ends before 10 pm is permitted and requires no licensing
by the City. Outdoor music after 10 pm needs to be licensed by the City.
HPD Review:
According to the Police Department there have been no formal complaints filed
regarding outdoor music at this location. Staff is not aware of any complaints received.

RESOLUTION NO. 05- -10
RESOLUTION APPROVING LIQUOR LICENSE AMENDMENT AND OUTDOOR TENT
WITH MUSIC FOR THE BIERSTUBE JUNE 5, 2010 AND SEPTEMBER 18, 2010
WHEREAS, Mr. Rob Groth, on behalf of the Bierstube has presented application to the City of
Hastings to amend the liquor license to allow for a tent outdoor music and serving alcohol within the
confines of the tent as submitted to the City at the Bierstube, located at 109 Vermillion Street, Hastings,
MN 55033 on Saturday, June 5 and Saturday, September 18; and
WHEREAS, a written request has been submitted; along with a map of the proposed layout; and
WHEREAS, the Bierstube's request is approved with the following conditions:
• Outdoor music is approved from 7:30 p.m. — Midnight on June 5 and September 18, 2010;
• Site layout will be as proposed by the Bierstube as included in the May 17, 2010 City
Council Packet;
• The liquor license is hereby amended to allow serving of alcohol within the confines of
the tent corral area and all alcoholic beverages must remain in the corral or within the original
licensed Bierstube;
• Proof of Insurance of the temporary liquor sales must be provided in advance of the event;
• Final review by both the City's Fire and Police Departments regarding security, access, and
any other public safety concerns;
• All fees must be paid in advance of the event
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hastings that the
Mayor and City Clerk are authorized and directed to sign this resolution with the conditions as outlined
above.
