Back round Information: Tom Reinardy of Tubby's Bar and Gill has requested an amendment to their liquor license to allow for a tent on Friday, July 16, Saturday, July 17, and Sunday July 18, 2010 as part ofRivertou -n Days. Beverages will be senTed, and music is proposed to be playing 8 Pm until 12:00 midnight on Friday, July 17 and on Saturday July 18. Staff has reviewed the request and will work with the licensee on ensuring proper access and security are maintained. The City Council recently adopted a policy to guide requests for playing music outdoors by establishments. Music that ends before 10 pin is permitted and requires no licensing by the City. Outdoor music after 10 pn needs to be licensed by the City. HPD Review: According to the Police Department, there have been no formal complaints filed regarding outdoor music at this location. Staff is not aware of any complaints received. If you have any questions, please let one know. s,±CI � 1 CITY OF HASTINGS DAKOTA COUNTY, MINNESOTA RESOLUTION NO. 05- -10 RESOLUTION APPROVING LIQUOR LICENSE AMENDMENT AND OUTDOOR TENT WITH MUSIC FOR TUBBY'S BAR AND GRILL JULY 16, 17, AND 18, 2010 WHEREAS, Mr. Tom Reinardy, on behalf of Tubby's Bar and Grill has presented application to the City of Hastings to amend the liquor license to allow for a tent outdoor music and serving alcohol within the confines of the tent as submitted to the City at Tubby's Bar and Grill located at 412 Vermillion Street, Hastings, MN 55033 on Friday, July 16, Saturday, July 17 and Sunday July 18, 2010; and WHEREAS, a written request has been submitted; along with a map of the proposed layout; and WHEREAS, Tubby's request is approved with the following conditions: Outdoor music is approved from 7:00 p.m. — Midnight on July M and 17, 2010; • Site layout will be as proposed by Tubby's as included in the May 17, 2010 City Council Packet; • The liquor license is hereby amended to allow serving of alcohol within the confines of the tent corral area and all alcoholic beverages must remain in the corral or within the original licensed Tubby's Bar and Grill; • Proof of Insurance of the temporary liquor sales must be provided in advance of the event; • Final review by both the City's Fire and Police Departments regarding security, access, and any other public safety concerns; • All fees must be paid in advance of the event NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hastings that the Mayor and City Clerk are authorized and directed to sign this resolution with the conditions as outlined above. Outdoor music after midnight is not permitted. Calls regarding loud music will be responded to on a complaint basis and the City of Hastings reserves the right to direct changes to the outdoor music as deemed necessary.
