HomeMy WebLinkAbout20100503 - VI-08 MEMORANDUM TO: Honorable Mayor and City Councilmembers FROM: Dave Osberg, City Administrator DATE: April 29, 2010 SUBJECT: Local #49 Union Memorandum of Understanding RECOMMENDED CITY COUNCIL ACTION It is recommended that the City Council take action approving the attached Memorandum of Understanding with the Local #49 Union as relates to the TRAC Drivers and a one time severance program. BACKGROUND At the City Council meeting on Monday April 5, 2010 direction was provided to Staff on certain parameters that might be considered for additional severance for those TRAC Drivers impacted by the change to the Transit Link program. Throughout the last month, Staff has discussed several times with the Union representation items to consider for including in the Memorandum of Understanding. The attached MOU illustrates the items that each party could agree: certain severance payout; letters of reference and opportunity for seasonal work. In addition, a provision recognizes that this does not establish a past practice, nor binding for future similar situations. David M. Osberg City of Hastings and IUOE Local #49 Memorandum of Understanding TRAC Drivers and Severance Program The Purpose of this Memorandum of Understanding is to outline additional benefits the City of Hastings is granting to the following TRAC Drivers. Tom Dixon Tom Friese Shirly Soggiorno James Cernhous Phillip Juneau Wayne Ruona As a result of the Metropolitan Council implementing a new transit program and eliminating any further funding for the City of Hastings TRAC program; and Because of this action by the Metropolitan Council, the City of Hastings is unable to operate the TRAC program, and thus no longer provide TRAC bus drivers positions to the above mentioned employees; and As a result of, and due to these un-precedented and uncontrollable circumstances, the City of Hastings and IUOE Local #49 mutually agree to the following: a.) TRAC Drivers with fewer than ten (10) years of service will be compensated 25% of their unused sick leave. b.) The City will provide each TRAC Driver who requests, ten (10) original copies of a letter reference. The letter shall be specific to individual employees and include the following: date of hire; last date of employment; explanation for the reason for the positions are no longer in existence and the list of job requirements and job duties of the TRAC Driver position. c.) Those TRAC Drivers interested in seasonal work for the City of Hastings in the summer months of 2010 shall be provided an opportunity to do so, provided they notify the Employer by May 10, 2010 and are able to meet the requirements of the seasonal position. The terms agreed to in this Memorandum of Understanding are specific to the situation of the elimination of the TRAC department as a result of loss of federal and state funding. Nothing in this memorandum of understanding shall be construed as a past practice or binding for future similar situations. FOR THE CITY OF HASTINGS: FOR I.U.O.E. LOCAL No. 49: David M.
