Charter Commission Meeting
City of Hastings
October 21, 1999

CALL TO ORDER AND DETERMINATION OF UORUM
Chair Terry Sieben called the meeting to order and declared a quorum present
APPROVAL OF MINUTES
Joan Bolesworth stated that the minutes from the meeting on April 15, 1999 should
properly reflect that she was absent from the meeting.
Moved by Boleswarth, seconded by Biasing to approve the minutes of the April 15, 1999
Charter Commission meeting, as corrected. All voted in favor.
UNFINISHED BUSINESS
There was no unfinished business far the Charter Commission to address.
NEW BUSINESS
The Charter Commission reviewed City Charter Section 7.12 "Gifts and Gratuities"
Moved by Bolesworth, seconded by Hoffman to accept section 7.12 of the City Charter
without the need to make any changes. All voted in favor.
OTHER BUSINESS
The Charter Commission reviewed the provisions regarding emergency ordinances and
emergency meetings to determine if any changes are needed. Moved by Bolesworth,
seconded by Biasing directing staff to review these provisions of the City Charter to
determine if changes are needed, and report back at the next meeting of the Charter
Commission. All voted in favor.
The Charter Commission confirmed that the next meeting would be conducted on
Thursday January 20, 2000 at 7:00 PM at the Hastings City Hail.
ADJOURNMENT
Moved by Bolesworth, seconded by Hoffman to adjourn the meeting at 7:30 PM. All

SECTION 4.01. COUNCIL MEETINGS.
REGULAR MEETINGS. On the first Monday after ~ the first Saturday in 3anuary
lowing a regular municipal election, the Council shall meet at the Council Chambers in
;City Hail at such time as specified by Ordinance for a regular Council meeting. At this
ie the duly elected members of the Council shall assume their duties. Thereafter the
~uncil shall meet at such times as may be prescribed by ordinance or resolution except
-t they shall have a# least two regular meetings each month. Provided that if any regular
:eting shall fall on a holiday or if it appears that a quorum of the Council will not be able
be present for a scheduled meeting the meeting shall be .held when a quorum of the
~uncil would be present. All meetings of the Council and its committees . and
committees shall be open to the public in compliance with the provisions of state law.

;tem at all regular Council meetings. ~ .
SPECIAL COUNCIL 1VIEETINGS. The Mayor, or any three members of the Council

EMERGENCY COUNCIL MEETING ; The Mayor, or any three members of the
~uncil may call an emergency meeting of the council upon one hour's notice to -each
ember of the council. Such notice.shall be delivered personally to each member or shall
.left with some person of suitable~age and discretion at-the usual place of abode of the
:tuber. Emergency meetings may ~be called only to deal with anexisting-emergency to the
.blic health, safety or welfare of the' community or its residents. Only matters relating to
id emergency may be considered at said meeting. The City shall also comply with all
quirements of the open, meeting law in effect at that time.
SECTION 4.02. APPOINTED OFFICERS.
CITY CLERK. The City Administrator shall appoint a City Clerk who shall hold
l•~ice under such terms and conditions as the City Administrator may .prescribe. The City
.erk shall serve as Secretary of the City Council and shall keep such records and perform
ch duties as may be required by this charter, by ordinance or resolution of the City
~uncii, or by State law. The City Clerk may hold any other city a£fice not inconsistent
erewith and may be charged with such administrative or managerial duties as the City
~ministrator shall determine.
CITY ADMINISTRATOR. The City Administrator may hold any other appointed
tY office not inconsistent therewith, including the office of City Clerk.

SECTION 4.05. EMERGENCY ORDINANCES. An emergency ordinance is an ordinance
necessary far the immediate preservation of the public peace, health, morals, safety, or welfare, in
which ordinance the emergency is defined and declared in a preamble thereto. An emergency
ordinance must be approved by a majority of the entire City Council. An emergency ordinance must
be in writing but may be enacted without previous filing or voting, and may be passed finally at the
meeting at which it is first introduced and voted upon, by one vote of the Council. An emergency
ordinance shall remain in effect for the duration of the emergency and shall become void when the
emergency no longer exists. No

SECTION 4.06. RESOLUTIONS LANDY O'I~OIV : `~A~ powers excep~'1'egi'~l~ti~'~~~o~ers
enacted by ordinance.shall be exercised by a resolution~ar motion. Any Councilmembet or the Mayor
may require the reading in full of a motion or resolution before a vote is taken thereon. Resolutions
and Motions shall take effect immediately upon their passage.
SECTION 4.07. REVISION AND CODIFICATION OF ORDINANCES. The City may
revise, rearrange and codify its ordinances with such additions and deletions as may be deemed
necessary by the City Council. Such ordinance code shall be published in book, pamphlet or
continuously revised loose-leaf form and copies shall be made available by the City Council at the
office of the City Clerk for general distribution to the public at a reasonable charge. Publication in
such a code shall be a sufficientpublication of said ordinances contained in the codification, including
any-ordinance provision not previously published, if a notice that copies of the codification aze
available at the office of the City Clerk is published in a newspaper of general circulation in the City
for at leapt two successive weeks before the effective date of said codified ordinances.
SECTION 4.08. AMENDMENTS OR REPEAL OF ORDINANCES. Every ordinance upon
its passage may be codified and recorded in a separate book ar books kept for that purpose. ~ --
Ordinances maybe amended, either wholly or partially, ar repealed, by reference to their sections, `
subsections or su$pazagraphs. It shall not be necessary in the case of amending an ordinance, to
completely restate the entire section or sections to be amended.
- SECTION 4.09. CONFLICT OF INTEREST. Except as otherwise permitted by Minnesota
Statutes, any member of the City Council or of any City Commission who has a substantial financial
interest in a matter which comes before that body for discussion, deliberation or decision shall, at the
commencement of such discussion, deliberation ar decision, relinquish his or her place on such body.
He or she may participate in such discussion, deliberation ar decision only as a member of the public,
and shall resume his or her place on such body only a$er that matter has been decided or otherwise
disposed of from the agenda of that meeting.
