March 6, 1986
Present: Mike Havgaard, Judy Gilbert, Jeanne McGree, Want Hartman,
Sharon Avent, Dick Dobrick, Earl BeJ.tz and Janice Johnson.
Absent: Chuck Caturia and Marie Bolden
Public: Daryl Plath and Lu Stoffle
The meeting was called to order by W. Hartman, acting Chairperson at
7:35 in the City Hall Council Chambers.
S. Avent moved to accept the minutes with J. Gilbert seconding. Motion
was passed and carried,
J. Johnson reported on the sub-committee meeting regarding the CA and
their recommendations to the Commission.
Question regarding Ordinance and charter. W. Hartman,--- in talking with
the attorney -- council cannot adopt an ordinance contrary to charter.
Charter always prevails.
W. Hartman reported for C. Caturia an attorney From Bloomington who sits
on Council there will be at the next meeting to take our~deas and
suggestions and put them in legal/charter language. After the attorney
provides us with proper language the changes will be sent to the League
for review as to any conflict with state statute.

City Council -- (a) eliminate wards, all elections at large - ~ year term
-fall back position -- one councilpersan per ward two at-large
(c) reduce council to ~ persons and mayor (d) fall back position -
6 councilpersons and mayor.
No action taken --- no motion. was made on any of the above, Little
discussion took place on the above.
The M~a -or -- (a) increase term i'rom 2 to 4 years (b} kill fledged member
votes on all ~:ssues - no veto (e) presides - must relinquish chair to
advocate (d) delete 3.05 oversight sentence (e) amend 3.05 to 2.08 Winona.
3.D5 -- The mayor sha11 study the perations of the City Govt., shall report
to the council any neglect, detelection of duty or waste an the part
of any officer or dept., and may periodically report to the council on
the status of City operations.
Motion was not made on aa~y of the above. No action was taken.
L. Stoffle was in doubt on number of council people and mayor voting.
There will always be an odd number including the mayor's vote. Mayor
recommends the mayor not vota.ng on each issue.

day city operations (b) Administrator appoints police chief - Chief of
Police responsible to CA. (c) charter defined functions.
W. ~Iartman suggested item b be done last.

The Council_ agenda ~. (a) Charter defined cut-off date ---- (b) Non-
agenda items deferred to next meeting and referred to committee and staff
for study and recommendation,
J. Gilbert - is this something that si~.ould be set in the charter.
W. ~iartman - policy is not being set by council then it should be in the
Charter.
Discussion --- this would eliminate the public throwing something at the
council far vote ar~d not having the proper studies done before voting.
items would be deferred automatically.
Question -- what about items that come up that needs action immeda.ately?
Council can determine that these are emergency items that can be acted
on.
Farl Beltz moved with Dick Dabrick seconding -- Items for the Council's
Agenda may not be included in the agenda if not submitted at least (5)
days in advance of the Council meeting. Von--agenda items shall be
deferred to the next council meeting and should be referred to staff for
study and recommendations except in case of an emergency declared by
Council. The motion wa.s passed and carried.
City Administrator - item B - W. H~.rtman spoke with the Police Chief
and City Attorney about .the matter of the PD being under the CA or
mayor. He had no preference but leans toward all city depts. including
the PD subject to the CA, now had doubts as which way to go and referred
us to Item 3.11 which was developed by .~,~. Hartman.
D. Plath - Police Civil Service Commission is under state statute and was
instituted to take the political involvement out of the PD. It was adopted
by the City in 1959. Referring to 3.11 -- what is described here i~
what is being done now. W. Hartman -~ what a~s being done now is not
how the Charter reads.
E. Beltz moved with :~'I. Hovgaard seconding -- the police chief is responsible
to the Mayor as described in Sec. 3.11 as prepared by W. Hartman with
the addition of Police to the Civil Service Commission in line 17.
Motion passed with J. Johnson voting no.
Secretary's note: Previous action on this matter-please see minutes
dated January 9, 19g~ item ~9. Phis conflicts and a.motion is needed
to rescind that votes
There being no further business M. Hovgaard moved for adjournment
with Dick Dobrick seconding.
Next meeting March 20, 1986 with the attorney.
