Melanie, we should be ok with the public hearing on April 5th. Minn. Stat 331A.05 subd 7 provides the an error not the fault of the political subdivision does not effect the validity
of the event to which the notice relates. Assuming no staff or councilmember request that the public hearing be resent and new notice be published, the Council can proceed with the
hearing. I do think the Council should be made aware promptly of the situation and notified that the print and online publications are corrected and the correct notice will be
published next Thursday which is well in advance of the hearing. I assume the HSG will get to you a proof of the corrected publication for proofing before publication.

Hi Dan—hope you’re enjoying sunny Florida! Just need to touch base with you on the publication of the charter amendment. I checked the paper this morning, and the version I sent
to HSG wasn’t completely included in the publication. Specifically, the section 3.11 where it refers to the powers of the CA and the new language would strike the exemption of the
police department/chief, was not included as language to be deleted—it was just listed as regular language. Then I went online and the entire posting was incorrect; none of the
3.06: Mayor-Law Enforcement was struck through as proposed to be deleted and the same situation with Section 3.11. I called Jean immediately and they are going to correct the online
version and re-run the correct notice in the paper next week, but obviously cannot rerun the correction for this week’s paper notice. Here’s my question—does this error by the
HSG impact our ability to hold a PH on April 5? All other notices (website, CH) are accurate, and the correct notice was submitted to HSG; they just messed it up.
Sorry to bother you on vacation, but if this is an issue, I want to make the Council & Dave (and charter commission) aware of it ASAP.
