Chair McInnis called the meeting to order at 7:00 p.m.

Approval of Minutes
2. ?January 11, 2010
Motion by Commissioner Bullington to approve the January 11, 2010, meeting minutes as
presented. Seconded by Commissioner Stevens.
Upon vote taken, Ayes 4, Nays 0. Motion carried.
PUBLIC HEARINGS
Tiller Corporation ?Special Use Permit #2010-03 ? Operation of a Hot Mix Asphalt

Associate Planner Barker provided a staff report.
Chair McInnis opened the public hearing at 7:05. Mike Caron, Tiller Corporation spoke for
the applicant and stated he was open to answering any questions. Hearing no comments from
the public, the public hearing was closed at 7:05.
Motion by Commissioner Vaughan to recommend approval of the Special Use Permit to
Operate a Hot Mix Asphalt Plant. Seconded by Commissioner Bullington.
Upon vote taken, Ayes 4, Nays 0. Motion carried.

Associate Planner Barker provided a staff report.
Motion by Commissioner Vaughan to recommend approval of the Special Use Permit for a
Soil Processing Permit. Seconded by Commissioner Bullington.
Upon vote taken, Ayes 4, Nays 0. Motion carried.
City of Hastings ? Ordinance Amendment #2010-05 ? Amend Residential Accessory

Structure Requirements.
Associate Planner Barker provided a staff report.
Commissioner Bullington thanked staff for their work on the Ordinance Amendment.
Commissioner Stevens inquired why the size requirement for a Special Use Permit was being
proposed at 750 square feet. Planning Director Hinzman stated the number was picked
because 750 square feet is approximately the size of a three car garage. Commissioner
Stevens stated he has expressed desire at a previous meeting to have the size be 500 square
feet for homes with an attached garage and 750 square feet for homes with a detached garage.
Commissioner Vaughan inquired as to the size of a two-car garage. Planning Director
Hinzman stated it was about 500 square feet.
Commissioner Vaughan asked if neighbors would be notified for garages over 750 square feet.
He stated that 750 square feet might be too high of a threshold as it is still a large garage.
Planning Director Hinzman reminded Chair McInnis that a public hearing needed to be held.
Chair McInnis opened the public hearing at 7:13. Hearing no comments from the public, the
public hearing was closed at 7:13.
Planning Director Hinzman stated that he did hear from one resident questioning the benefit of
requiring a Special Use Permit.
Commissioner Bullington stated in response to the comment from the resident that the reason
for the Special Use Permit was due to the impact on the neighborhood. In addition, it gives
property owners a voice in the process. Finally, a Special Use Permit would provide public
disclosure. Commissioner Bullington stated he thought 500 square feet would be an
appropriate threshold for requiring a Special Use Permit.
Commissioner Stevens requested clarification that Special Use Permits cannot be denied, only
conditions place upon the permits. He further inquired about view preservation.

Planning Director Hinzman stated that there is nothing in the code relating to view
preservation. He confirmed that conditions can be placed on a Special Use Permit, but a
Special Use Permit cannot be denied. Planning Director Hinzman stated that if the Special
Use Permits meets the requirements of the ordinance, it must be approved, but conditions can
be attached to it.
Commissioner Vaughan inquired into the staff time required in relation to the permit fee.
Commissioner Bullington asked if the Tree Ordinance was being followed. Planning Director
Hinzman clarified that it is a Tree Policy, but not a Tree Ordinance. He stated that, in the past,
trees for residential projects had not been closely reviewed.
Commissioner Stevens asked if this would affect all residential zoning codes. Planning
Director Hinzman stated it would affect all residential zoning codes.
Motion by Commissioner Bullington to recommend approval of the Ordinance Amendment to
amend Residential Accessory Structure Requirements with the modification to require a
Special Use Permit for accessory structures over 500 square feet. Planning Director Hinzman
asked for confirmation that this square footage would apply to both attached and detached
accessory structures. Commissioner Bullington confirmed this.
Seconded by Commissioner Vaughan.
Upon vote taken, Ayes 3, Nays 1 (Stevens). Motion carried.
Stevens voted against the item as he desired the Special Use Permit for a 500 square foot
structure to apply to homes with an attached garage and 750 square feet for homes with a
detached garage.

Planning Director Hinzman provided a staff report.
7.Other Business
Planning Director Hinzman updated the Commission on upcoming items.
