HomeMy WebLinkAbout20100119 - CC Minutes 20100104 Hastings, Minnesota City Council January 4. 2010 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday th January 4, 2010 at 7:00 PM in the Council Chambers at the Hastings City Hall, 101 East 4 Street, Hastings, Minnesota. Members Present: Mayor Hicks, City Councilmembers Alongi, Balsanek, Hollenbeck, Nelson, Elling Schultz and Slavik Staff Present: City Administrator Dave Osberg City Attorney Dan Fluegel Assistant City Administrator Melanie Mesko Lee Planning Director John Hinzman Pioneer Room Curator Cindy Smith Presentation—Don Kramlinger Mayor Hicks and the City thanked Mr. Kramlinger for his service to the community and the collaboration and advocacy he brought to the position. A reception will be held Thursday, January 14 from 4-7 p.m. at the Green Mill. Presentation—Repaired and Rebound City Council Minute Books Volume 1: June 1857 to May 1867 Volume 3: November 1873 to August 1887 Curator Smith stated that the books were rebound using donated funds. They can be viewed in the Pioneer Room. The Council thanked Smith for her work on preserving the City’s history. Approval of Minutes Mayor Hicks asked if there were any corrections or additions to the minutes of the regular City Council meeting on December 21, 2009. Hearing none, the minutes were approved as presented. Consent Agenda Moved by Councilmember Slavik, seconded by Councilmember Alongi to approve the Consent Agenda as presented. 7 ayes; Nays, None. 1. Approve Amendment to Flexible Compensation Plan Document Public Hearing—Consider Street Closing Request for 2010 Historic Hastings Saturday Night Cruise-In Events City of Hastings January 4, 2010 City Council Minutes Page 2 of 3 Assistant City Administrator Mesko Lee introduced the item and clarified that parking on Eddy is not included, contrary to the map that was distributed. Mayor Hicks opened the public hearing at 7:15 p.m. Hearing no comments, Mayor Hicks closed the public hearing at 7:15 p.m. Approve Request by DBA for 2010 Historic Hastings Saturday Night Cruise-In Events Moved by Councilmember Hollenbeck, seconded by Councilmember Alongi to approve as presented. 7 Ayes; Nays, none. Authorize Letter of Credit Reduction—Westview Properties LLC (Westview Packaging) Planning Director Hinzman introduced this item. Moved by Councilmember Slavik, seconded by Councilmember Schultz to approve as presented. 7 Ayes; Nays, none. rd Hearing—SuperAmerica South (215 33 Street West) Liquor License Compliance Check Violation Hearing—SuperAmerica West (1390 South Frontage Road) Liquor License Compliance Check Violation City Attorney Dan Fluegel stated that both SuperAmerica locations had stipulated to the first civil penalty violations, which would be a $1,000 civil penalty and a three-day license suspension to be served January 20, 21, and 22, 2010. Fluegel noted that no hearing has been requested by the applicant, and should any changes to the stipulation be made, the item will need to be brought back before the Council for action. Moved by Councilmember Alongi, seconded by Councilmember Nelson to accept the rd stipulation for SuperAmerica South (215 33 Street West) as presented. 7 Ayes; Nays, none. Moved by Councilmember Hollenbeck, seconded by Councilmember Nelson to accept the stipulation for SuperAmerica West (1390 South Frontage Road) as presented. 7 Ayes; Nays, none. Hearing—Wal-Mart (1752 North Frontage Road) Liquor License Compliance Check Violation City Attorney Fluegel introduced the item and stated that Wal-Mart has waived their formal hearing. Cody Schmitz, the Wal-Mart manager confirmed waiving the hearing and was available for any questions from the Council. Moved by Councilmember Nelson, seconded by Councilmember Schultz to treat this as a second violation within 24 months and order a $1,500 civil penalty and six-day license suspension to be served February 1-6, 2010. There was discussion about Wal-Mart’s previous violations, the first which occurred within 27 months of the third violation, and their proposal to remedy illegal sales to youth. Mr. Schmitz stated that he had been manager since August 2009 and is currently reviewing the process and training that has occurred and is considering participation in the City’s Best Practices Program. Councilmember Alongi stated that the current motion for penalty and suspension is not stringent enough. Councilmember Slavik concurred. There was discussion on serving concurrent day suspension or parsing it out over a number of weekends. City of Hastings January 4, 2010 City Council Minutes Page 3 of 3 Councilmember Alongi offered a friendly amendment, which was accepted, to amend the original motion to order a $1,500 civil penalty and a nine-day license suspension to be served January 28-February 6, 2010. 7 Ayes; Nays, none. Discussion—Hastings Facebook Page City Administrator Osberg introduced the item and requested conceptual approval of the City creating a City Facebook page. Moved by Councilmember Schultz, seconded by Councilmember Hollenbeck to approve as presented. 7 Ayes; Nays, none. Discussion—Core Values City Administrator Osberg introduced the item and provided information on the staff work to date on development of core values and implementation and communication to staff and the public. New Business Councilmember Balsanek asked staff to look into whether the handicapped parking is adequate for downtown. Announcements ? Councilmember Nelson was wished a happy birthday. ? The next Council meeting will be on Tuesday, January 19 at 5:30 p.m.; City offices will be closed on Monday, January 18 in honor or Martin Luther King, Jr. Day ? The Charter Commission will meet on Wednesday, January 13 at 7:00 p.m. Mayor Hicks asked the Commission to look into the current police department structure as part of their work. ?
