REQUEST
The Planning Commission is to review and discuss the Accessory Structure Ordinance.
HISTORY
The Planning Commission reviewed and discussed the Accessory Structure Ordinance at its
November 9 and November 23, 2009, meetings. The review of the Ordinance was at the request
of Commissioners, due to an OHDS review for a garage at the September 28, 2009, Planning
Commission meeting.
The two main points of the discussion at the November 23, 2009, meeting was: 1) Tree
replacement and 2) Notification of neighboring properties when a garage is proposed to be built.
Tree Replacement
Staff has amended the Shed and Deck Permit Application to reflect the desire of the Planning
Commission to better enforce the Tree Preservation Policy. A line has been added to the
application that reads, “Identify all trees to be affected by the new structure and see attached
Three Replacement Schedule.”Please see attached amended application.
Notification
The Planning Commission stated its desire to notify neighboring properties to which a garage
permit has been applied. However, these types of building permits are typically handled
administratively and are usually heard before the Planning Commission, unless a variance is
needed due to a side yard size or OHDS review is required. Staff discussed the notification
process with the City Attorney. The City Attorney expressed concern that there was not an
established procedure in place with the notification process. This means that neighbors would be
notified of the intended building structure, but would have no recourse to object to its size,
location, etc. The recommendation of the City Attorney would be to have a procedure in place,
such as requiring a special use permit for garages over a certain size limit.

Replacement trees shall consist of "certified nursery stock" or state inspected transplant
stock as defined by Minnesota Statutes 18.46.
Species Requirement
Where ten or more replacement trees are required, not more than fifty (50) percent of
the replacement trees shall be of the same species without the approval of the City.
