The City Council of the City of Hastings, Minnesota met in a regular meeting on
Monday, May 15, 2000 at 7:00 p.m. in the City Hall Council Chambers, 101 4th Street
East, Hastings, Minnesota.
Members Present:
Councilmember Yandrasits, Riveness, Simacek, Johnson, Hicks,
Moratzka & Mayor Werner
Members Absent:
None
Staff Members Present:
Dave Osberg, City Administrator;

Matt Weiland, City Planner;

Approval of Minutes
Mayor Werner asked if there were any corrections or additions to the minutes of
the regular meeting of May 1, 2000 and hearing none approved the minutes as presented.

Council Items to be Considered
City Administrator Osberg requested that a resolution designating a supervisor for
Building Official Merlin Wilbur be added as Item #5 under City Administrator.

Consent Agenda
Moved by Councilmember Simacek, seconded by Councilmember Riveness, to
approve the Consent Agenda as presented.

3. Resolution No. 5-4-00-Supporting the Planning for the Grand Excursion 2004

Hearing-Temporary Liquor License Suspension
Mayor Werner opened the Hearing at 7:05 p.m. City Attorney Shawn Moynihan
stated that Council has two determinations to make; One: whether an illegal sale took
place as alleged at the Liquor Locker and, if so, what kind of penalty shall be imposed on
the Liquor Locker for said violation.
Landis Iverson, owner of the Liquor Locker was present; he stated that this was
an unfortunate incident but as a local businessman for eighteen years in the City of
Hastings, he requested lenience from the Council.
Hearing no further comment, the hearing was closed at 7: 10 p.m.

Temporary Liquor License Suspension
Moved by Councilmember Hicks, seconded by Councilmember Riveness, to
impose a two-day suspension on the Liquor Locker from selling alcoholic beverages.
The dates to be Monday, May 22od and Tuesday, May 23, 2000. Staff was also directed
to research the possibility of establishing a standardized penalty progression for liquor
license violations.

Public Hearing-Proposed Ordinance Delegating the City & HRA to Exercise City's
Housing Powers
Mayor Werner opened the Public Hearing at 7:16 p.m. hearing no public
comments the public hearing was closed at 7: 17 p.m.
Moved by Councilmember Moratzka, seconded by Councilmember Hicks, to
approve the proposed ordinance delegating the City and HRA to exercise City's housing
powers.

Street Vacation-Portion of Bass Street
Mayor Werner opened the Public Hearing at 7:20 p.m. City Planner Matt Weiland
stated that Clarence Chapman and Elliene Swanson have submitted a petition to the City
requesting the vacation of a portion of Bass Street North of 3rd Street East, which Staff is
recommending approval. Hearing no further public comments the public hearing was
closed at 7 :21 p.m.

Moved by Councilmember Hicks, seconded by Councilmember Yandrasits, to
approve Resolution No. 5-5-00, Street Vacation a Portion of Bass Street.

Setback Variance-616 West 18th Street
City Planner Weiland stated that Paul & Leann Peters of 616 18th Street West
have requested approval of a five-foot variance to the required 20- foot rear yard setback
from property lines to add an addition to the existing home. Weiland also stated that the
Planning Commission voted unanimously to recommend denial of the setback variance at
their May 8th Planning Commission meeting because they did not feel the request met the
variance criteria.
City Attorney Shawn Moynihan stated that Council needed a six out of seven vote
to approve the variance, or four out of seven to deny; if the Council denies the variance,
they must provide Findings of Fact supporting the denial.
Moved by Councilmember Simacek, seconded by Councilmember Johnson, to
deny the request for a variance based on the Planning Commission's recommendations
and Findings of Fact.

Arbor Oaks Development Agreement
Moved by Councilmember Riveness, seconded by Councilmember Yandrasits, to
table this item to the June 5, 2000 City Council meeting.
7 Ayes; Nays, None.
First Reading & Schedule a Public Hearing: Dangerous Dog Ordinance
Moved by Councilmember Moratzka, seconded by Councilmember Hicks, to
schedule a second reading and public hearing for the June 5, 2000 City Council meeting
with Staff to work on some language changes.
7 Ayes; Nays, None.
Fire Chief Appointment
Moved by Councilmember Hicks, seconded by Council member Simacek, to
approve the appointment of Mark Holmes as Fire Chief effective June 1,2000.

Resolution No. 5-6-00-Designating Supervisor for Building Official Merlin Wilbur
Moved by Councilmember Simacek, seconded by Councilmember Riveness, that,
pursuant to Judge Lacey's order dated, May 8, 2000, the Hastings City Council reaffirms
that William Mesaros is the designated Supervisor of Building Official Merlin Wilbur
and Merlin Wilbur is hereby required to report to William Mesaros.

Comments from the Audience
City Planner Matt Weiland stated that the City would be hosting an Open House
from 5:30 p.m. to 7:00 p.m. on May 17th to discuss Hastings MarketPlace Development.

adjourn opened door meeting at 7:45 p.m.
