The City Council of the City of Hastings, Minnesota met in a regular meeting on
Monday, June 16, 2003 at 7:00 p.m. in the City Hall Council Chambers, 101 4th Street
East, Hastings, Minnesota.
Members Present: Councilmembers Hazlet, Hicks, Moratzka, Riveness, Schultz, and

the regular meeting of June 2, 2003. Hearing none, the minutes were approved as

Resolution-8ite Plan #2003-28: 3D-Unit Condo Building: 875 Bahls Drive
(Lawrence Builders)
Moved ~y Council member Moratzka, seconded by Council member Riveness to
approve the rb30lution with the '16 conditions as presented in the planner's staff report.

Resolution-Variance #203-40: 1009 East 3rd Street (Haas)
Staff recommended denial of the variance because staff does not feel that the
applicant has demonstrated sufficient hardship to warrant approval. If the variance is
approved, the house will become a legal, non-conforming structure. The Planning
Commission recommended denial of the variance, citing lack of hardship.
Council member Yandrasits stated that she felt that the applicant does meet the
standards for a setback variance. She stated that special circumstances exist, which
can be used as a finding of fact in the granting of a variance.

approve the n:-. .~uest for a setback varianc'J and deny the request for a variance from the
City's shorela:1d ordinance.

Resolution- TJariance #2003-43: 502 West 7th Street (Mancino)
Planning Director Hinzman stated that the applicant is seeking a variance to build
an attached garage on the site. Staff is recommending approval of the variance. The
Planning Commission considered this request and recommended approval of the
variance. Hinzman also stated that this property is under consideration by the HPC to
be added to the local Heritage Preservation List. A public hearing has been ordered for
July 7,2003 to consider that application.

First Reading-City Code Amendment #2003-38: Downtown Master Plan Zoning
Staff detailed the item before the Council for action at the meeting. The City
Council :8 being asked to consider ordinance amendments for rezoning districts. Any
requests for reLoning specific parcels of ~íoperty would be considered by the Council at
a future date. No action is being requested at this meeting except to order the public
hearing for July 7,2003 to receive comments.
Bess Freeman, 522 Lea Street, read a statement signed by some of the
homeo\^-'ners expressing their opposition to any rezoning proposals.
Clarenue Chapman, 623 East 3rd Street, expressed opposition to any proposal
that would close a 3rd Street access. He requested that &lEast Hastings" be removed
from the redevelopment plan.
Council(nember Hicks stated support for some of the proposed changes. He also
stated that the Council is not required to make any decisions following the public hearing
on July 7; they can wait for more information or more discussion as is deemed
warranted.

approve the first reading and order the public hearing for July 7,2003.

Authorization for Request for Proposa~s-Riveñront Redevelopment
HRA Director John Grossman introduced Jessica Cook of Ehlers and Associates
to provide a br;ef background on the draft RFP that has been prepared. Cook discussed
the goals that; ¡ave been established, the description of the sites, and other details of the
RFP. The Council discussed some language changes that they would like incorporated

authorize the publication and distribution of the RFP, with the changes as discussed.

Pay Estimate #4-Louis Lane Ponding Basin: Pember Construction ($3,567.75)
Counciímember Moratzka requested clarification on whether the overlay has been
completed. Staff will resolve any outstanding issues prior to final payment.

approve the pay estimate as presented.

Adopt thß attachßd resolution that approves a Lawful Gambling Premises Permit Renewal
Application at the Knights of Columbus Hall, located at '3075 Vermillion Street. The license will
be in effect from September 1, 2003 through August '30,2005.

Applfêation ha6 been received for a renewal of a premise permit for lawful gambling at the
Knights of Columbus Hall, located at 3075 Vermillion Street. This application is for a license,
which allows pull-tabs, tipboards, paddlewheels and raffles.
The Applicant has shown documentation that the reporting and donation requirements
established by the City Council have been complied with for the year 2002 and is up-to-date on
reporting requirements for the year 2003.

RESOLUTION APPROVING APPLICATION OF A
PREMISE PERMIT RENEWAL APPLICATION FOR LAWFUL GAMBLING
WHEREAS, the Knights of Columbus 1600 has presented an application to the City of
Hastings to renew their Lawful Gambling Permit at the Columbian Hall, 3075 Vermillion Street,
Hastings, MN 55033; and
WHEREAS, the premise application which permits raffles, paddlewheels, tip boards, bingo,
and pull-tabs; and
WHEREAS, the Knights of Columbus 1600 shall comply with all applicable laws governing
lawful gambling, including the requirement for 50% of lawful gambling expenditures to be used for
lawful purposes with the City of Hastings trade area.
.----NOW" THEREFORE, BE IT RESOLVED by the City Council of the City of Hastings that
the Mayor and Administrative Assistant/City Clerk are authorized and directed to sign this resolution
and forward it to the Minnesota Department of Gaming, Gambling Control Division, showing
approval of this application for a renewal of a Premise Permit at Knights of Columbus 1600,
Columbian Hall, 3075 Vermillion Street. .

Dear Mr. Osberg:
Please accept my letter of intent to retire effective July 14,2003.

I received a letter from Melanie Mesko Lee, Administrative Assistant/City
Clerk, dated October 9,2001, which stated that upon my retirement (after
- my 55th birthday) I am entitled to vacation time, sick and extended leave,
com'pensatory time, and 100% City-paid health insurance for a period of
10 years or until I am eligible for Medicare, whichever comes first. Due to
my medical leave of absence I exhausted all my banked hours but I do
expect to receive the 100% City-paid health insurance. I do wish to
remain with single-family coverage so I believe I do not need to provide a
six-month notification to retire and receive this benefit. I have spoken with
someone at PERA and I will personally take care of my retirement
benefits.
Please let me know if the acceptance of my retirement and approval of
health insurance benefits will be a Consent Agenda item for July 7,2003
or if the matter will be presented to the entire City Council. If you have
any questions, please feel free to contact me.

position vacated by the resignation of full time clerical person Mary Jo Anderson.
We 1íáve evaluated the upcoming budgetary concerns in our current office structure and
will be seeking only a part time clerical position replacement for the full time position
previously held by Ms. Anderson. The part time clerical position would work 20 to 30 hours
per 40 hour work week and would not receive the benefits that a full time clerical position
would receive.

Request to Grade South Oaks 2nd Addition Prior to Preliminary Plat Approval
Council is requested to add to the consent agenda, approval for the South Oaks 2nd
Additional developer to commence grading on the site prior to preliminary plat approval.
Enclosed is a request from the developer's consultant engineer requesting approval to
commence grading to prepare the site for the public street and utility improvements to be
constructed by the City's contractor this summer. The approval requested is similar to
that granted by the Council for School House Square last fall. The developer understands
that grading prior to Council approval of the preliminary plat is done at his own risk.

On behalf of Greg J ablonske, the developer of South Oaks of Hastings 2nd Addition, I
am submitting a written request to proceed with the development mass grading prior
to receiving preliminary plat approval.
I believe preliminary / final plat approval is expected at the 2nd council meeting in
July. Any further comments should be relatively minor. I know timing is of concern
to City Staff as the improvements are going to be a public project. Staff's progress on
the construction drawings should be indicative of the fact that we all feel pretty
comfortable with the grading design.
I understand there is a council meeting on the 7th of July. If Council approval is
needed for this request, I would appreciate it if you could bring this before them.

Public Hearing for Increasing On-Sale Liquor License Fees for 2003/2004

Following a public hearing, Council is requested to approve the increase in on-sale liquor
license fees for the 2003/2004 license year by $500 to $3,400.

State statute requires that cities hold a public hearing, with 30-day notification to
licensees, prior to any increases to on-sale liquor license fees. In 2002, the City Council
held public hearings to amend Chapter 3 of the City Code regulating liquor licenses. As
part of this public hearing process, the City Council also'approved establishing incremental
increases1?o the City's liquor license fees (Resolution 05-13-02). These incremental fees
were approved due to the fact that on-sale liquor license fees had not been adjusted in
ne2;¡rly 10 years yet the staff costs of processing and issuing the licenses had increased
over the years. At their May 20, 2002 meeting, it was Council's direction to increase
these fees by $500, plus a cost-of-living increase, annually until the fees reached $4,000
annually. Licensees were notified of the 2002 public hearing prior to the meeting.
Following the meeting, licensees were also notified of the Council's direction to
incrementally increase fees over a period of approximately 3 years and to add an annual
cost-of-living adjustment to the annual license fee.
On April 7, 2003, the Council adopted Resolution 04-03-03, which increased the
2003/2004 fees by $500 plus a 31'0 cost-of-living adjustment, for a total annual increase
of $515, consistent with their direction in 2002. This increase brought the annual on-sale
liquor license fee to $3,415, which is billed Y2 at time of renewal in June & Y2 in December.
When renewal paperwork for 2003/2004 liquor licenses were sent out, a copy of the 2003
resolution along with a brief reminder, was included in the paperwork.
The City Ccuncil has already approved the 2003/2004 liquor license fees; the action
requested at the July 7, 2003 meeting is to reaffirm that action in accordance with
state requirements. Following the original approval of fees in April 2003, it was brought
to staff's attention that state statute mandates a public hearing and 3D-day advance
notification prior to any increases in on-sale liquor license fees. Therefore, Council was
requested to order a public hearing for July 7, 2003; all licensees were sent notices
regarding the public hearing and the proposed action. The following are the comments
that staff has heard in response to the proposed fees:

]ssue: Improper Notification; therefore, fees cannot be increased for the 2003/2004
license year.
~: According to state statute 340A.408, Subd. 3a., cities are required to
provide a 30-day notice and a hearing prior to any fee increases. There is no provision
mandating when cities need to hold hearings for a particular fee increase. Staff has
verified with Department of Public Safety-Alcohol & Gambling Enforcement personnel
that holding a public hearing on July 7, 2003 for fee increases for the 2003/2004 license
year is acceptable.
Issue: Club licensees are charged less annually for their liquor licenses, yet fail to abide by
the "members only" provision of state law.
~: Staff has notified the Department of Public Safety-Alcohol & Gambling
Enforcement of the licensees' concerns. DPS has an investigative arm of their
department which is following up on these concerns.
Issue: Fees are too high.
~: Attached is the 2003 AMM license fee survey. For cities with a population
between 10,000 & 20,000 that charge a flat annual fee, the average fee is $4,541.
Surrounding communities (Cottage Grove, Farmington, West St. Paul, Eagan, South St.
Pa!J~ Inver Grove Heights) have similar flat fee structures. For those communities that

charge a flat annual fee, the average fee of surrounding communities is $3,729.

Hastings has ordered a public hearing for Monday, July 7, 2003 to discuss fee increases
for on-sale liquor licenses. State statute requires a 30-day notification to all licenses prior
to a fee adjustment. You have previously been provided with copies of the resolutions
that the City Council has adppted in 2002 and 2003 regarding these fees.
Attached is information regarding the public hearing and proposed action. Licensees are
invited to provide any comments directly to me or to attend the public hearing on July 7,

REQUEST
The City Council is asked to hold a public hearing to consider second reading and
adoption of the attached amendment to Chapter 10 of the City Code (Zoning Ordinance)
relating to adoption of the Downtown Master Plan. First reading was considered by the
Council at the June 16, 2003 City Council Meeting.

The proposed amendments are changes to the text of the Zoning Ordinance only.
Changes to the zoning map (rezonings of properties) would be considered at a
later date upon adoption of the language.
RECOMMENDATION
The Planning Commission recommended unanimous approval of the changes at the
June 9, 2003 meeting. The Commission previously reviewed the changes on May 12,
and held a public hearing on May 27 (please see attached minutes).
PUBLIC NOTIFICATION
The Planning Commission held a public hearing to consider the changes at the May 27,
2003 meeting. A post card outlining proposed changes was sent to all residents of the
City within the limits of the Downtown Master Plan. The card gave notice of this
meeting, and directed citizens to the City's web site where proposed code changes, and
future meetings are posted.

City of Hastings - City Code Amendment #2003-38 - Chapter 10 (Various
Sections) - Downtown Master Plan.
Director Hinzman provided a summary of the proposed changes to the language since the
last meeting. He also gave background information on the process - that changes to the
language of the code would be considered first. Only upon Council adoption of language
changes, would rezoning of property be considered.
Commissioners discussed the following changes to the draft:
Accessory Buildings and Structures - allow sidewalls in excess of 10 feet regardless of
whether a residential unit is located above the structure or not. Commissioners sought a
reVision that ensured the overall height and design of the building were compatible to the
house.
Residential Mixed Use District - Allow commercial activities on the entire first floor of the
structure, but not more than 50 percent of the structure.
Vice-Chairman Greil opened the public hearing at 7:22 pm.
Greg Schmitt, 109 Bass Street - Suggested limiting garage door heights as a way to limit
accessory structure heights. Had concerns about the OSR district designation for East
Hastings, would it lead to greater density than is there at present?
Director Hinzman stated that the OSR district would allow for clustering of units, which could
exceed the existing limit of a two unit dwelling, provided open space and green space is
provided to ensure the density would not exceed 3.0 units per acre (the existing R-2 density
limit).
Ryan Berg, 703 East 2nd Street - Had concerns about greater density in East Hastings, and
the potential for low income residences.
Clarence Chapman, 614 East 3rd Street - Questioned the movement of the greenway from
along the railroad tracks adjacent to downtown, further east to link Lake Isabel Park and the
Mississippi River. He also questioned how the zoning changes would affect additions to
homes.
Director Hinzman stated that the greenway along that the Lake Isabel greenway was in
addition to the one along the railroad.
Pastor, Our Saviour's Church, 400 West 9th Street - Questioned how the changes would
affect the ability of the church to expand - would existing structures be protected.
Director Hinzman stated the new ordinance speaks to building standards, not protection of
older properties.

Cyndi Mollick, 623 East 1st Street - Her property is designated as park land in the Downtown
Master Plan - would she be allowed to construct an addition, or would the city condemn her
property .
Director Hinzman stated the OSR district would allow for both single and two family
structures to be constructed. Further research would need to be done on the affects before
any rezonings to evaluate the consequences.
James Fowlkes, 312 West 2nd Street - Questioned how his property would be designated in
the future.
Ryan Berg - Doesn't understand the need for additional park land. He is concerned that the
property owners of East Hastings will be burdened by this plan - they like things they way
they are now.
Commissioner Twedt stated the intent of the changes seems OK, but the application
appears to be muddy.
Commissioner Alongi stated if their were other ways to obtain green space other than the
plan - he questions the value of the OSR district on East Hastings.
Cathy Maynard, 920 Vermillion Street - Asked if the Schoolhouse Square project would be
affected by the changes.
Director Hinzman stated that the Schoolhouse Square property is within the Master Plan
District, and would be subject to the plan.
Public Hearing was closed at 8:35pm
Planning Commission Action:
Commissioner Hollenbeck moved and Commissioner Alongi seconded a motion to
table the proposed zoning changes until the next Planning Commission meeting to
allow staff to incorporate changes discussed at the meeting.
Upon vote taken: Ayes: 5 (Alongi, Greil, Hollenbeck, Truax, Twedt), Nays: O. Motion passed.

Recomlnended city code revisions
The Zoning Code revisions address the following:
This section provides a review of Zoning, Critical Area,
and Shoreland Management Chapters of the City Code,
suggesting revisions needed to implement the land Use
Map and the Original Hastings Design Guidelines. The
intent of these recommendations is to offer ways to work
within the existing City Code, without overhauling or
rewriting substantial portions of it. The uniqueness of
the Design Guidelines creates the need for new approaches
to zoning implementation. New and adapted zoning
districts are proposed to the Zoning Regulations that are
necessary to provide the consistency with the land Use
Map.
The recommendations are structured in a manner that they
may be transferred directly into ordinance language. As a
tool for City Staff, it does not necessarily provide a large
amount of background detail the proposed changes.
Therefore, review of the proposed changes with the
Planning Commission and City Council may require some
additional insight as Staff feels may be necessary.

Recommended revisions to chapter 10 ... zoning
The Zoning Code is the primary means of implementing
many of the land use aspects of the Design Guidelines.
Recommended revisions are needed in a number of areas
in the code including districts, parking, and review process
sections. The majority of these revisions are needed in
the zoning districts section to subsections such as intent
statements, use charts, and bulk standards.
I. Modifying those existing zoning districts where
minimal changes are needed.
2. Create new res~dential zoning districts to
distinguish them from others in the community.
3. Develop bulk standards to respect historical
platting and development character of the
downtown area.
4. Require minimum densities of certain multi,family
residential projects.

Intent. The intent of the Vermillion Street Overlay District is to
preserve the character of existing residential and religious
buildings while allowing conversions of their use to accommodate
residential, institutional, and commercial activities. Preservation
of building and site character elements are critical to ensure this
corridor .maintains its vitality. Conversion of structures to uses
other than the original is based on performance criteria as defined
in this section. This District recognizes that because each building
and site has its own unique design characteristics, some structures
will have greater conversion potential than others.
Review use conversions as Conditionally Permitted Uses (CUP)
when the inherent character of the building, site and corridor is
not disrupted:
a.
Commercial activities in residential buildings
provided that less than 2000 square feet of floor
area is dedicated to such activity. Use conversion
shall be acceptable to all building code issues as
determined by the Building Official.
b. Commercial activities in religious buildings.
c. ProCessional Offices.
d. Mixed Residential use of commercial structures.
Prohibit:
1. Assembly, storage and manufacturing activities.
2. Outside sales.
Building Architecture: The existing building character shall be
maintained consistent with the Original Hastings Design
Guidelines.

. Accessory Living Quarters - The, Plan
recommends modifying the zoning code for single'
family zoned areas to allow accessory structures
designed and used as residential living units.
Accessory Living Quarters can offer increasingly
important lifestyle options (own/rent, maintenancd
maintenance~free) within a single~family lot.
Traditional Neighborhood Design (TND) codes often
have)detailed criteria for this situation that could act
as precedents for Hastings. in detennining specific
code modiIications that will work for Hastings, City
staff may want to consider treating requirements for
accessory living quarters such as setbacks and height
restriction's differently than either principal structures
or other accessory structures (garages). Locally,
the City of Chaska recently adopted accessory living
quarters regulations that are recognized as successful
in addressing zoning and building code issues' for
accessory living quarters.
. Residential Structure Bulk/Mass - Although the
allowable building area on a lot is guided by yard
setbacks, building out to the maximum. amount may
give a property the appearance that it is overbuilt;
There are a couple of approaches the City may wish
to consider. A maximum impervious surface limit
would control the amount of building and other
hardsurface area. This is typically used as a surface

water management technique but would also control
building mass. Another approach would be to limit
the foundation size of principal and accessory
structures. Although either approach would prevent
overbuilding, further analysis of existing conditions is
nee,ded to understand what currently exists.
. Landscaping Provisions - As areås of the
Downtown area redevelop, the opportunity to enhance
building character with landscaping should not be
overlooked. Each of the Districts has its own
character and landscaping standards should be
developed to help accentuate each project. More
than just typical type, caliper and number provisions
should be considered in drafting new provisions.
. Lighting - The parking provisions discuss lighting
of parking areas, but not in great detail. Parking lot
lighting often involves balancing the need to provide
adequate lighting to ensure personal security with
the concerns of neighboring property owners about
glare and overlighting. The use of unnecessarily high
wattage lights can actually lead to a less secure
environment, by creating very dark pockets just
outside the range of the lights. Lighting is an
especially important concern when commercial
projects adjoin residential areas - and when very
tall lighting poles are proposed to be used. While
taller poles can illuminate larger areas they are more
likely to cause light to spill over onto adjacent
pr°.l?erties. Low~angle cutoff light fixtures can be

used to better direct the light to those areas where it
is needed, minimizing glare, spillover effects and light
pollution.
. . Fencing/Screening - In some areas in the core,
fencing may be appropriate. Other areas like the
Open Space Redevelopment District may not be
enhanced with fencing unless properly designed or
designed in conjunction with landscaping
provisions.
. Green Buildings and Site Design - Use LEED
(Leadership in Energy and Environmental Design)
or other comparable ratings. Buildings with
approaches to save energy could receive flexibility in
other code areas.
. Stormwater Credits - By reducing the amount of
surface water on a site, credits cold be gained and
used for other items.

Summary:
Designation is the formal Council action that places a property on the protected list. The
Ordinance requires that a nomination form be prepared and reviewed by the HPC,
Planning Commission and State Historic Preservation Office (SHPO), and that a Public
Hearing be held before Council action.
The HPC recommended that City Council designate the property a Heritage Preservation
Site.. The owners, Patrick and Susan Mancino, oppose designation. The Planning
Co!JUIlission recommended denial of the designation. The SHPO does not support
désignation.
Work has started on an addition to the house. As the building permit has been issued, this
work will not be reviewed even if the property is now designated.
A draft resolution to designate the property is attached.
HPC Action.
Findings of significance and consideration of the condition of the property and its setting
are required by Ordinance for the recommendation to Council: The property and its
significance is described in the attached Nomination form.
Motion by Goderstad, second by LaBreck to recommend designation to Council with the
following findings:
The Commission finds that 502 W. th Street possess local historic significance due in
particular to a resident, Professor John Lewis, City and State Superintendent of Schools,
and local architectural significance as an example of Gothic revival and stick style on a
vernacular home as described and shown in the nomination; and the Commission also
finds that the following conditions are met:
. That the location and setting is compatible with future preservation and use.
. That the physical condition is such that preservation, maintenance or adaptive
use is economically feasible.
. That the distinguishing characteristics of significance are for the most part
original and intact or capable of restoration.

. That the existing or proposed use is compatible with the preservation and
maintenance of the site.
The vote was 5 ayes, 2 nays; motion carried.
Planning Commission Action.
The Planning commission is asked to comment on the relation of the proposed
designation to the Comprehensive Plan, Zoning Ordinance or any other planning
considerations:
Commissioner Twedt moved and Commissioner Alongi seconded a motion to recommend
denial of the proposed designation of 502 ih St. W. to the City Council. Ayes 3; Nays: 2;
Griel and Hollenbeck dissenting. Motion passed.
State Historic Preservation Office.
The state statute requires that all nominations be sent to SHPO for their review and
comment. The office finds that the building does not show sufficient architectural design
to warrant local designation. See attached letter from the Minnesota Historical Soceity.

Owners' comment.
Mr. Mancino has expressed his opposition to the designation before the Heritage
Preservation Commission and the Planning Commission. Mr. Mancino's attorney, Sam
Hertogs, wrote to the Planning Commission stating that in his opinion the HPC actions
raised some concerns. A letter of opposition from Maxine Clapp, who inherited the
house and sold it to Mr. and Mrs. Mancino, was provided to the HPC and Planning
Commission.
The Ordinance does not make the owner's consent a condition of designation. Owners
have opportunities to present their point of view. In the past Council has both designated
properties and not designated properties when owners were opposed.
Addition to 502. W 7tb. Street.
Although the point is moot, the Ordinance and Guidelines would have required HPC
approval for the addition if the property had already been designated. The Ordinance
does not provide for protection of properties which have not been designated, but appear
to be eligible for designation.
Recommendation.
The HPC recommends designation of 502 W. 7th to the City Council as an Heritage
Preservation Site. When the recommendation was adopted, on June 17th, the SHPO
comment had not yet been received. The action needed to designate the property is
approval of the attached resolution.

WHEREAS The city of Hastings finds that the historic and architectural heritage of the
City is a community asset and has established a municipal program of historic
preservation under Minnesota Statutes 471.193; and
WHEREAS The City of Hastings has adopted Sect. 2.18 of the City Code to provide
procedures for the designation and preservation of the Heritage Preservation Sites by
reason of their significance; and
WHEREAS The City of Hastings is a Certified Local Government established May 10,
1988 under the provisions of the National Historic Preservation Act of 1980; and
WHEREAS The Heritage Preservation Commission finds that 502 West 7th Street meets
the criteria for designation under the procedures established by Sct. 2.18 of the City Code
and recommends designation;
NOW THEREFOR BE IT RESOLVED that the City Council of the City of Hastings
hereby designates that property legally described as Lot 4 and the east 10 feet of Lot 3,

Ruth M. Morton was born in International Falls, Minnesota to Charles Herman Morton and Lillian Brittell Morton,
their second female child, March 24, 1910. Their first child was Dorothy Morton Beard. Charles came fÌ'om
Thomasberg East, Canada to Marquette, Michigan and married Lillian Brittell. They moved to. Canada, then back to
Michigan when Charles received a letter fi'om a triend offering him a job at the King Midas Flour Mill in Hastings,
making wooden dog leg spouts (these were spouts used in the flour industry.
Ruth was a small child when the family moved to Hastings. They rented the Thompson house and later moved to
712 West Eighth Street before moving to 502 Seventh Street West. Ruth has remained living in this home. Ruth
had one sister, Dorothy, born in 1900 who died in 1945 of cancer. Dorothy was a secretary and cashier in the office
of Kin~ Midas Flour Mill. Dorothy married Ralph C. Beard and they had one daughter, Maxine Baird Clapp. Ruth
andMaxine are,the only surviving members of the this family. Lillian Brittell Morton died in 1955 and is buried at
Lakeside Cemetery. Charles H. Morton retired trom the King Midas Mill, died October 5, 1961, and is buried at
Lakeside Cemetery also.
Ruth did not marry. She was the homemaker of the family. Lillian, her mother had a very serious heart condition
and was unable to manage the home. They had boarders in the earlier years and this was Ruth's responsibility. Her
mother waS a lovely caring person, popular and loved by all their acquaintances. Ruth was to enter the 11 th grade in
high school when she developed tuberculous (she was totally cured and never had any illnesses trom this disease).
She is very talented in art and the gracious traditions of her generation are a part of her daily living. Ruth traveled
extensively.
Eva Britten Jacka, Lillian's sister, was married to Si Jacka, owner of mines in Crystal City, Michigan. They were
wealthy and very generous to Lillian and Ruth. Eva did not have children. She and her husband traveled in wealthy
circle of friends and acquaintances. Her clothing was the best and her husband was very generous.
Ruth M. Morton has many hobbies. In her earlier years while traveling she would sketch sights as she traveled and
later would put them in color, making lovely cards and stationery, giving these to fi'iends. Her flowers and gardening
are lovely, she has a vast knowledge of plants. Max is her companion, a lovely cat that she enjoys and Max loves
Ruth, always purring and wanting attention. She has a lovely home that she has cared for and enjoys. She has
written many articles for the Senior Citizens. Ru$ is always elegantly dressed and the Emily Post of her generation.
God in His generous gifts has rewarded Ruth with good health and love of people, her illness and caring for others
has given her the stamina to overcome hardships, always putting others fIrst and Ruth last. She is a member of the
Presbyterian Church.
The lovely, exquisite clothing that she has preserved and given to the Hastings Pioneer Room for safe keeping and
preservation for the citizens of Hastings to enjoy is a gift of generosity. and love to this city.
This is Ruth's personal story as told to Janie Darsow before her 90th birthday. March 24,2000
Ruth Morton died January 7, 2003 at 3:30 AM. She had a stroke December 12.2002, and was hospitalized. She
died at Regina Memorial Hospital of pneumonia and is buried at Lakeside Cemetery, Hastings. .

been reviewed pursuant to MiIUlesota Statutes §471.193, subd. 6., and Section 2,18 of the
Håstings City Code.
While we are pleased that the Heritage Preservation Commission is considering local
designation in order to protect the Lewis House, at this time we cannot support the
designation.
The Lewis House appears to be a relatively slll1ple example of a gabled ell house form
with a modicum of decorative elements, Several Gothic Revival design characteristics are
present on the Lewis House, including the vergeboards and window hood molds, but
these are modest architectural features. Unfortunately, the asbestos shingle siding
obscures the original clapboards and other exterior details.

Gary Heselton, applicant, and Renee Meyer, owner, propose to subdivide 1908A Eddy
Street into two lots and vary from the minimum side yard setback provisions.
Approval of the request is recommended, with the conditions indicated at the end of the

BACKGROUND INFORMATION
Comprehensive Plan Classification
The use does conform to the 2020 Comprehensive Plan. The property is designated is
designated U-I - Urban Residential and the property is developed at a density of
approximately 2.4units per acre.
Zoning Classification
The subject property is zoned R-2 - Medium Density Residential. Two family dwellings are
a permitted use in the R-2 District.
Existing Condition
The existing site has a side - by-side town home with detached garages in the front yard.

MINOR SUBDIVISION REVIEW
Background
The existing lot has a platted size of 66' by 330' and 21 ,300 square feet.

Minimum Lot' Size
The minimum lot size for a twin home on a single lot is 9,700 sJ. The City has applied
4,850 sJ. (half the size) on zero lot line splits to create separate lots of record for each unit.
The existing lot is 21,300 square feet, including 1,935 square feet in ROW easement.
VARIANCE REVIEW
Background
The homes were constructed in 1982 and are currently 6.8' from each side lot line. The R-2
Zoning District does require minimum 7' setbacks for primary structures. Also, the garages
each have a 4.1' side yard setback, where the minimum required setback is 5' per the
zoning ordinance. The setback requirement for accessory structures was changed several
years ago from a 3' setback to a 5' setback, due to the typical side yard drainage easement
of 5' .
It should also be noted that while this lot was platted at a width of 66', when it was
measured in the field by the surveyor, the width came out to be 65.90. It is not unheard of
to have minor discrepancies in the platted width and the measured width, especially in
older plats. This plat was recorded in 1912.
Review Criteria
The following criteria have been used as findings of fact in granting variances to zoning
provisions:

That special conditions and circumstances exist which are peculiar to the land,
structure, or building involved and which are not applicable to other lands,
structures, or buildings in the same district.

privilege that is denied by Chapter 10 to other lands, structures, or buildings in the
same district. No non-conforming use of neighboring lands, structures, or buildings
in the same district, and no permitted or nonconforming use of lands, or buildings in
other districts shall be considered grounds for the issuance of a variance.

The Planning Commission held a public hearing on June 23, 2003. The only comments
received were from the property owner, who submitted a petition from 11 property owners
in the area in support of the minor subdivision. The petition is attached to this report.
The Planning Commission voted unanimously (6-0) to recommend approval of the minor
subdivision/variances for 1908A Eddy Street, subject to the conditions included in this
report.
RECOMMENDED ACTION
Motion to recommend approval of the attached resolution.

REQUEST
The City Council is asked to consider first reading of the attached amendment to the
Hastin.9s City Code, Chapters 10.23 and 10.24 - Industrial Park Uses. Changes
incluae strengthening the purpose and intent statements, and eliminating some uses.
Upon approval of first reading, second reading and final adoption would be scheduled
for the July 21,2003 City Council Meeting.
HISTORY
The City Council voted to table the amendment at the May 19, 2003 meeting, citing
concerns about language changes on Industrial Zoned property outside of the Hastings
Industrial Park. Of particular concern was the prohibition of religious institutions (It
appears a church has purchased land zoned Industrial outside of the park - the
changes would prohibit future church construction).
PLANNING COMMITTEE REVIEW
The Planning Committee of the City Council discussed the amendment, and
recommends allowing religious institutions as special uses in the Industrial District.
INDUSTRIAL PARK BOARD & PLANNING COMMISSION
The Industrial Park Board unanimously recommended adoption of the changes at the
April 17, 2003 meeting. The Planning Commission voted unanimously to recommend
the changes at the May 12, 2003 meeting with limited discussion. No one spoke for or
against the change during the public hearing.

districts in the City. Operations that are incompatible in most commercial zoning districts and

SECTION 10.24. 1-2 INDUSTRIAL PARK STORAGE/SERVICE.
SUBD. 1. INTENT. The intent oftms Chapter in establishing an industrial park storage/service
district is in recognition of the need to segregate for aesthetic and functional reasons uses that
involve exterior storage of products, raw materials, equipment or vehicles and that require a lesser
degree of public improvements that is typically provided in the 1-1 Industrial Park District. It shall
be recognized that the intensity and type of industrial uses that shall be permitted in the 1-2 District
will be based upon a determination by the City that an adequate level of public services to support
such uses can be provided based upon the level of public improvements available to the district. The
District serves to regulate existing 1-2 uses. Further expansion of the 1-2 District geographic limits is
!!ill anticipated. Future rezoning orland for industrial storage and services uses shall be designated I-
I. subiect to the provisions of Section 10.23. as amended.
SUBD. 2.
PERMITTED. Same as permitted in the 1-1 District.
SUBD. 3.
USES BY SPECIAL PERMIT.
a) Motor Vemcle Impound Lots, subject to the following conditions:
(1) Motor vehicles cannot be kept in an impound lot for more than 14 days unless a
police hold has been placed on the motor vehicle.

(2) No sales of motor vehicles, salvaging, repairing, dismantling, or stripping of motor
vehicles shall be allowed in the impound lot.
(3) 100% opaque fencing or landscaping at least six feet high must be placed around the
entire lot and must be adequately maintained.
(4) All motor vehicles impounded shall be kept within the opaque fenced or landscaped
area.
(5) All buildings on the lot must be pennanent structures with pennanent foundations.
(6) The entire impound lot shall be surfaced with a bituminous covering, Glass 5 grayel-,
or other surface covering as appro~¡ed--by-the city. and concrete curbing to City
standards
(7) A sufficiently sized bituminous area shall be provided for the parking of vehicles that
may be leaking fluids or other pollutants.
(8) Any lighting in the impound lot shall not be obtrusive to neighboring property.
(9) Employees of the City or its duly appointed representatives, shall be allowed on the
property at any time to inspect the impound lot to verify compliance with City Code.
b) Any special use pennit issued hereunder shall be reviewed annually and at other times
deemed appropriate by the City, to verify compliance with the City Code and any special
çonditions of the pennit. As part of the review procedure, the city may hold a public hearing,
,~- precedèd by the appropriate mailed and published notice. As part of any review procedure,
the city may amend the pennit by adding or deleting any conditions it deems necessary to
protect the public health, safety, and welfare.
c) All conditions imposed by City Code Section 2.04, Subd. 5, Subsection (B) (5) must be met.
Additionally, the city may impose any other conditions it feels are necessary to protect the
public, health, safety and welfare. .
d) Any violation of this subdivision or any conditions imposed upon the special use permit shall

Recommended City Council Action
It is recommended that the City Council take action to deny consideration of a
"variance" from the City's RV and Trailer Parking Ordinance, as requested in the
attached letter from James King living at 1520 Brittany Road.
Background
Attached is a letter from James King, who lives at 1520 Brittany Road, requesting a
"variance" from the City's ordinances regulating RV and trailer parking. The City Council
does not grant variances from Ordinances. Mr. King has been advised on numerous
occasions by both the City Police Department and the City Inspection and Code
Enforcement Department of the violations to the RV and Trailer Parking Ordinance
req~jrement~. A copy of the Ordinance regulating the "Parking, Storage or Use of Major
Recreational Equipment" is attached for your information. Council affirmation of the
Staff's attempt to enforce the Ordinance, and denial of any consideration of an
exception or "variance" to the Ordinance is recommended.

This is a request for a variance to allow the parking of my RV and trailer in my
driveway. Do to the layout of my property, it is impossible to park either of these vehicles
next to or behind my house.
My plan is to sell my pick up and to use my RV as my main hauling vehicle. I am a
single parent and can't afford to keep both of these vehicles.
. Since I am not on a comer lot and the vehicles will be at least 20 feet off the road, I
feel that this does not pose a safety concern and is the only solution to this problem.

SUBD. 3. PARKING, STORAGE OR USE OF MAJOR RE~RËAT\.ONA~
EQUIPMENT. For purpose of these regulatic(1s, ~'ecíeational equipment IS defined as
including boats and boat trailers, pickup campers or coaches (designed to be mounted
qn automotive vehicles), rnotored dwellings, tent trailers, snowmobiles and snowmobile
trailers, jet skis and jet ski trailers, and the like, and cases or boxes used for
transporting recreational equipment, whether occupied by such equipment or not. No
recreational equipment shall be parked or stored on any lot in a Residential District
except in a carport or enclosed building, and in compliance with the following provisions:
1.) No recreational equipment shall be allowed in the right-of-way; 2.) One currently
licensed recreational equipment 7 feet high or less shall be allowed in a driveway; 3.)
One currently licensed recreational equipment item may be parked behind the nearest
portion of a building to a street; 4.) A maximum of two currently licensed recreational
equipment items may be stored outside on a property, provided:
a) that such equipment be parked on the residential premises not to exceed
twenty four hours during loading or unloading.
No recreational equipment shall be used for living, or housekeeping
purposes when parked or stored on a residential lot., or in any
location not approved for such use by City Code.

SUBD. 4. MISCELLANEOUS MATERIALS AND EQUIPMENT STORAGE.
Within the City, all materials and equipment shall be stored within a building or be fully
screened so as not to be visible from adjoining properties, except for the following:
clófhes lines, recreational equipment, construction and landscaping materials and
equipment currently being used on the premises, agricultural equipment and materials if
these are used or intended for use on the premises, and off-street parking; except as
may otherwise be regulated by the City Code.
SUBD.5. GRASS AND WEEDS ON PRIVATE PROPERTY.
A. It is unlawful for any owner, occupant or agent of any lot or parcel of land in
the city to allow any vegetation such as weeds or grass growing upon any such lot or
parcel or land to grow to a height greater than 12 inches or to allow such weeds or
grass to go to seed.
B. If any such owner, occupant or agent fails to comply with this height limitation
and after notice given by the Property Maintenance Inspector, has not complied within
seven days of such notice, the city shall cause such weeds or grass to be cut and the
expenses thus incurred shall be a lien upon such real estate. The City shall certify to
the Dakota County Auditor, a statement of cost incurred by the City. Such amount
together with interest, shall be entered as a special assessment against such lot or
parcel of land and shall be collected in the same manner as real estate taxes.
SUBD.6. TREES, BRUSH, SHRUBS ON PRIVATE PROPERTY.
A. Any tree, shrub or brush that grows against any building or fence which
represents a hazard to the structural integrity of said building or fence shall be removed
or trimmed to prevent damage.

AGREEMENT FOR HASTINGS RIVERTOWN DAYS

THIS AGREEMENT made this 7th day of July 2003, by and between the City of Hastings, Minnesota, and
the Hastings Area Chamber of Commerce.
WHEREAS, the Hastings Area Chamber of Commerce (Chamber) has scheduled a community festival for
Hastings entitled Rivertown Days, which is to be held on July 17 through July 20, 2003; and
WHEREAS, in the past the City of Hastings (City) has cooperated with the Chamber in its production of
Rivertown Days by providing some assistance; and
WHEREAS, both parties wish t<? put in writing the agreement which has been made between the parties.

II. SHUTTLEBUS

Hastings Bus Company will provide one'bus to operate on a limited basis Saturday and Sunday. The
shuttle, Will: transport people from Pioneer Park to the Downtown area and Jaycee Park. On,Sunday,
the route will include Peavey Park. If demand is sufficient, the Chamber will provide an additional
bus for shuttle pwposes. Shuttle bus hours will be from, 10 a.m. to 6 p.m. on Saturday, July 19th and
i2'~ 3 p.m. on Sunday, July 20th.

The Chamber will be selling Rivertown Days Buttons for $2 each. Buttons will be required for
admission to the Lake Rebecca and Jaycee Park areas. Proceeds from button sales are used to pay for

IV.. PICNIC TABLES
The City will provide an adequate number of picnic tables to be detennined by the City--and the
Rivertown Days Committee at Jaycee, Peavey and Pioneer Parks and at the High School and
Roadside Park tennis courts. Rivertown Days Committee will coordinate with Marty McNamara.
V. INSURANCE
A. Certificates of Insurance
The Chamber will obtain and present to the City prior to Rivertown Days certificates of insurance
from each of the following: Lumberjack Show, pyrotechnician, carnival operator, Stunt Bike Shows,
Twin City Power Boat Association and any others the City deems necessary. Waivers of liability
will be secured from all sports participants. Each certificate of insurance shall name the City of
Hastings, the Hastings Area Chamber of Commerce, and the Rivertown Days Committee as
Additional Insureds at no additional cost to the City of Hastings.
B. Hold Harmless Agreement
The Chamber agrees to indemnify the City and hold it harmless from any and all claims, demands,
lawsuits, or liability for such loss or damage, injury, death, and costs and expenses incident thereto
arisÏ1}g out of all Chamber activities connected with Rivertown Days.

Prior to Rivertown Days, the City shall be furnished with an endorsement naming the City as an
additional insured on the Chamber's policy. The Chamber's insurance policy shall not be canceled or
its conditions altered in any manner without ten days prior written notice to the City Administrator of
Hastings.
VI. ELECTRICITY
The City will give the rights for use of all electrical outlets in Jaycee and Lake Rebecca Parks. City
will not charge the Chamber for use of said electricity. City will check all streetlights along the
Lock and Dam Road to verify that the lights are in working order.

WATER
The City will allow vendors access to all fire hydrants along the Lock and Dam Road. City will have
connections available on Jaycee Park hydrants by July 14,2003. The City will provide a water truck
to fill the LumbeIjack Tank on Saturday if necessary.

A. In addition to the foregoing, the City of Hastings agrees to the following:

The City will provide in kind services of the Parks, Streets, Police and Fire Departments.
The City will provide trash and litter pickup before, during and after the festival, which will
be coordinated with Waste Management - Hastings (This service donated by Waste
Management - Hastings). The Parks Department will coordinate daily clean up.
Two Parks Department employees will be on duty on Saturday and Sunday, July 19th and
20th from 7 a.m. to 5 p.m.
The City will provide barricades and snow fence where appropriate.
The City will provide "No Parking" and "Handicapped Parking" signs where needed.
Ambulance service will be provided for miscellaneous events, most importantly the Power
Boat Races on Saturday, July 19,2003.
The Streets or Parks Department will mark/rope the appropriate grass areas adjacent to Lock
and Dam Road for public parking.
The Streets or Parks Department will mow the former tank farm area to accommodate
parking.
The Parks Department will contact Mosquito Control and arrange spraying in the Jaycee and
Lake Rebecca Park areas the week of July 14th.
The City will provide adequate police protection during the festival.
The City will provide extra garbage barrels at Pioneer, Jaycee and Peavey Parks and provide
pickup Saturday afternoon.
The City will erect several temporary signs no larger than 4' X 8' (furnished by the Chamber)
approximately 3-6 weeks before the event and take them down after the festival.
All vendors must obtain a concessions permit from the Rivertown Days Committee, in
cooperation with the City of Hastings. Police will assist with removal of vendors without
permits.
Provide the Chamber President with a list of cell phone numbers to reach Parks, Police, Fire
and Streets Department staff. List will remain confidential.

B. In addition to the foregoing, the Chamber agrees to the following:
1.
The Chamber will work with the Police Department to arrange for adequate traffic and crowd
control at each scheduled Rivertown Days event.
The Chamber will provide the City with a list of contact persons with phone numbers who
are responsible for the various areas and events.
The Chamber will secure all necessary City permits and licenses required by Hastings City
Ordinances for any and all activities during Rivertown Days.
The Chamber will provide a schedule of events for Rivertown Days (see attached).
The Chamber will provide and pay for all portable toilets at sanctioned Rivertown Days
events where they deem necessary.
The Chamber will provide and pay for all off-duty police reserve officers, who shall be in
uniform during the festival, where the Rivertown Days Committee deems necessary.
The Chamber will provide and pay for all Explorer Scout services during the festival.
The Chamber will coordinate all waste containers and recycling with Waste Management-
Hastings.

1. Direct traffic and keep it running smoothly along Second Street. Police will monitor traffic to detennine
whether or not road closure is necessary.
2. Continue to direct traffic to designated parking lots filling the first lots before proceeding to the next.
3. Prevent cars from entering lots designated as areas for "permit parking" only.
4. Patrol lots to support and assist Explorers in monitoring designated parking (e.g. Handicapped Parking
and Permit Parking).
5. Watch for activities that may disrupt the peace and try to prevent any illegal activities.
6. Stay in contact by cellular phone or radio with the Rivertown Days Steering Committee.

7. Assist'public or direct them appropriately with any questions or problems. (There will be an infonnation
tent at the river.)
8. Alert and assist ambulance service in case of an emergency.
9. Coordinate individuals or reserves so that an adequate number are working at all times. The busiest time
is Saturday evening ITom 6:00 p.m. until after the fireworks display and on Sunday during the parade.
10. Provide flashing warning lights at 15th and Maple and at 15th and Pine.
11. Assist with escorting non-licensed vendors off park property.
12. Other security duties as deemed appropriate by Mike McMenomy, Chief of Police.
