January 22, 2002
The City Council of the City of Hastings, Minnesota met in a regular meeting on
Tuesday, January 22, 2002 at 7:00 p.m. in the City Hall Council Chambers, 101 4th Street East,
Hastings, Minnesota
Members Present: Councilmembers Hazlet, Hicks, Schultz, Moratzka, & Yandrasits
Mayor Werner
Members Absent: Councilmember Riveness

Approval of Minutes
Mayor Werner asked if there were any corrections or additions to the minutes of the
regular meeting of January 7, 2002. Hearing none, the minutes were approved as presented.
Council Items to be Considered
Moved by Councilmember Yandrasits, seconded by Councilmember Hicks to amend the
agenda to add Appointment of John Hinzman as Planning Director.

Recognition of Clarence Soleim, Jr.
Mayor Werner presented a plaque of recognition to Clarence Soleim, Jr. for 40 years of
community involvement, including but not limited to service on the City Council, the Planning
Commission, and the Police Civil Service Commission.
Police Chief McMenomy presented a miniature replica of a Hastings Police Department
squad car to Soleim in recognition of his service to the Hastings Police Civil Service
Commission.
Consent Agenda
Moved by Councilmember Moratzka, seconded by Councilmember Hicks, to approve the
Consent Agenda as presented.

Appointment of John Hinzman as Planning Director
Moved by Councilmember Moratzka, seconded by Councilmember Hicks to approve the
appointment of John Hinzman as Planning Director, with an anticipated start date of Monday,
February 11, 2002.

Illegal Liquor Sales
City Attorney Moynihan presented background information on the process and
circumstances surrounding the compliance check by the Police Department and the failure to
properly ID by both Short Shop Liquors and the House of Wines.
Ed Robinson, owner of House of Wines, did not dispute the illegal liquor sale. He
requested leniency by the Council in considering penalties for the second violation within a 24-
month period.
Moved by Councilmember Hicks, seconded by Councilmember Hazlet, to impose the
penalty as provided in the guidelines established by the Council for the second violation within a
24-month period. This penalty includes a $750 civil fine and a two-day suspension to be served
on Thursday, February 7 and Friday, February 8, 2002.
Roll Call Vote was taken.

Kraig Thompson, owner of Short Stop Liquor, did not dispute the illegal liquor sale. He
requested leniency by the Council in considering penalties for the third violation within 37
months. In January 2001, Short Stop failed a second compliance check and the Council took
action treating that violation as a first violation, imposing a penalty of a $300 civil fine or the
purchase of an ID reader machine at a cost of approximately $300. The Council also stipulated
in the action of January, 2001 that should Short Stop fail another compliance check within the
subsequent 24 months, that next violation would be treated as the establishment's third violation,
and corresponding penalties would be imposed.
Moved by Councilmember Hicks, seconded by Councilmember Hazlet to impose the
penalty as provided in the guidelines established by the Council for a third violation. This
penalty includes a $1,000 civil fine and a five-day suspension to be served from Tuesday,
February 5, 2002 through Saturday, February 9, 2002.

Moved by Councilmember Moratzka, seconded by Councilmember Schultz to approve
the resolution presented.

CDBG Grant Application
Moved by Councilmember Moratzka, seconded by Councilmember Schultz to approve
the CDBG grant application as presented.

Rural Fire Agreement
City Administrator Osberg stated that he has scheduled an appointment to pick up the
check and signed agreement from the Rural Fire Association attorney on Friday, January 25,
2002. No action is requested on this item.

meeting at 7:54 p.m.
