DETERMINATION OF QUORUM Presentation—Recognition of Planning Commissioner Greg Schmitt The Council thanked Schmitt for his service over the last 6 years V. APPROVAL OF MINUTES Approve Minutes of the Special Workshop and Regular Meeting on June 15, 2009 and the Special City Council meeting on June 29, 2009 Minutes approved as presented V. COUNCIL ITEMS TO BE CONSIDERED Hinzman clarified that Donald Slaten is recommended to be appointed to the Planning Commission Alongi, Slavik to amend Consent Agenda Item #13 as recommended VI. CONSENT AGENDA The items on the Consent Agenda are to be acted upon by the City Council in a single motion. There will be no discussion on these items unless a Councilmember or citizen so requests, in which event the items will be removed from the Consent Agenda to the appropriate Department for discussion. Alongi, Nelson to approve the Consent Agenda as amended 6-0 Pay Bills as Audited 1. Resolution 07-01-09—Approve Massage License for Kevin Elzia at Caring Hands 2. Massage (427 Vermillion Street) Resolution 07-02-09—Approve Massage License for Michael Cline at Caring Hands 3. Massage (427 Vermillion Street) Declare as Excess: Police Equipment 4. Resolution 07-03-09—Accept $100 Donation from Hastings Rivertown Lions Club to 5. Hastings Police Department Crime Prevention Program Resolution 07-04-09—Accept $50 Donation from MOM’s Club of Hastings-West to 6. Hastings Park & Recreation Department Youth First Program Resolution 07-05-09—Accept $1,500 Donation from East Hastings Improvement 7. Association to Hastings Park & Recreation Department for a Flagpole at Lake Isabel Approve 2009 Rivertown Days Agreement 8. Approve Appointment of new HPC Commissioner 9. Approve Marketplace West/Xcel Energy Street & Utility Easement Agreement 10. Authorize Advertisement for Bids – Hwy 55 Ground Storage Tank Painting 11. Authorize Advertisement for Bids – Adams Street/East Hastings Lift Station 12. Replacement Approve Appointment of Planning Commissioner 13. th Solicit Bids for East 4 Street Paving 14. Transfer of Funds—Police Department 15. VII. AWARDING OF CONTRACTS AND PUBLIC HEARINGS 1. Public Hearing—Ordinance Amendment Relating to Liquor License Compliance Checks and Presumptive Penalty Process, and Best Practices Business Policy Mesko Lee provided background information on the proposed change. Public Hearing opened at 7:09; hearing no comments, public hearing closed at 7:09 p.m. VIII. REPORTS FROM CITY STAFF A. Public Works 1. Accept Proposal for Storm Water Utility Study Elling Schultz, Alongi Award proposal to WSB for $34,200 6-0 B. Planning 1. Resolution 07-06-09—Variance/OHDS Review #2009-18: Home Addition – 504 rd West 3 Street (Lehmann) Alongi, Slavik to approve the variance as presented 6-0 Slavik, Nelson to approve the OHDS review as presented 6-0 C. Administration 1. Second Reading/Ordinance Amendment 2009-07—Relating to Liquor License Compliance Checks and Presumptive Penalty Process, and Best Practices Business Policy Elling Schultz, Hollenbeck to approve ordinance amendment as proposed 6-0 2. Request to Reconsider Request to Amend Liquor License at Rivertown Days Slavik, Nelson—motion to reconsider previous action Discussion about process, decision, and future policy considerations Roll call vote was taken on the motion to reconsider Ayes: Nelson, Slavik Nays: Alongi, Hollenbeck, Elling Schultz, Hicks Motion failed IX.
