The City Council of the City of Hastings, Minnesota met in a regular meeting
on Monday February 2,2004 at 7:00 p.m., in the City Hall Council Chambers at the
Hastings City Hall, 101 East 4th, Street, Hastings, Minnesota. .
Members Present:
Mayor Mike Werner, City Councilmembers Hazlet, Hicks,
Moratzka, Schultz, and Yandrasits
Members Absent:
Councilmembers Riveness
Staff Members Present:
City Administrator David Osberg;
Administrative Assistant/City Clerk Melanie Mesko Lee;
City Attorney Shawn Moynihan;
Planning Director John Hinzman;
Public Works Director Tom Montgomery;
HRA Director John Grossman;
Fire Chief Mark Holmes; and
Asst. Fire Chief Mike Schutt
Approval of Minutes
Mayor Werner asked if there were any corrections or additions to the minutes
of the regular meeting of January 20, 2004. Hearing none, the minutes were
approved as presented.
Council Items to be Considered
City Administrator Osberg requested that Closed Door-2004 labor
Agreements be added to the closed door discussion.
Moved by Councilmember Yandrasits, seconded by Councilmember Schultz to
add that iteR1 to the agenda.

Consent Agenda
Mayor Werner noted that Items #5 and #9 have been requested to be
removed from the agenda.
Ceuncilmember Moratzka requested that Item #7- HPC Request for
Redevelopment Review, be moved to Item #3 under Administrator.
Moved by Councilmember Moratzka, seconded by Councilmember Hicks, to
approve the Consent Agenda as amended.

Award Contract-Fire Department Tanker
Holmes requested award of contract to Midwest Fire in the amount of
$190,963. This amount is higher than original because the tanker size was
increased.
Moved by Councilmember Yandrasits, seconded by Councilmember Hicks, to
award the contract as presented.

HPC Request for Redevelopment Review
Councilmember Moratzka stated that the HPC has requested that it be able to
review and comment on proposed downtown changes as part of the downtown
redevelopment plan. Moratzka suggested that the HPC provide its comments to the
Downtown Redevelopment Committee.
Moved by Councilmember Moratzka, seconded by Councilmember Yandrasits
to approve the request as presented.

Preliminary Development Agreement with Sherman Associates
HRA Director Grossman outlined the main points of the agreement, including
the following:
. The City/HRA will work exclusively with Sherman Associates while they
are investing time and money in the plans for the project;
. Concepts proposed by developer are not an approved plan;
. Plans are expected to be approved by October 20, 2004;
. Various expectations that the developer will fulfill during this agreement;
. Conditions specified by the City Council and the HRA;
. An "exit strategy" as directed by the Council.
Brief amendments to Sections 3 and 6 were proposed.
Moved by Councilmember Moratzka, seconded by Councilmember Yandrasits
to approve the preliminary development agreement as amended.
Mayor Werner requested a friendly amendment to the motion regarding a
minor language change with regards to public financial assistance language.
Friendly amendment accepted.

Moved by Councilmember Hicks, seconded by Councilmember Schultz to adjourn to
a closed door session at 7: 18 p.m.

Mayor Werner opened the closed door session at 7:18 p.m.
Moved by Councilmember Hazlet, seconded by Councilmember Schultz to adjourn
the closed door session at 7:59 p.m.
Mayor Werner reconvened the open door session at 7:59 p.m.

approve the resolution as presented.

Summarize why you are seeking an appointment to a City of
Hastings commission?
A college professor once told me "there is something about you Hastings kids, you have a
pride and a loyalty towards your hometown; something not seen very often anymore".
This statement definitely holds true for myself. It was quite common to hear me
explaining the uniqueness of Hastings as a plàce where you can have history, small-town
charm and still have the luxuries of a typical Twin Cities suburb to my friends. So much
so, that I convinced a few friend to move to Hastings long before I returned this past
April. Essentially, I want to be appointed to the planning commission because Hastings is
a community I truly enjoy and I want to help make it an even better place to live.
Secondly, from of my past experiences in the public sector, I have gained a real love for
the political process. The planning commission being one of the first steps in the political
process is also one of the most "local". I would look forward to working with residents
and developers, as well as, having discussions on what is best for the City long-term
versus the inter~sts the individual party(ies).
Prior experience as a public employee, elected or appointed?
Hastings Aquatic Center Committee: (Appointed Spring 1997 until pool opening)
Determine the feasibility of a new aquatic center in the City of Hastings, make
recommendations to city council on location, cost and style. .
St. Joseph Economic Development Board: ( Appointed December 2000 - December
2902) Examine the commercial and industrial properties in the City of St. Joseph (MN),
recommend updates to the industrial park, solicit new businesses to the city to increase
tax base and livable paying jobs.
CORE Board-St. Joseph: Appointed January 1998 - May 2000) A 12 person advisory
board made up of city council members and residents of S1. Joseph, students and
administrators from the College of St. Benedict and S1. John's University to discuss ways.
to improve relations between the Colleges and the City of S1. Joseph.
St. Joseph Downtown Redevelopment Board: (Appointed January 2003 - April 2003)
Examine the downtown bui~dings and, environment and create a master plan to give S1.
Joseph downtown the small-town college feel.

The City Council is asked to adopt the attached resolution in support of the City of Hastings
application for E-Commerce Ready Certification thru the State of Minnesota's Department
of Employment and Economic Development.
BACKGROUND
City of Hastings Staff has been working with representatives from the Hastings Chamber of
Commerce to gather the information necessary for the application. This application is also
a part of the larger Dakota County application for E-Commerce Ready Certification.

WHEREAS, the 1999 Minnesota legislature assigned the Department of Trade and
Economic Development with the responsibility to create an "E-commerce certification program"
for communities, and
WHEREAS, "E-commerce" or electronic commerce is a term used to describe all
commercial and non-commercial activities facilitated through the use of information technology
and network technologies, such as the Internet, intranets and extranets, and
WHEREAS, high speed data access to the Internet is already becoming a key location
factor for some types of businesses, and
WHEREAS, the application will be used to document the stages of readiness for E-
commerce in cities across Minnesota, and
WHEREAS, those cities so certified will receive use of an electronic image that will be
displayed on their online Community Profile and may also be displayed on community web sites
as well as other city publications and marketing materials, and .
WHEREAS, the City has worked collaboratively with the Chamber of Commerce
regarding the area's technological and economic development to pool knowledge, data and
experience to evaluate our common position, and
WHEREAS, the City has compiled the information provided by the community coalition
and prepared the attached E-Commerce Ready Certification Application to submit to the
Minnesota Department of Employment and Economic Development (formerly the Department of
Trade and Economic Development),
WHEREAS, on February 17, 2004, a review of this application was held before the City
Council of the City of Hastings, and

commerce?
Within the last year, all City facilities (except the Aquatic Center) have been connected
so that all employees at outlying facilities have access the City Hal! network. The
Finance Dept. has also added the capability of paying water bills via automatic
withdrawal, and the applications for such are available at the City's website.
Recent additions of DSL and Broadband to homes and businesses in the community
increase the ability to do business over vast distances and to telecommute giving
businesses and individuals more fteedom and opportunities to expand into new areas.

REQUEST
Greg Jablonske seeks to reauthorize the final plat approval of SOUTH OAKS OF
HASTINGS 2ND ADDITION, containng 35 single family lots and 60 townhome lots on 37.54
acres gßnerally located along 31st Street between Bohlken Drive and Century Drive:
.. The plat was originally approved by the City Council on August 4, 2003. Chapter 11 of the
City Code (subdivision) requires all plats to be recorded with Dakota County within 90 days
or they are null and void.
CHANGES SINCE ORIGINAL APPROVAL
Since the August 4th approval the six twin home lots located on the north side of 31 st
Street (west of Bohlken Drive) have been subdivided in half to allow for separate
ownership of each unit. The total number of units is unchanged.
RECOMMENDED ACTION
The Planning Commission recommended unanimous approval of the Preliminary and Final
Plat at the July 14, 2003 meeting. Several individuals addressed the item during the public
hearing, the following comments were made:

Comprehensive Plan Classification
The proposed use and density are consistent with the Comprehensive Plan.
The Comprehensive Plan designates the property as:
. U-I, Urban Residential (1-3 units per acre) - north of 31 st Street

Existing Condition
The site is presently undeveloped. Areas along the far north and west (adjacent to the
Vermillion River) are wooded. The majority of the site is open with little topographic relief.
FINAL PLAT REVIEW
Trail Payment
Trails and sidewalks that are located with City right-of-ways will be constructed and
assessed as part of the public improvement. The feasibility report for South Oaks public
improvements identified a trail link between 31 st Street to the Vermillion River trail. The
cost for the trail was estimated at $42,000. Only 15 percent of the trail is located on South
Oaks property (the remaining 85 percent is on the city flood channel property). The
developer would only be responsible for 15 percent of the trail cost.
Public Land Dedication
The Natural Resources and Recreation Committee reviewed park dedication options with
the original South Oaks of Hastings plat and recommended the following:
1) Payment of cash in lieu of land for park dedication in the amount of $80,750 ($850
per unit x 95 units) prior to release of final plat mylars.
Lawcon Property Trade
As part of the original South Oaks of Hastings approval, the City of Hastings agreed to
swap approximately 0.95 city owned acres located along the rear of Lots 1-8, Block 2 with
approximately 0.98 acres owned by Mr. Jablonske located north of Lots 1-2, Block 3. The
trade was necessary in order to create adequate depth for lots on the west side of Bohlken
Drive.

The City owned land was acquired through the federal Lawcon program, and must receive
federal and state DNR approval prior to the trade. The request for land trade has been
submitted and verbally approved. Execution of formal documents is expected in the
coming weeks to officially allow the ownership change.
The following conditions must be satisfied as a condition of plat approval:
1) Final approval of the lawcon trade must be secured prior to filing of a final plat
for the affected property.
2) A 20 foot rear yard conservation easement must be approved by the City, and
established over the following properties prior to release of Final Plat mylars
for recording: Block 1, Lots 11-16; and Block 2, Lots 1-8. The Conservation
Easement requirement was part of the original conditions for City approval of the
lawcon swap in conjunction with the original South Oaks Addition.
Interceptor Sewer Fee
Sewer Interceptor Fees shall be paid as follows:
1) Payment of sewer interceptor fees in the amount of $30,875 ($325 per unit x 95
units) prior to release of final plat mylars.
Planned Residential Development
Areas south of 31 st Street were originally zoned as part of a planned residential
development, allowing for deviations from standard zoning setback and lot size
requ¡rements. The proposed residential density of the multiple family area is
approximately 7 units per acre, within the 4-8 unit per acre allowance under the U-II .
district of the Comprehensive Plan.
The Planned Residential Development layout is acceptable subject to the following:
1) All lots are subject to a 20 foot minimum front and rear yard setback. The
layout appears to meet this provision.
Lot Laya ut
Lot layout is acceptable with the following changes:
1) Outlot D must be combined with Lot 1, Block 3. Creation of small
undevelopable outlets is not recommended because of the strong likelihood of
becoming tax forfeit, with maintenance and liability reverting to the County and
City.

Homeowner Association\Covenants
A homeowner association and covenants must be established to ensure continued
maintenance of all outlots and common areas prior to release of the final plat mylars.
Flood Plain Fill
Portions of lots along the north end of Bohlken Drive are within the 100 year flood plain as
identified on the Federal Emergency Management Agency (FEMA) Map. A separate
application for flood plain fill has been submitted in conjunction with the plat application.
Approval of the Final Plat shall be contingent upon approval of the floodplain fill permit by
the City Council. Future construction of homes along Bohlken Drive may also require
FEMA review and approval and potentially a Conditional Letter of Map Revision (CLOMR)
prior to building construction.
Erosion Control Problems
The City has experienced problems with the builder\developer of South Oaks 1 5t Addition in
maintaining silt fences, and clear access of streets during construction. Erosion control
measures must be improved for the existing development, and will be closely monitored
during the construction of South Oaks 2nd Addition.
Site Plan Review
Site Plan review and approval for all buildings exceeding two units must be granted by the
City Council, prior to construction.
Final Plat Modifications
The following changes are needed on the Final Plat prior to signature of the Final Plat
Mylar:
1) A trail easement must be established to encompass the existing trail over
Block 2, Lot 1.
2) Rear dimension for Block 4, Lot 3 must be correctly identified. The
preliminary Plat shows the dimension as 32 feet, and Final Plat identifies the
dimension as 23.74 feet.
3) Front lot widths for Block 4, Lots 6 and 7 must clearly be identified.
4) Rear easements for Block 4, Lots 1-4; and Block 5, Lots 1-5 must be 20 feet in
width.

legally described as follows:

WHEREAS, on July 14, 2003, a public hearing was conducted before the Planning
Commission of the City of Hastings, as required by state law, city charter and city ordinance; and
WHEREAS, the Planning Commission recommended approval of the Final Plat subject
to the conditions contained herein; and
WHEREAS, on August 4, 2003, The City Council of the City of Hastings adopted
Resolution No. 08-10-03 approving the Final Plat of South Oaks of Hastings 2nd Addition; and
WHEREAS, The applicant has failed to submit the plat to Dakota County for approval
within the 90 day limit established in Chapter 11 of the City Code.

NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF HASTINGS AS FOLLOWS:
That the City Council hereby reauthorizes the final plat of SOUTH OAKS OF HASTINGS 2ND
ADDITION subject to the following subject to the conditions of Resolution No. 08-10-03 as follows:
1. Adherence to the conditions of the South Oaks of Hastings 2nd Addition Preliminary Plat
2. Final approval of the lawcon trade must be secured prior to filing of a final plat for the affected
property.
3. A 20 foot rear yard conservation easement must be approved by the City, and established over
the following properties prior to release of Final Plat mylars for recording: Block 1, Lots 11-16;
and Block 2, Lots 1-8.
4. Development of the platted outlots shall be prohibited until replatted as lots of record.
5. A declaration of covenants, conditions and restrictions or the equivalent document shall be
submitted for review and approval by the City before release of the final plat mylars to ensure
maintenance of open space, common drives, and common utilities. The declaration shall
include, but is not limited to, the following:
(a)
A statement requiring the deeds, leases or documents of conveyance affecting
buildings, units, parcels, tracts, townhouses, or apartments be subject to the
terms of the declaration.
(b) A provision for the formation of a property owners association or corporation and
that all owners must be members of said association or corporation which may
maintain all properties and common areas in good repair and which may assess
individual property owners proportionate shares of joint or common costs. The
association or corporation must remain in effect and may not be terminated or
disbanded. .
(c)
Membership in the association shall be mandatory for each owner and any
successive buyer.
(d)
Any open space restrictions must be permanent and may not be changed or
modified without city approval.
(e) The association is responsible for liability insurance, local taxes and the
maintenance of the open space facilities deeded to it.
(f)
Property owners are responsible for their pro-rata share of the cost of the
association by means of an assessment to be levied by the association which
meet the requirements for becoming a lien on the property in accordance with
Minnesota Statutes.

(g) The association may adjust the assessment to meet changing needs.
6. The following changes shall be made on the final plat mylars prior to signature by the City:
a)

Dear Mr. Hinzman:
In 1999 when the Bohlkens were in the process of platting Bohlken Estates 6th Addition, we
worked with the City and Greg Jablonske to provide a path from Bohlken Drive North to the
City Park. At the instance ofTon1 Montgomery of the Cjty of Hastings, we agreed to arrange the
westerly line of Lot 1, Block 1 so that the path would be perpendicular to Bohlken Drive and run
in a straight line to the park. Now we see that the preliminary plat of Lot 1, Block 2 of South
Oaks 2nd referenced above, has disregarded this path arrangement. In fact, there is no path at all
on the new plat and thus it would dead-end prior to reaching the park. You will note that on the
preliminary plat, no path extension is shown. Accordingly, in the event the City accepts the plat
as presented, then the existing path would end in the middle of Lot I, Block 2 and \vould
therefore be of no use to the public. In that case we ask that the City relinquish its easement for
path purposes and allow that land to be developed as a regular part of Lot 1, Block 1, Bohlken
Estates 6th.
In the event the City intends to provide an access path, it could curv'e and follow the easterly line
of said Lot 1, Block 2 and thus place it directly behind Lot 1, Block 1 of Bohlken Estates 6th.
This was not the agreement of Mr. Jablonske and the City at the time we platted. We object to
any path location which would follow the line I described. A better and acceptable location
would be to continue the path in a straight line at least to a depth of 135 feet from Bohlken
Drive, all according to OUI previous agreement.
Secondly, v.¡e contributed the entire path property to the City in our plat. Now, the City appears
to be conveying land north of our Lot 1) Block 1, to Mr. Jablonske. This seems to be not only
contrary to bur agreement with the City, but also unfair to the Bohlkens and an unnecessary
addition to the South Oaks plat. We ask that if any land lying directly north of Bohlken Estates
6th addition is to be conveyed by the City, it be conveyed to Bohlken Estates Partnership and
added to Lot 1) Block 1, Bohlken Estates 6th.

In the event no change is required on the South Oaks plat, an alternative would be to prohibit any
construction of any kind on the subject triangular piece lying north of Bohlken Estates 6th. We
are particularly concerned about this because the subject triangle would alre<;.dy be detached
iTom Lot 1, Block 2, South Oaks by reason of the inteIVening path, and thus could be an
attractive location for a shed, storage facility or doghouse or kennel with a fenced border. I am
sure you can understand our concern about this matter. .
In summary, we object to the proposal of a lot lying north of Bohlken Estates. We object to
dead-ending the path that we dedicated and we believe the City treated the Bohlkens unfairly in
this platting process and now are making matters worse by all a 'wing adjoining property to
potentially devalue the land of our client.
We ask that you try to work with us prior to approval of this part of the plat of South Oaks 2nd.

Greg Jablonske - South Oaks 2nd Addition - Century Drive and 31st Street.
a) Preliminary & Final Plat #2003-41 to subdivide single and multiple-family
units.
Special Use Permit #2003-49 - Floodplain Use Permit to place f ill on lots
along Bohlken Drive.

Director Hinzman provided background information on both items.
Chairman Anderson opened the public hearing at 8:28 pm.
Jeff Kelly, 3025 Highview Knoll asked if the street improvements were planned for this year,
whether this are was within a watershed area, what FEMA's requirements were, how deep
the boulevard is along 31 st Street, If the sidewalk is in the easement, and whether the
applicant will be filling in a pond.
Director Hinzman stated that no traffic studies have been done, but that both 31 st Street and
36th Street are identified as necessary connections in the road system. He added that the
existing flood area is identified on FEMA maps, and that certification to FEMA of the change
in flood area may be necessary prior to home construction on those lots. He added that the
proposed sidewalk is 5' wide, a trail would be 8'-10' wide, and that the applicant is creating
storage space to make up for the filling.
Joe Bocce, 3558 Greten Lane, stated that he was concerned about the land trade and fêlt
that the City could be getting a greater value for the land. He also feels the City is grossly
underestimating the traffic on 31 st Street. He suggested that the City develop the street as a
parkway to reduce speeds, as it will become a shortcut for casino traffic. He added that the
park in Century South is inadequate, with children waiting to get on the play equipment, and
that there is a problem with poor behavior of unsupervised children from the lower priced
homes. He also asked if the Planning Commission can regulate aesthetic issues.
Chairman Anderson responded that to a point the City can review and comment on
aesthetic issues.
Mr. Bocce asked what the units along Olson Drive would look like and what their price point
would be.
Greg Jablonske, applicant, stated that the units along Olson Drive would be in the $165,000
price range, and that it was a new product, and not like the units currently being constructed
by MW Johnson along 35th Street.
Matt Schuster, future Olson Drive resident, expressed concern that the lots were being split,
and questioned why there were no parks in the South Oaks area.

Mr. Jablonske stated that the units would probably be a split level style, and that the City
chose to accept cash in lieu of land for the South Oaks Development.
Mr. Kelly questioned what 36th Street would be connected to, and where the money from the
South Oaks park fees would go.
Director Hinzman explained road connections in the area, and stated that the NRRC
determines where the money goes, and tries to keep it within the same ward.
Paul Mocher, 18910 Plan Avenue, Ravenna Township, stated that he had recently
purchased Lot 1, Block 1, Bohlken's 6th Addition, which is the last lot on the north side of
Bohlken Drive and will be adjacent to the South Oaks development. He expressed concern
because of a portion of the South Oaks Development will protrude behind his lot.
Jeff McCauley, 788 South Park Drive, expressed concern with the existing wooded area
through which Bohlken Drive will continue, and asked what the costs of the lots would be in
that area. He also asked how it is decided which trees will be removed.
Mr. Jablonske stated that he anticipated the costs would run about $100,000 each. He
stated that some of the trees would be removed for grading purposes, but that there would
be a 20' easement at the rear 0 f each property to conserve the trees a nd prohibit clear
cutting.
Dan M attimiro, 114 25th Street West, questioned the reasons no traffic studies had been
done, was interested in the amounts of run-off to the Vermillion River, and how does the this
development impact the school district and the potential need for a new school. He felt the
City should reject the land trade, as filling in land wrecks trees in the area. The trade may be
equal space-wise, but not value-wise.
Chairman Anderson closed the public hearing at 9:05 pm.
Commissioner Truax asked why this development was being allowed to plat cul-de-sacs.
Director Hinzman stated that cul-de-sacs are allowed is it can be demonstrated that there
are physical and/or geographical limitations. In this case, requiring both cul-de-sacs to
connect to neighboring streets would mean a number of lots with double or possibly even
triple frontage on streets.
Commissioner Twedt asked if the portion of the South Oaks Development that currently is
located behind the home in the Bohlken Addition could be sold to the owners of that lot or
removed from the land trade.
Director Hinzman stated that the rules regarding LAWCON properties are very strict and that
that would probably not be allowed.
Chairman Anderson asked about the status of the wooded area along Bohlken Drive.
Director Hinzman stated that a tree inventory is required to be done afld must be approved
by the City Forester prior to any work being done in the area.
Mr. Jablonske stated that the issue with the two lots at the meeting point of Bohlken's
Addition and the South Oaks development had been tried to resolved earlier, as the City
indicated it wanted right angles to the lots.

Planning Commission Action (Plat):
Commissioner Greil moved and Commissioner Hollenbeck seconded a motion to
approve the Preliminary and Final Plat for South Oaks 2nd Addition to the City
Council, with the following conditions:
Preliminary Plat conditions:
1) Cash in lieu of land for park dedication shall be paid at the time and amount
established upon final platting
2)
Sewer interceptor fees shall be paid at the time and amount established upon final
platting.
3)
A tree preservation plan including the identification of significant trees and proposed
measures for preservation must be submitted and approved.

All lots are subject to a 20 foot minimum front and rear yard setback
Outlot D must be combined with Lot 1, Block 3.

All lots abutting 31 st Street are subject to a 35 foot setback.
Block 3, Lots 1-6 would contain twin homes on a single lot of record. It is strongly
recommended that construction of the units incorporate provision for future
subdivision including separate utilities and adequate fire separation.
A ten foot corner setback for the R-2 and R-3 Districts must be identified on the plan.
Easements must be delineated on Block 3, Lots 7-10, and Blocks 7-10.
35th Street must be labeled on the plat.
Street names for A & B, and Outlot C will need to be submitted and approved, prior
to City Council approval.
The street width for Outlot C must be identified. It appears the street width may limit
the ability for on-street parking, and must be labeled no parking.
All cul-de-sacs must include landscaped islands. A homeowners association or
covenants must be established to ensure maintenance of plantin"gs.
One front yard tree is required to be planted within 10-15' of the right-of-way line.
Boulevard trees must be setback at least 30 feet from all intersections.
Approval of the Final Plat shall be contingent upon approval of the floodplain fill
permit by the City Council.
Future construction of homes along Bohlken Drive may also require additional FEMA
review and approvals including a Conditional Letter of Map Revision (CLOMR) prior
to building construction.

Final approval of the grading, drainage and utility plans by the Public Works Director.
The applicant shall pay for all costs associated with consultant review of the plans
and assumes all risks associated with the grading and utility placement prior to
formal approvals.
All disturbed areas on this property shall be stabilized with rooting vegetative cover
to eliminate erosion problems.
The disturbed areas of the site shall be maintained to the requirements of the City's
property maintenance ordinance.
Submission of an electronic copy of all plan sets (TIF, PDF, or similar format) prior to
issuance of certificate of occupancy.
Approval is subject to a one year sunset clause. Approval is null and void if

Development of the platted outlots shall be prohibited until replatted as lots of record.
A declaration of covenants, conditions and restrictions or the equivalent document
shall be submitted for review and approval by the City before release of the final piat
mylars to ensure maintenance of open space, common drives, and common utilities.
The declaration shall include, but is not limited to, the following:

A statement requiring the deeds, leases or documents of conveyance
affecting buildings, units, parcels, tracts, townhouses, or apartments be
subject to the terms of the declaration.
A provision for the formation of a property owners association or corporation
and that all owners must be members of said association or corporation
which may maintain all properties and common areas in good repair and
which may assess individual property owners proportionate shares of joint or
common costs. The association or corporation must remain in effect and may
not be terminated or disbanded.

Any open space restrictions must be permanent and may not be changed or

The association is responsible for liability insurance, local taxes and the

Execution of a development agreement to memorialize the conditions of the plat and

Payment of cash in lieu of land for park dedication in the amount of $80,750 ($850
per unit x 95 units) prior to release of final plat mylars.

Dear Dave,
Thank you for your support of the past Nick Clare Memorial runs and for bringing the run
request forward to the city council. Weare hoping to get approval for the run again this
year. Please put it on the consent agenda as soon as possible. Proceeds from the run will
benefit athletic programs at the high school, Nick Clare scholarship fund,and local
charities.
The routes for the 10K, 5K, and 2K will be the same as last year. The 10K and 5K will
start Oft Featherstone. The 10K will proceed North on Pleasant Drive, then down on the
Lock and Dam Road, then up on 2nd Street back to Pleasant. It will then turn west on 4th
St. to General Sieben Drive, then back to Featherstone Road into the North/East entrance
of the High School.
The 5K will go from Featherstone to State, then to 3rdSt, then River Street, and back up on
4th Street to General Sieben Drive, and back to Featherstone into the North/East entrance of
"the High School. The 2K route will go down General Sieben to Summit Point, then back
on Featherstone. A map is enclosed with the routes for the three walk/runs.
We will need the following:
* About 200 cones, 6 buckets of sand, and barricades from the street department.
* Police assistance in blocking off part of one road (County Road 42) and
directing traffic.
We will contact each department for the above once approval by you and the city council is
granted.
We would like the barricades at General Sieben Dr. & 4th, River & 4th, Pleasant & IS\ 2nd
& Lock & Dam Rd., 1st & County Rd. 42, Pleasant & 4th, River & 2nd S1., Cty. Rd. 42 &
Pleasant, 2nd & River and 2nd & Pine S1.

Nick Clare was an avid cross-country runner and cross-country skier. He was tragically killed in a motor vehicle
accident on November 11, 2001. Nick graduated from Hastings High School in 1996. He participated in the cross-
country running, cross-country skiing and track programs. Proceeds from the run witt benefit these programs and
the scholarship in his name at the Hastings High School. .

THIS AGREEMENT is made and entered into by and between the State of
Minnesota, Department of Transportation, hereinafter referred to as
the "State", and the City of Hastings, Minnesota, acting by and
through its City Council, hereinafter referred to as the "City".

WHEREAS, the City is about to perform landscaping along Trunk Highway
No. 55 from Spring Street to Bahls Drive within the corpo~ate City
limits in accordance with City-prepared plans, specifications and
special provisions designated as the "Hastings T.H.55 Landscaping
Plan", which project has been designated by the State as State
Project No. 1910-969A (T.H.55=053)¡ and
WHEREAS, the City has requested participation by the State in the
costs of landscape materials acquisition in accordance with the terms
of the State's "Community Roadside Landscaping Partnership Program";
and
WHEREAS, the State is willing to participate in .the costs of the
landscape materials acquisition as hereinafter set forth¡and
WHEREAS, Minnesota Statute Section 161.20, subdivision 2 authorizes
the Commissioner of Transportation to make arrangements with and
cooperate with any governmental authority for the purposes of
constructing, maintaining and improving the trunk highway system.

IT IS, THEREFORE, MUTUALLY AGREED AS FOLLOWS:
ARTICLE I - PROJECT ADMINISTRATION BY THE CITY
Section A. Landscape Materials Acquisition
The City shall acquire landscape materials in accordance with
State-approved City plans, specifications and special provisions
designated as the "Hastings T.H.55 Landscaping Plan". Landscaping
shall be performed by City forces in accordance with State-approved
City plans, specifications and special provisions that are on file in
the City's office and in the State's pffice of Environmental Services
in St. Paul, and are incorpor~ted into this Agreement by reference.

Section B.
Purchase Order to be Furnished to the State
The City shall, within 7 days after ordering the landscape materials,
submit. to the State's Landscape Partnership Program Coordinator in
St. Paul a copy of the purchase order for the landscape materials.
Section C. Direction, Supervisi~n and Inspection
Landscape materials acqu'isition performed in accordancê.with this
Agreement shall be under the direction of the City; however, the
State cost participation landscape materials to be acquired under
this Agreement shall be open to inspection by the State's authorized
representatives. The City shall give the State's Landscape
Partnership ,Program Coordinator five days notice of its intention to
receive delivery of the landscape materials.
Responsibility for the control of the State cost participation
landscape materials acquisition covered under this Agreement shall be
on the City and shall be carried out in accordance with State-
approved City plans, specifications a~d special provisions designated
as the "Hastings T.H.55 Landscaping Plan".

The City must verify whether or not nursery vendors are under a Gypsy
. .
Moth Compliance Agreement between the Minnesota Department of
Agriculture, hereinafter referred to as the "MDA", and the United
States Department of Agriculture or under an MDA Japanese Beetle
Quarantine. A current Certificate of Compliance must accompany all
plant material shipped from nursery vendors subject to quarantines
for Gypsy Moth and Japanese Beetle. To determine if vendors are
subject to quarantines, call the MDA Supervisor of Plant Regulatory
Services at (651) 296-8388.

Section D. Completion of Materials Acquisition and Installation
The City shall cause the acquisition and installation of landscape
materials to be started and completed in accordanèe with the time
schedule in the Community Roadside Landscaping Partnership Program
Project Application, which is on file in the State's Office of
Environmental Services and is incorporated into this Agreement by
reference. An exchange of letters between the appropriate City
official and the State's Landscape Partnership Program Coordinator,
for unavoidable delays encountered in the performance thereof,may
extend the completion date for the landscape materials acquisition
and installation.
Section E. Compliance with Laws, Ordinances and Regulations
The City shall, in connection with the acquisition of the landscape
materials, comply with all Federal, State and Local laws, and all
applicable ordinances and regulations.
Section F. Right-of-Way, Easements and Permits
The City is hereby authorized to work on State right-of-way for the
purposes of installing and maintaining the landscape materials, ".
including any necessary replacement of landscape materials that fail
to survive.
The City shall, without cost or expense to the State, obtain all
rights-of-way, easements, construction permits and any other permits
and sanctions that may be required in connection with the
installation of landscape materials. Prior to advance payment by the
State, the City.shall furnish the State with certified copies of the
documents for those rights-of-way and easements, and certified copies
.of those construction permits and other permits and sanctions
required for State landscaping.

ARTICLE II - STATE COST
Section A.
Basis
The State's full and complete share of the costs of the landscaping
to be performed along Trunk Highway No. 55 from Spring $treet to
Bahls Drive within the corporate City limits under State Project
No. 1910-969A (T.H.55=053) shall be equal to the delivered cost of
the'landscaping materials acquired in accordance with the "Hastings
T.H.55 Landscaping Plan."
Section B. Payment
It is estimated that the cost of the landscape materials acquisition
is $5,797.00. The maximum obligation of the State under this
Agreement shall not exceed $15,000.00, unless the maximum 'obligation
is increased 'by execution of an amendment to this Agreement.
The State shall pay to the City an amount equal to the delivered cost
of the landscape materials, not to exceed the maximum obligation,
after the following conditions have been met:

Encumbrance by the State of the State's total cost share.

Execution and approval of this Agreement and the State's
transmittal of it to the City.

Receipt by the State's Landscape Partnership Program Coordinator,
from the City, of the following:

Copies of the purchase orders for the landscape materials,

supplier invoices for the landscape materials acquisition

ARTICLE III - GENERAL PROVISIONS

installation and Maintenance by the Cit~
After acquisition of the landscape materials, the City shall install
the landscape materials along Trunk Highway No~ 55 and provide for
the proper mainten~nce thereof, without cost or expense to the State.
Maintenance includes, but is not limited to, removal and replacement
of all materials that fail to survive. Criteria for maintenance and
replacement are shown and described in EXHIBIT "A", Maintenance
Responsibilities Plan and Schedule, which is attached and
incorporated into this Agreement.
Section B. Responsibilities of the Cit~
The City shall, in connection with the landscape materials
acquisition, installation and maintenance, comply with the following
conditions:
1.
Use of State right-of-way shall in no way impair or interfere
with the safety or convenience of the traveling public in its use
of the highway.
2.
Preserve and protect all utilities' located on lands covered by
this Agreement, without cost or expense to the State.

As required by Minnesota Statute 216D, notify Gopher State One
Call System (1-800-252-1166) at least 48 hours before any
excavation is done on this project.
4.
No advertising signs or devices of any form or size shall be
constructed or shall be permitted to be constructed or placed
upon State right-of-way.
5.
Upon completion of the installation of landscape materials and
during performance of maintenance operations, restore all
disturbed areas of State right-af-way so as to perpetuate
satisfactory drainage, erosion control ~nd aesthetics.
Any'use of State right-of-way permitted by this Agreement shall
remain subordinate to the right of the State to use the property for
highway and trànsportation purposes. This Agreement does .not grant
any interest whatsoever in land, nor does it establish a permanent
park, recreation area or wildlife or waterfowl refuge facility that
. would become subject to Section 4(f) of the Federal-Aid Highway Act
of 1968.

Section C.
Examination of Books, Records, Etc.
As provided by Minnesota Statute Section 16C.OS, subdivision 5, the
books, records, documents, and accounting procedures and practices of
each party' relevant to this Agreement are subject to examination by
each party, and either the legislative auditor or the state auditor
as appropriate, for' a minimum of six years from final payment.
Section D. Te~nation of Agreement
The State may terminate this Agreement if "it's the State's desire to
use any portion of State right-of-way subject to this Agreement for
transportation purposes, by giving the City written notice at least

90 days prior to the date that such termination shall become
effective. Upon termination of this Agreement, the City will be
required to restore and return the area to a condition satisfactory
to the St~te's Metropolitan District Engineer at Roseville.
Each party may terminate this Agreement, with or without cause, by
providing the other party with written or fax notice of. effective
date of termination. The State is not obligated to pay for services
performed after notice and effective date of termination. Upon such
termination, the City is entitled to payment for services
satisfactorily performed under this Agreement. prior to the effective
date of termination.
The State may immediately terminate this Agreement if it does not
obtain funding from the Minnesota Legislature, or other funding
source; or if funding cannot be continued at a level sufficient to
allow for the payment of the services covered under this Agreement.
Termination must be by written or fax notice to the City. The State
is not obligated to pay for services performed after notice and
effective date of termination. Upon such termination, the City ia
entitled to payment' for services satisfactorily performed under this
Agreement prior to the effective date of termination, to the extent
the funds are available.
Section E.
C1a~s
Each party is responsible for its own employees for any claims
arising under the Workers Compensation Act. Each party is
responsible for its own acts, omissions and the results thereof to
the extent authorized by law and will not be responsible for the acts
and omissions of others and the results thereof. Minnesota Statutes
Section 3.736 and other applicable law govern liability of the State.

Minnesota'Statutes Chapter 466 and other applicable law govern
liability of the City.
Section F. 'Nondiscrimination
The provisions of Minnesota Statute Section 181.59.and of any
applicable law relating to civil rights and discrimination shall be
considered part of this Agreement as if fully set forth herein.
Section G. Agreement A~roval
Before this Agreement becomes binding and effective, it shall be
approved by a City Council resolution and executed by such State and
City officers as the law may provide' in addition to the Commissioner
of Transportation or their authorized representative.

Recommended City Council Action:
Approve the attached Resolution, approving a one-day gambling permit for Elizabeth Ann
Seton School. The raffle is planned for April 30, 2004 and will be held at SEAS.
Background:
If Council should approve this application, the attached resolution will be sent to the
Minnesota Lawful Gambling Board showing the City's approval to allow the raffle. The
Council approved a similar request by this organization the last several years.

WHEREAS, the Minnesota Lawful Gambling Board requires a Resolution be passed
to approve the request; and
WHEREAS, the application for Exemption from lawful Gambling license has been
presented; and .
WHEREAS, St. Elizabeth Ann Seton has paid the required fees.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hastings
that the Mayor and City Clerk are authorized and directed to sign this resolution and
forward to the Minnesota Department of Gaming, Gambling Control Division, showing the
approval of this application for an Exemption from Lawful Gambling License.

This memo is to advise the Council of a recent vehicle forfeiture that has been processed
through the courts. Because of this successful forfeiture, this department is now the owner
of a vehicle for which we are seeking Council's permission to utilize for the Drug Task
Force officers from our department who work with the Dakot&County Drug Task Force,
The vehicle is a 1995 Chevrolet pickup, V.I.N, #2GCEK19K3S1245909. An Administrative
Forfeiture was taken against the owner of the vehicle for a 2nd Degree D,U.I. offense that
occurred on September 7th, 2003, On January 22nd, 2004 the defendant pled guilty to the
2nd Degree D.U.I offense, and the forfeiture of the vehicle was then processed through City
Attorney Shawn Moynihan's office and the Dakota County Coull
As previously mentioned, it is our request that we utilize this vehicle' for use by our two
officers working with the Dakota County Drug Task Force program as well for use by the
D.A.R.E. program, which is allowable for vehicle forfeitures. The other option is to sell the
vehicle, and the proceeds for the vehicle must then be allocated to the D.U.I. Forfeiture
Fund or a D.A. .R.E. type program. We currently have one previously forfeited vehicle that
our Drug Task Force officers have utilized. That vehicle has had many mechanical
problems and it is older and not very reliable for use by our Drug Task Force officers.

Attached to this memo is a proposed agreement between the city and a company
called Community Marketing Consultants to put an Informational Display Unit
(IDU) at the Hastings Civic Arena.
The IDU would have spots for about 10 advertising signs that Community
Marketing Consultants would sell to sponsors. The IDU would also have a white
board portion where notices or arena information. could be written. Additionally,
there would be pockets on the bottom of the display where brochures could be
placed.
The IDU would hang on the wall in the lobby area of the arena. SHv McGree said
that at this point it is proposed to go over the third concession window that has yet
to be used.
The proposed agreement calls for the city to be paid $1000 per year for allowing this
unit to be displayed at the arena. The rest of the terms of the agreement can be
found in the document.
SHv is recommending council approve this agreement.

AGREEMENT
THIS A GREEMENT is made this - day of , 2004 by and between the City
of Hastings ("City") and Community Marketing Consultants Inc, ("CMC").
RECITALS.
A.
City is the owner of the Hastings Civic Arena in the City of Hastings, Minnesota.
B,
CMC is in the business of selling advertising on Information Display Units (IDU) which are
owned by CMC.
C,
CMC seeks an agreement to post an IDU at City's ice arena, subject to the terms of this
Agreement
D.
City is willing to allow CMC to post one of its IDU's at City's arena subject to the terms of
this Agreement.
NOw, THEREFORE, it is agreed between the parties as follows:
1.
Puroose. City grants CMC the non-exclusive right to post one ofCMC's IDU's at
the City's arena. The location of the IDU shall be in a location mutually agreed upon
between the parties. The City reserves the right to relocate the IDU if City
determines the IDU will interfere with any future improvements to the arena or with
any, function of the arena, City will notify CMC at least two weeks before City
relocates the IDU and will ask CMC for input on the location to which the IDU will
be removed, The costs to locate and relocate the IDU shall be paid by CMC.

Term. The term of this Agreement shall be for one year from the date this
Agreement is first signed, This date shall be known as the "anniversary date". This
Agreement shall automatically be renewed unless at least 90 days before the
anniversary date either party notifies the other in writing that this Agreement will

terminate on the anniversary date,
Termination. Upon termination of this Agreement, CMC will remove its IDU
within seven days after the anniversary date, If CMC does not remove the IDU
within seven days, the City can remove the IDU and CMC agrees to reimburse the
City for the cost of removal. CMC must take possession of the IDU within 30 days
after it has been removed or it will be deemed to be abandoned by CMC and City
may then dispose of the IDU in a manner the City deems appropriate, without any
further liability to CMC,

Compensation. CMC agrees to pay City $1,000.00 per l2-month term for the
privilege of posting its IDU at the civic arena, One half of the payment ($500) shall
be made to the City upon City's signing this Agreement and before the IDU is
installed at the arena, The second half of shall be paid to the city not later than 30
days before the end of the anniversary year. Thereafter, if this Agreement is renewed,
payment shall be made at least 30 days prior to the anniversary date. It is intended
that the second half of the payment and the first half of the next year's payment will
be due at the same time, Failure to make timely payment to the City shall be grounds
for termination of this Agreement by the City, If CMC does not make tim~ly
payments as required by this Agreement, city has the right to immediately take down
the IDU and retain possession of it until CMC pays all monies due the City, If CMC
does not make payment in full to the City within 30 days after payment is due, City
has the right to dispose of the IDU in any manner it deems appropriate and City will
not be responsible to CMC for any costs of the IDU,

Risk of Loss/Insurance. If the IDU is damaged or destroyed while it is in the arena,
and assuming CMC is not in default of this agreement at the time, then City's
liability to CMC for the damages will be only to the extent of any insurance coverage
the City may have on the IDU. All remaining risk of loss shall be CMC's
responsibility. City is not under any obligation to acquire any insurance coverage on
the IDU, If CMC is in default of this Agreement at the time of the damage and
destruction then City and its insurer shall have no responsibility to CMC whatsoever.

Citv's Ri1!ht to Review Advertisers. The City is given the right to review all
advertising prior to display on the IDU, As part of the City's right to review
advertising, the City also reserves the right to reject any proposed advertising if the
City deems it inappropriate for the civic arena,

Notice of Breach. Upon a breach of the terms of this Agreement by one party, this
Agreement may be terminated by the other party, Written notice shall be given to the
breaching party, which notice must specify the nature of the breach. Ifwithin 30 days
after that notice has been sent, the breaching party has not corrected the breach, the
other party can declare this Agreement terminated and all payments made under this
Agreement shall be kept by the City, In this event, CMC agrees to remove its IDU
within seven days after the Agreement has been terminated or it may be disposed of s
provided in Paragraph 3,
8,
Entire Aereement. This Agreement contains the entire understanding of the parties
and no oral representations, express or implied, have been relied upon by the
Agreement may be modified only by the written Agreement of both parties and shall
be binding upon the assigns and successors of the parties,

Steve West, President of the Hastings Concert Association, asks Council
permission to use Public Square and City Hall for free Sunday concerts
again this summer. See attached letter. The request includes the same
items that have been approved in the past:
1. Use of the north steps and square in good weather, and the council
Chamber if raining.
2. A Police Reserve Officer to open and secure City Hall and assist
public.
3. Use of City Hall restrooms and refrigerator for ice cream.
4. Place concert signs on the iron fence Friday through Sunday each
week.
The 2004 Concerts will be held August 1, 8, 15, 22 and 29, 2004. The
concerts have been a popular community event for many years. The
Hastings Concert Ass.ociation.does an excellent job of fund raising,
managing and promoting. .

The Hastings Concert Association would like the opportunity to use the Public Square
and City Hall for our summer Sunday night concerts. These will be held on August 1,8,
15, 22 and 29, 2004. We would like use of the building for restrooms and reftigeration
for the groups serving ice cream and pie. We would also like to use Council Chambers in
case of rain.
As in the past, we would appreciate if you could provide a po lice reservist beginning at
5:00 p.rn. for set-up. The concert should be completed and the area vacated by around
9:00 p.rn. We would also like permission to once again place the "concert" sign on the
Public Square fence from Friday evening until the conclusion of the Sunday concert.
These concert have gained in popularity over the years (over 1500 people attended in
2003) and donations from local businesses continue to allow us to offer these ftee of
charge to the residents of Hastings and surrounding communities. The concerts also
provide fundraising opportunities for other non-profit organizations through serving
refteshments.
I want to take this opportunity to thank you and the Council for your support and help in
allowing us to host these events since 1990.

Request for Authorization to Purchase Two Staff/Emergency
Response Vehicles
Included in the 2002 capital improvements budgët, was the purchase of a
replacement staff/utility vehicle. The amount approved at that time was $33,400,00,
which included the costs necessary to outfit the "ehicle with lights, siren, graphics,
and radio installation, This vehicle was to be purchased from the State bid, which is
awarded in the-Pall of the year. '
Prior to purchase of a replacement staff vehicle, concerns arose regarding the loss of
local government aid, Since any loss of aid would have a direct influence on
budgets and most likely impact ERF contributions, I decided to delay this purchase,
My decision to do so was based on ERF balances at that time, and more critical
needs such as replacement of two 1981 first-line '~mergency response vehicles. Also
occurring during this timeframe was an accident involving the Assistant Fire Chief'.s
vehicle, The damage amount to the car rendered it unrepairable and the vehicle
was a total loss. Since the value of the vehicle resulted in approximately $3,000,00 in
reimbursement to the City, funding was not available for a replacement. Since the
accident, the Assistant Fire Chief has been using a vehicle, which was purchased to
replace a 1971 grass fire rig, To date, the original grass fire rig is still in service,
After meeting with the Finance Committee and learning ERF funding may be
restored for 2004, the need for replacing staff vehicles returned as a priority,
Unfortunately, the budget process was well underway and requesting at that time,
with the uncertainty of ERF contributions, the decision to wait and see was made, In
discussion with Lori Webster, we decided to request a budget transfer in 2004 from
the fire department's ERF if adequate funding was available.

Purchasing two vehicles at the same time would allow for a number or organizational
improvements. Most importantly: restoring the Assistant Fire Chief's vehicle to its
intended use, retiring a 1971 vehicle, and replacing a 1997 vehicle with 117,000
miles logged, If approved, both vehicles would be equipped and designed the
same allowing for ease of use by weekend duty paid-an-call officers for emergency
response.
Requested Action:
Approve purchase from the State bid awarded to Hinckley Chevrolet for two 2004
Chevrolet Tahoe 4x4 sport utility vehicles in the amount of $29,950,00 each. Also
allow for $5,500.00 to equip and outfit vehicles for emergency response.

Proposed Liquor Ordinance Violation
Dear Mayor and City Council Members:
As the council may recall, it recently was considering imposing penalties against the owner of House
of Wines for an illegal sale. During that process, I pointed out to the council that the current city
ordinance requires a notice to be published in the legål newspaper ten days prior to the date of any
hearing to suspend or tenninate a liquor license. Minnesota state law does not require published
notice, State law only requires that the owner of the license be given notice of the hearing and be
given an opportunity to respond to the allegations,

Since the state law does not require publication, I am recommending the city council delete from city
code the requirement of published notice. This publication requirement hampers the ability of the
council to timely address liquor liceJ?se violations. It does not alter the requirement that the holder
of the license be notified, To expedite the process to suspend or revoke a liquor license, I
recommend the council delete the publication requirement.

Approve a resolution, designating mail balloting for all voters living in Hastings,
Washington County.

The City of Hastings has a small portion of land which extends into Washington County,
Anywhere between two and four registered voters live in this section (Ward 1, Precinct 1),
and the City has previously provided separate ballots and supplies for these voters. This
an additional burden on City and County staff to prepare the supplies, and traditionally
these voters have voted by absentee ballot.
Therefore, City Staff and Washington County have worked together to prepare a resolution
which would allow these voters to vote by mail ballot for this year's and all future
elections, until rescinded by the City Council. These voters will be notified of this change,
which is basically an administrative change and should be essentially transparent to the
voters. If you have any questions, please feel free to contact me,

After completion of the scheduled public hearing, the City Council is asked to take
action on the rate adjustment for residential solid waste collection, as requested in the
attached documents from Waste Management

At the City Council meeting on February 2, 2004 action was taken to schedule a public
hearing for Tuesday February 17, 2004 to consider the request made by Waste
Management for an adjustment in the residential solid waste collection rates, In
November, 2000 a six year solid waste collection and recycling license was awarded to
Waste Management. One of the provisions included a restriction on rate adjustments
only after three years, and then only if increased costs were demonstrated, and the rate
was adjusted by no more than 3,00 %. Documentation supporting the requested rate
adjustment, as submitted by Waste Management is enclosed for your review.
During a meeting of the Utility Committee on Thursday January 22, 2004, Randy Triplett
from Waste Management presented information on the proposed rate adjustment. The
Utility Committee is in agreement that the rate adjustment should be implemented, City
Ordinance requires a public hearing, preceded by 10 days published notice, which has
been completed. Furthermore, City Ordinance states that, "Any requested change in
these rates shall be submitted to the City Council in writing, at least (60) days prior to
the proposed implementation date for any adjustment. Thus, any increase in rates
would only take place 60 days after February 2, 2004, which is the official date in which
the full City Council was notified of the requested rate adjustment.

Thank you for the opportunity to present our request for a rate increase on the residential solid waste
collection. A brief history to get each of you to the point we are at today.
In November 2000, a six-year solid waste collection and recycling license was awarded to Waste
Management - Hastings. One of the provisions of this agreement was: "Rates would be adjusted after
three years, only if increased costs are demonstrated: the increase is approved by the City Council,
and with the understanding that rates would not increase by more than 3%". The rates listed below
were effective January 1, 2000.

In December 2001, Waste Management approached the City Council to request an increase based on
a change in taxation from the State of Wisconsin from $0.30 per ton to $3.00 per ton effective January .
1, 2002. The increased was approved at the January 7th, 2002 Council Meeting and went into effect
April 1st, 2002. The increase at this time went directly to the State of Wisconsin. The rates at that time
changed as listed below.

May 2002 was the public hearing for a rate increase for single sort recycling. The requested increase of
$0.30 per month was to pay the capital expenditure for 5,000 carts. The increase became effective in
July 2002. The rates changed as listed below.

To date, the two increases that Hastings residents have received since 2000 have been increases that
have gone directly to pay for disposal cost and single sort recycling carts. Waste Management is
seeking an increase for the operating or hauling of the solid waste.
Some of the cost increase we have experienced since 2000 are listed below. Please note that in April
2000, all Waste Management customers throughout the United States, as well as customers of UPS,
FED-EX and other transportation companies implemented a fuel surcharge because of the spike in
diesel fuel. The table below was taken directly from Department of Energy and can be found at
www.eia.doe.gov. The City of Hastings residents do have a fuel surcharge on their quarterly invoice.

Fuel is a major component of our hauling or collection costs. While new trucks have helped with the
amount of fuel being consumed per hour, a collection truck in the City of Hastings will use over 50
gallons of fuel each day. With the increased cost of fuel, other petroleum-based products such as oil
and grease have increased also, along with the cost associated with getting those products delivered.

The spreadsheet below demonstrates the cost increase of providing quality and affordable health
insurance for our employees. I have listed the actual cost to Waste Management for each year, and
have shown for 2004 the actual out of pocket expense for an employee with family coverage. While we
have passed a portion of these increases on to the employees, Waste Management does pride
ourselves on providing equal or better health care coverage than other Fortune 500 companies.

Waste Management has added other services since December 2000 that are worthy to be mentioned.
The first is the success of the Youth Recycling Program. This was launched with the first youth group
in February 2002 and Boy Scout Troop 503 earned $330.00 for helping recycling 22 tons of mixed
paper. Since that time an additional 189.69 tons have been placed into the youth recycling box, and
$2.845.35 has been donated to various groups for their education and recycling efforts. It should be
noted that from the data available, no decrease in participation or the amount of tons recycled has been
seen from the residential homes within the City of Hastings.
April 2001 Waste Management received approval to allow City of Hastings residents to dispose of Sony
electronic products at no charge and non-Sony products for a fee at our Yard Waste drop site. This is
advertised each year in the City of Hastings - Solid Waste Guide To date 315 Sony products have been
delivered to our facility at no charge.
Because of the aforementioned cost increases, Waste Management is requesting a 3% increase on
the solid waste collection. With council approval and then the required public hearing, the increase
would be effective as soon as April 1, 2004. The table below lists the current rates and then the new
rates with the approved increase.

While any price increase is sometimes difficult to accept, Waste Management feels that we have done
an excellent job of containing and reducing costs associated with the collection of the solid waste.
Changes such as automation, day changes and every other week collection directly lower labor and
worker compensation costs. However 75% to 80% of our costs are variable costs such as fuel, truck
repairs, parts, health insurance, cost of living wage increases and other overhead supplies. These
variable costs have increased over the last four years and we have been able to absorb some of these
with our increased operating efficiencies. It has now become necessary to request this increase to
provide an acceptable level of return to Waste Management.

Re: Police Dept. building roof replacement
Council action is requested on awarding the roof replacement contract for the
Police station roof. Because the bids are all fairly close and the materials are all very
similar, I would like to focus on the contractors. A roof with the best materials can still
leak if not applied properly. Because of the thickness of the material, I would like to
recommend that Fischer Co.'s bid of $40,880.00 be accepted. I feel this would give the
City of Hastings the best value for it's money.
I have bids from three different contractors, all reputable and using similar
materials. They are as follows:

The flat roofing systems on the Police station, Fire station and part of City Hall
are now all 10 and 11 years old and at their end of useful life. They all have an EDPM
(black rubber) ballasted roofs. While these roofs are the cheapest, they also have the
shortest life span (abol:1t 10 yem:s). After much research, I am rec~mm~~ding a white
thennoplastics ('inyl) r°<lfing system. These eliminate the problems that go with EDPM
roofs, ie, shrinkage, tearing, weak seams, etc. Their life span is easily fifteen to twenty
years with the thickness of the products I am looking at ( about 50 mils,) and the white
color reflects a very high percentage of the suns heat. If the roof has air conditioning
equipment on it, one time energy rebates are available from Xcel Energy. The Police
station qualifies for a little over $3000.00 in rebates. Since the Police station roof is in the
worst shape and currently leaking, this roof is scheduled to be replaced this year. The
money has been set aside for the last two years from the ERF fund and is currently at
$97,220.86.

No change to water rates are recommended for 2004, Estimated revenues for 2004 based
on a five year average usage are expected to show a small surplus after deducting
estimated 2004 expenses. The 2004 expenses include a five year average of watermain
replacement costs. Both water usage and watermain replacements are calculated on five
year averages to level out fluctuations in usage due to variable weather, and fluctuations
in watermain replacements based on street reconstruction needs,

City continues to reconstruct its older streets, additional sanitary sewer main replacement
will occur, though not likely at the level expected in the Westwood

generate an additional $50,000 of revenue per year,

repairs, parts, health insurance, cost of living wage increases and other overhead supplies. These
variable costs have increased over the last four years and we have been able to absorb some of these
with our increased operating efficiencies, It has now become necessary to request this increase to
provide an acceptable level of return to Waste Management.

It is recommended that the City Council take action authorizing the ultimate frisbee
event at Todd Field in the City of Hastings, based on the conditions and requirements
outlined be10w,

City Councilmember Danna Elling Schultz and Staff have been in contact with
organizers of an ultimate frisbee event scheduled to be conducted at Todd Field May
7th, 8th and 9th. Organizers are hoping to break a world record of 50 hours of continuous
ultimate frisbee, and to raise money for the American Cancer Society, Permission has
been granted to use Todd Field by the Hastings High School, who is also planning to
co-sponsor the event. The event will start on Friday and end of Sunday, Lights are
projected to be on both evenings, with the intent to have only the lights on the north side
of the field on, reducing the shining in the residential area. Further review of that
situation will take place as the event gets closer and the weather warmer, While one of
the requests is to waive the curfew requirements, such a change would require an
ordinance modification, and also coordination with the Dakota County. Discussions with
the Police Department suggest that like other "all-night" events, that strict enforcement
of the curfew woufd take place only outside of the "grounds" (Todd Field), and that
participants omy be allowed to leave Todd Field with their parent(s). Furthermore, adûlt
supervision should be on the premise at all times, Staff would also suggest that the
organizers also conduct a neighborhood meeting advising of the event, and that the City
be given evidenœ that said meeting will take place and be advised of the time, date and
location, Finally, Staff would also suggest that any approval or endorsement by the City
Council be given with the understanding that music, and other loud noises shall not
become a nuisance to the neighborhood and that there be strict enforcement.

LeDuc House Restoration Update
The following is the February update on construction work for the LeDuc House Restoration. If you have
any questions or concerns, please let me know and I will be happy to discuss them with you.

The new Summer Kitchen foundation is almost complete, The contractor hand dug the entire
interior perimeter of the foundation and has installed a new concrete footing below frost, with a
concrete block foundation wall. The general contractor mistakenly built the foundation wall
completely out of concrete block, forgetting stone was to be installed above grade, They will be
removing concrete block in applicable areas, and then installing stone (This will be done at their
cost).

Changes to the new kitchen were discussed, but it was decided to leave the kitchen de~ign
unchanged from the original construction documents, except the possible relocation of the hand-
washing sink.

The fire suppression system is currently being installed, The basement and third floors installation
is complete. The first and second floors are currently being worked on, Cutting and patching of
plaster will need to be done during the installation, but both subcontractor and general contractor
have taken care to remove as little historic material as possible.

Heating! Air conditioning duct installation is proceeding nicely. The general contractor and
subcontractor have worked diligently to ròute ducts as unobtrusively as possible and to remove as
little historic building material as possible. Care has been taken to place vents is unobtrusive
locations as well.

The last two replacement radiators (to replace radiators that could not be brought back to working
order) have been located but are longer than they should be, and will require modification, Weare
waiting on estimate from subcontractor. Sandblasting and painting of existing radiators is
expected to begin this week. The architect is proceeding with paint scrapings, to determine the
original color(s), The radiators will be one of the last items installed, as final finishes will need to
be installed behind them,

Remnants of three different wallpapers have been found in the house this last month. Two
different types of wallpaper were found on top of library bookcases. Samples of the wallpaper has
been removed and cleaned. During installation of ducts, the back 'of the main bathroom cabinet
was removed - different wallpaper remained installed on the wall behind. We are hoping these

may be original wallpapers. MHS will be consulting an architectural historian, concerning the age
and time period of samples,

Final draft of the archeology report has been approved. When final report is printed, I will
distribute to DCHS and the City of Hastings.

Insulation and structural stabilization of attic above east wing is complete, Unit heater will be
installed at a later date.

Plaster repair changes to be discussed with subcontractor, and estimate to be complete by February
23rd.

Update on LeDuc House Interpretation Program
Thank you for this opportunity to provide an update on our progress at LeDuc. '
Hastings has been waiting since 1958-ahnost a half-century-for the LeDuc house to open.
There are high expectations and great responsibilities. With your ongoing support, we are
working hard to make Hastings and Dakota County citizens proud of their nationally significant
historic property. This means getting the most out of this valuable resource. In collaboration with
the Friends of LeDuc, our goal is to create "The LeDuc: A History Experience, a Learning
Experience, and a Community Experience."
An effective, engaging, interpretive and educational program brings people back for repeat visits
and provides site financial sustainability. Thanks to our grant from the National Scenic Byways
Program, we have an exceptional planning effort. We're hopeful that a new grant proposal to the
Institute of Museum & Library Services (IMLS), a federal agency, will produce additional
assistance later this year.
Our interpretation plan for the site is threefold: exhibits, guided tours, and "virtual" tours. The
exhibits plan, now entering the second of four phases, will create a compelling visitor experience
using state-of-the-art museum techniques and strategies. The proposal for the Library, for
example, includes an "orientation object theater," with recorded first-person voices reading
original LeDuc letters and diary entries, music and sound effects from the period, and spot-
lighted artifacts. The experience gives visitors an overall sense of the story while transporting
their minds and hearts to a different time and place. The first-person voices give us big events
and intimate moments, making the house feel less foreign and more personal.
The other rooms-Dining Room, Parlor, Kitchen--have different approaches and tell other
stories. The Parlor, which is the largest room, becomes a space for changing exhibits so the
house interpretation is periodically renewed and refreshed. The Dining Room exhibits explore
the architecture and construction of the house itself and follow the story from the LeDuc family
through the Carroll Simmons era. In the Kitchen we hear about the various business ventures of
William LeDuc and the LeDuc women, who created the Hastings Needlework, for example.
More interpretation continues outside the house, in the Carriage Barn, and around the grounds.
When the house opens in 2005 the exhibits will be complemented by guided tours led by trained
interpreters. The IMLS grant is designed to fund the research, planning and training for the
guided-tour program. Like so many things, a tour that looks easy is backed up by a lot of hard

work that the public never sees, so iCs important that our tour program is as thorough and
professional as possible, A winning tour is the best historic house interpretation of all and it
creates goodwill ambassadors who return with family and friends. We all remember our own
experiences with ineffective tour guides, A bad tour experience may send a visitor away forever.
For visitors who have ADA accessibility challenges, or those who can't walk the grounds
because of bad weather, or who want additional LeDuc details, or who cannot travel to the house
at all-for all those visitors we are developing "virtual" tours. The virtual tour plan also is part of
the IMLS grant proposal. The virtual tour uses computer and web technology to bring
information to visitors at an on-site kiosk and through our regular website. New, low-cost,
software and photographic technology allow us to create interactive, 360-degree imagery of all
parts of the house, its rooms, the outbuildings, and the grounds, as well as othe~ Hastings historic
sites. The virtual tour expands our interpretation and education program to anywhere the world
wide web goes.
Using this threefold approach, we will provide the widest possible range of opportunities for
LeDuc visitors to experience and learn about this rich historic place. Quality exhibits and
programs are not cheap and the Friends of LeDuc are embarking on a ambitious fundraising
campaign to build on the limited grants and funds we already have.
We're doing even more as we head toward our 2005 opening. As you know from the Minnesota
Historical Society's update memo, the construction project is moving rapidly now. Because the
LeDuc has never before been restored, interpreted, and open to the public, an entire historic site
operation is being created from scratch. We're pretty busy.
In addition to the exhibit and tour plans, we're working with city staff and consultants to develop
a Landscape Master Plan that will include both the restored historic grounds and modem public
amenities and necessities, such as parking, paths, signage, and utilities. To run the site we'll have
an Operating Plan, with goals, staffing, budgets, and visitation projections. That will be followed
by a first-year annual plan, aimed at a calendar of hours, tours, and events. Because LeDuc must
benefit the wider community, including businesses and organizations, we're also looking at ways
to promote heritage tourism at the LeDuc and throughout "Historic Hastings," as the city water-
tower proclaims. A Fundraising Plan is being developed by Friends of LeDuc as a community-
wide effort to support what today's public understandably expects from a long-anticipated site
like LeDuc.
All together, it's a big job, but it would be hard to find another city with more enthusiasm and
energy for such a project as LeDuc. Our website at www.leduc.house.museum has more
