REQUEST
The City Council is asked to adopt the attached resolution to vacate portions of various
drainage and utility easements platted as part of SCHOOLHOUSE SQUARE 2ND
ADDITION. The easements will no longer be necessary with the recording of
SCHOOLHOUSE SQUARE 3RD ADDITION.
A public hearing was held at the January 2, 2007 City Council Meeting. No one from the
public spoke for or against the item. The City Council ordered the public hearing on
December 18, 2006.
REVIEW
The vacated easements will be re-dedicated as part of Schoolhouse Square 3'd Addition.
The City's consultant engineer has reviewed the proposed vacation against necessary
easements to be dedicated with the recording of Schoolhouse Square 3`d Addition and is
satisfied public easement rights will remain.
Vacation of the easements would be conditioned upon the immediate recording of the Final
Plat of Schoolhouse Square 3~d addition.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HASTINGS
VACATING PORTIONS OF A DRAINAGE AND UTILITY EASEMENT DEDICATED
AS PART OF SCHOOLHOUSE SQUARE 2ND ADDITION, DAKOTA COUNTY,
MINNESOTA

Resolution and moved its adoption:
introduced the following
WHEREAS, Camegaran, LLC has initiated consideration to vacate portions of a
drainage and utility easement dedicated as part of SCHOOLHOUSE SQUARE 2ND
ADDITION on property generally located northeast of 10~h and Vermillion Streets and
approved by the City Council on November 3, 2003.
WHEREAS, Camegaran, LLC has prepared SCHOOLHOUSE SQUARE 3`d
ADDITION that describes the new easements over the property. These easements are
shown on SCHOOLHOUSE SQUARE 3`d ADDITION PLAT.
WHEREAS, a Public Hearing on the proposed vacation was held before the City
Council of the City of Hastings, as required by state law, city charter and city ordinance;
and
WHEREAS, the City of Hastings in all respects proceeded with the vacation hearing
as provided by the Charter, ordinances and applicable Minnesota Statutes.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
HASTINGS AS FOLLOWS:
That the request to vacate said easements as legally described above is hereby
approved subject to the following conditions:
1) The vacation of easement shall not become effective and must not be recorded
unless immediately followed by the recording of SCHOOLHOUSE SQUARE 3RD
ADDITION to ensure continuation of necessary public easements.
Council member moved a second to this resolution and
upon being put to a vote it was unanimously adopted by all Council Members present.
Adopted by the Hastings City Council on February 5, 2007 by the following vote:
