Second Addition
REQUEST
Twin Cities Habitat for Humanity seeks final plat approval to divide an existing lot into four
single family lots and one outlot.
The site is generally located at 13XX North Frontage Road and consists of 1.62 acres.
The property on which the project is proposed is currently owned by the City of Hastings and
is considered excess as it is not needed by the City. As a condition of the Final Plat, Habitat
for Humanity will enter into a development agreement that will transfer property rights into
their name.
The Final Plat is consistent with Preliminary Plat approval granted November 20, 2006.
RECOMMENDATION
On December 11, 2006, the Planning Commission voted (7-0) to approve the Final Plat
for Pleasant Acres 2"d Addition. Please see attached minutes for further information.

BACKGROUND INFORMATION
In August 2002, the City Council approved of the Final Plat for Pleasant Acres 1S'
Addition. This Final Plat resulted in a subdivision of an existing lot into seven lots and an
outlot between Pleasant Drive and North Frontage Road. Seven single family homes
have since been built on the 1.44 acres in the subdivision.
Twin Cities Habitat for Humanity is proposing a similar development to Pleasant Acres 1 S`
Addition. The proposal is for four single-family homes each with 1,440 square feet.
On November 20, 2006, the City Council approved the Rezone, Comprehensive Plan
Amendment, and Preliminary Plat for Pleasant Acres 2"d Addition.
Zoning
The site was recently rezoned from C-1 General Commerce to R-3 Medium High Density
Residence. Thus, the zoning is consistent with the proposed use.
Comprehensive Plan Classification
The 2020 Comprehensive Plan designates the property as C-Commercial. The proposed use
is not consistent with the plan as the proposed use is U-Ilt, Urban Residential with 9+ units
per acre. A Comprehensive Plan Amendment was granted by the Metropolitan Council after
approval by the City Council.

The existing site is vacant and open. Topography slopes down from a high point at the south
side of the property continuing to the existing homes on the west.

FINAL PLAT REVIEW
The applicant proposes to subdivide Lot 2, Block 1, Hastings Family Housing. This
subdivision would be known as Pleasant Acres Second Addition and consist offour lots and 1
outlot in 1.62 acres.
Twin Cities Habitat for Humanity is proposing a similar development to Pleasant Acres 1S`
Addition. The proposal is for four single-family homes each with 1,440 square feet.
Access and Circulation
No new public or private streets are proposed. Access to the site will be provided from North
Frontage Road. A private road currently exists off North Frontage Road with each home
having access to this private drive.
As a condition of the Final Plat, Twin Cities Habitat for Humanity will be responsible for the
maintenance of their portion of this road. This includes snow maintenance in the winter.
Also as a condition of the Final Plat, there shall be no parking anywhere on the road.
Grading, Drainage, Erosion Control, and Utility Plan
The City's consultant engineer has conducted an initial civil plan review.
The applicant must obtain formal approval of the Grading and Utility Plans by the Public
Works Director as a condition for approval.
Park Land Dedication
As a condition of the Preliminary Plat ,the City Council voted to waive the requirements of the
park land dedication.
Sewer Interceptor Fee
As a condition of the Preliminary Plat, the City Council voted to waive the sewer interceptor
fees.
Zoning Setbacks
Zoning setbacks are acceptable. Setbacks in the R-3 Medium High Density Planned
Residential Development District are not specified. The following setbacks are proposed:

The proposed zoning setbacks are similar to other R-3 PRD setbacks in the vicinity.
Pedestrian Access
A concrete sidewalk will be required on the private street. An existing concrete sidewalk is
located on North Frontage Road and will remain.
Landscape Plan
Per the City of Hastings Subdivision Regulation Ordinance, trees are required to be planted
every 50 linear feet of street frontage in a subdivision. Further, one front yard tree is required
per home. The landscaping plan for Pleasant Acres 2nd Addition meets these requirements.
Signage
Signage has not been indicated on the site plan and will be administratively permitted under a
separate sign permit application. Although sign permit review will take place after site plan
approval, the monument sign is limited to 50 square feet in size and must be no greater than
6 feet high.

Regular Meeting
7:00 p.m.
Chairman Twedt called the meeting to order at 7:00 p.m.
1. Roll Call
Commissioners Present: Hiedeman, McInnis, Peine, Truax, Twedt, Schmitt, Zeyen
Staff Present: Planning Director John Hinzman, Associate Planner Kari Barker
2. Approve November, 2006 Planning Commission Meeting Minutes
Commissioner Truax requested two changes to the Meeting Minutes. The first change is found
on page three, the third from last pazagraph. The word "concern" replaces the word
"appreciation." The second change is found on page 5 in the paragraph following the staff
recommendations. The word "with" replaces "without" in the last sentence of the pazagraph
Motion by Commissioner Truax to approve the minutes of the November 13, 2006,
Planning Commission meeting with the aforementioned changes, seconded by
Commissioner McInnis.
Upon vote taken, Ayes: 7, Nays 0. Motion passed.
Public Hearings
3. City of Hastings -City Code Amendment #2006-59 -Accessory Structure
Ordinance relating to carports.
Associate Planner Kari Barker gave a staffreport.
Chair Twedt opened and closed the public hearing at 7:09.
Commissioner Heideman asked how portable carports would be defined. Planning
Director Hinzman stated that a portable carport would be open on all four sides with a
roof, but would not have a foundation.
Commissioner Schmitt clarified the defmition by asking if portable carports would not be
attached. Planning Director Hinzman stated they would not as portable carports would be
open on all four sides. He further stated that of all the examples shown during the staff
report, only one would meet the new code.

Commissioner Truax referenced a photo of a carport. He asked if the carport would be in
compliance if it had a roof and solid walls. Planning Director Hinzman stated it would be
in compliance of the carport ordinance.
Commissioner Schmitt stated that he thought the definition was sufficient. He expressed
concern over the regulation of seasonal satellite buildings to cover rv's and Easy-Up's.
Commissioner Schmitt wanted to know how long the Easy-Up's could be up, if used for
graduation or other events.
Chair Twedt inquired if the enforcement was being driven by neighbors reporting
violators, thus driving the enforcement. Planning Director Hinzman stated that this was
the most likely case.
Chair Twedt stated he was unsure if the Easy-Up's should be restricted. Planning
Director Hinzman stated that language could be added to the ordinance to allow Easy-
Up's for a temporary time period. Commissioner Schmitt stated it would be better to
define the parameters, versus exclude them.
Commissioner Peine stated that he was glad to see something in regards to anchoring for
wind loads. He inquired how this would be verified. Planning Director Hinzman stated
that the Building Department was still contemplating specific requirements.
Commissioner McInnis asked if colors should be restricted. Associate Planner Barker
stated that this was covered in Letter G.
Commissioner McInnis stated that existing portable carports should be taken case by case
to bring them up to code.
No motion was needed as the ordinance will be modified and another public hearing held
at the January 8, 2007, Planning Commission meeting.
OTHER ACTIONS
4. Habitat for Humanity -Final Plat #2006-45 -Pleasant Acres 2"d Addition -North
Frontage Road.

Commissioner Truax inquired about the Grading Plans for Pleasant Acres 2"d Addition
and if the retaining wall would match the first one. Planning Director Hinzman stated
that this had been discussed; however the grade is about 4 or 5 feet. Thus, the drop off is
not as abrupt.
Commissioner Truax inquired if it would be possible to tie Pleasant Acres 1~` and 2"d

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCII. OF THE CITY OF HASTINGS
APPROVING FINAL PLAT APPROVALFOR PLEASANT ACRES Z"D ADDITION
Council member introduced the following Resolution and
moved its adoption:
WHEREAS, Habitat for Humanity has petitioned for Final Plat approval of Fleasant Acres
god Addition, a 4 bt t+esidential subdivision, legally described as Lot 2, Block 1 of Hastings Family
Housing, and one outlot; and
WHEREAS the Planning Commission recommended approval of the request to the City
Council; and
WHEREAS the City Council has reviewed the request and concurs withthe recommendation
of the Planning Commission.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF HASTINGS AS FOLLOWS:
That the City Council hereby approves the Final Plat as presented to the City Council subject to the
following conditions:
1 • Conformance with the Plans submitted with the City Council staffreport of Febn~ary 5, 2007.
2. Final approval of the development grading and utility Plans by the City of Hastings
Engineering Consultant. The applicant shall be liable for any costs involved in consultant
review of the plans.
3. All disturbed areas on this property shall be stabilized with rooting vegetative cover to
eliminate erosion problems.
4. The disturbed azeas of the site shall be maintained to the requirements of the City's property
maintenance ordinance.
5. Submission of an electronic copy of all plan sets (TIF, PDF, or similar format) prior to
issuance of certificate of occupancy.
6. Approval is subject to a one year Sunset Clause. If significant progress is not made towards
construction of the proposal within one year of City Council approval, the approval is null and
void.
7. Twin Cities Habitat for Humanity will be responsible for the maintenance on their portion of
the Dakota CDA access road. This includes snow maintenance in the winter.
8. Parking shall be prohibited on the Dakota CDA access road.
9. Retaining walls and fencing must match material of Pleasant Acres 1 ~` Addition.
10. The applicant must provide proof of access rights to the private Dakota CDA access road.
11. The park land dedication fees shall be waived.
12. The sewer interceptor fees shall be waived.
13. As a condition of the Final Plat, Habitat for Humanity will enter into a development
agreement that will transfer property rights into their name.
Council member moved a second to this resolution and upon
being put to a vote it was unanimously adopted by all Council Members present.
