Subject: Hold Public Hearing- Vacation of Right-of--Way #2007-06- 100
N. River Street
REQUEST
The City Council is asked to hold a public hearing to vacate a portion of the
unimproved First Street right-of--way generally located east of River Street and
west of Grove Street adjacent to 100 River Street. All properties abutting the
proposed vacation are owned by Tecla Karpen. Please see attached location
map for further details.
Ms. Karpen seeks vacation in order to eliminate the separation between her
properties and to establish a Conservation Easement with Dakota County
Farmland and Natural Area Program.
REVIEW
The proposed area does not contain any roadway or city infrastructure. There
does not appear to be a future public need for the right-of-way.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HASTINGS
VACATING THE FIRST STREET RIGHT-OF-WAY GENERALLY LOCATED
BETWEEN RIVER AND GROVE STREETS, DAKOTA COUNTY, MINNESOTA.

Resolution and moved its adoption:
introduced the following
WHEREAS, Tecla Karpen has initiated consideration to vacate certain easements
within SECTION 21, TOWNSHIP 115, RANGE 17, legally described as follows:
The first street right-of--way located between Grove Street and River Street,
directly north of Block 2, Addition No. 13, Dakota County, Minnesota,
WHEREAS, a Public Hearing on the proposed vacation was held before the City
Council of the City of Hastings, as required by state law, city charter and city ordinance;
and
WHEREAS, the City of Hastings in all respects proceeded with the vacation hearing
as provided by the Charter, ordinances and applicable Minnesota Statutes.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
HASTINGS AS FOLLOWS:
That the request to vacate said easements as legally described above is hereby
approved subject to the following conditions:
1) The vacation of easement shall not become effective until recorded with Dakota
County.
2) A public drainage and utility easement shall be established over the vacated right-
of-way.
8E IT FURTHER RESOLVED, that a copy of this resolution shall be filed with the
Dakota County Recorder's Office by the Hastings City Clerk.
Council member moved a second to this resolution and
upon being put to a vote it was unanimously adopted by all Council Members present.
