MEMORANDUM
TO: Honorable Mayor and City Councilmembers
FROM: Dave Osberg, City Administrator
DATE: March I, 2007
SUBJECT: I" Reading and Schedule Public Hearing Regarding Ordinance
Amendments Relating to the Method of Adjusting Residential Solid Waste
Collection and Recycling Rates
RECOMMENDED CITY COUNCIL ACTION
It is recommended that the City Council take action approving the 1 S` reading and
scheduling public hearings regarding the Ordinance amendments relating to the methods
of adjusting residential solid waste collection and recycling rates.
BACKGROUND
At the City Council meeting on Monday February 5, 2007 the City Council approved
four actions regarding the residential solid waste collection license request for proposal
process, including directing: "City Staff to prepare the necessary Ordinance amendments
for City Council consideration at a future meeting, that properly reflect the method for
implementing residential solid waste collection rate adjustments, based on a consumer
price index and fuel clause adjustment factor." The February 5, 2007 City Council
meeting also included action that resulted in Waste Management being awarded the
residential solid waste collection license.
The Utility Committee of the City Council had reviewed each of the proposals submitted,
and in particular reviewed closely those submitted by Violia and Waste Management.
Each company had included in its proposal documents, provisions for a rate adjustment
that would be based on a fuel clause adjustment and a consumer price index adjustment.
Current Ordinance does not allow a rate adjustment in the first year of a license, with
future adjustments approved by the City Council. As the City Council will note, the
ordinance amendments essentially state that rate adjustments shall be incorporated in the
written agreement between the City and ]icensed hauler (Waste Management). Thus,
should fuel prices reach certain levels (both increases and decreases) the rates will adjust
accordingly.
It is fair to conclude there may be an annual adjustment based on the CPI. All of this
will be clearly spelled out in the proposed agreement between the City of Hastings and
Waste Management, which is scheduled for presentation to the full City Council for
consideration at the meeting on Apri12, 2007; coinciding with the public hearing and second
reading of~e attached ordinances.

H. The city shall establish the rates for residential solid waste
collection. The council shall establish the rates by written
agreement with the licensed hauler. Such rates may
include an automatic price increase or fuel surcharge when
based on an ascertainable standard described in the written
agreement. A residential hauler cannot request a rate
adjustment during the first year of a residential hauler's
license.

MARCH SESQUICENTENNIAL EVENT:
Please note change in time!
March 19, 2007, 6:15 p.m. prior to the City Council start time.
Celebrating the incorporation of the City of Hastings in 1857 and its
election as County Seat, we will be packing a time capsule. This time
capsule will be placed in the new north entrance* to City Hall which
will be installed later this summer. Coffee, cake and apple cider will
be served.
*This "new" north entrance will actually be a renovation to make the
entrance look more like the original entrance when the building was
built in 1869-71. The current appearance of the north entrance is
from the 1912 renovation.
NOTE: If you have suggestions on what to include in the time
capsule, please feel free to call the Pioneer Room (480-2367) and
leave a message. The Hastings Star Gazette has agreed to publish a
story on the time capsule asking our citizens for their suggestions.
