HomeMy WebLinkAbout20070305 - VI-10VI-10 Memo To: Mayor Hicks and City Council From: John Hinzman, Planning Director Date: March 5, 2007 Subject: Resolution Correction: Final Plat Approval - #2006-53 -Twin Cities Habitat for Humanity-13XX North Frontage Road-Block 1, Lots 1, 2, 3, and 4, Pleasant Acres Second Addition REQUEST The City Council is asked to approve the attached corrected resolution approving the Final Plat of Pleasant Acres 2"d Addition. Staff agreed to incorporate the changes on behalf of Habitat for Humanity prior to the February 5, 2007 meeting; however an older version of the resolution was included in the Council Packet. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HASTINGS MODIFYING AND REPLACING RESOLUTION NO. 02-03-07 GRANTING FINAL PLAT APPROVAL FOR PLEASANT ACRES 2"d ADDITION Council member moved its adoption: introduced the following Resolution and WHEREAS, Habitat for Humanity has petitioned for Final Plat approval of Pleasant Acres 2°a Addition, a 4 lot residential subdivision, legally described as Lot 2, Block 1 of Hastings Family Housing, and one outlot and WHEREAS, the Planning Commission recommended approval of the request to the City Council; and. WHEREAS the City Council adopted Resolution No. 02-03-07 approving the Final Plat request subject to 13 conditions of approval; and WHEREAS an incorrect version of the said resolution was adopted by the City Council. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HASTINGS AS FOLLOWS: The City Council hereby modifies and replaces Resolution No. 02-03-07 granting Final Plat approval with this resolution subject to the following conditions: I. Conformance with the plans submitted with the City Council staff report of February 5, 2007. 2. Final approval of the development grading and utility plans by the City of Hastings Engineering Consultant. The applicant shall be liable for any costs involved in consultant review of the plans. 3. All disturbed areas on this property shall be stabilized with rooting vegetative cover to eliminate erosion problems. 4. The disturbed areas of the site shall be maintained to the requirements of the City s property maintenance ordinance. 5. Submission of an electronic copy of al( plan sets (TIF, PDF, or similar format) prior to issuance of certificate of occupancy. 6. Approval is subject to a one year Sunset Clause. If significant progress is not made towards construction of the proposal within one year of City Council approval, the approval is null and void. 7. Execution of an agreement between Twin Cities Habitat for Humanity and Dakota CDA outlining responsibilities for maintenance along the private access road east of Lots l -4. 8. Parking shall be prohibited along the private access road east of Lots 1-4 unless the roadway is expanded to accommodate vehicle parking. 9. Retaining walls and fencing must match material of Pleasant Acres Is` Addition. 10. The applicant must provide proof of access rights to the private Dakota CDA access road. l 1. The park land and dedication fees shall be waived. 12. The sewer interceptor fees shall be waived. 13. As a condition of the Final Plat, Habitat for Humanity will enter into a development agreement that will transfer property rights into their name.
