REQUEST
Robert Abdo seeks to extend the approvals for the following actions related to Three Rivers
Place, located on Block 2, Town of Hastings:
1) Preliminary Plat Approval -Three Rivers Place (City Council Resolution 04-13-05)
2) Special Use Permit Approval -Impervious Surface Coverage (City Council
Resolution No. 04-14-05)
3) Special Use Permit -1St Floor Residential Use (City Council Resolution No. 05-05-
05)
4) Site Plan Approval - 49 Unit Condo Building (City Council Resolution No. 05-06-05)
5) Final Plat Approval -Three Rivers Place (City Council Resolution No. 10-04-05)
All approvals would be extended to July 31, 2008
RECOMMENDATION
The Planning Committee of the City Council considered the request at the March 26, 2007
meeting and recommended the extension as presented.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HASTINGS
AMENDING CITY COUNCIL RESOLUTION NOS. 04-13-05, 04-14-05, OS-OS-OS, 05-06-
05, AND 10-04-OS EXTENDING THE DEVELOPMENT APPROVALS RELATING TO
THREE RIVERS PLACE, A ONE LOT, SUBDIVISION CONTAINING 49
RESIDENTIAL UNITS LOCATED ON BLOCK 2, TOWN OF HASTINGS, DAKOTA
COUNTY, MINNESOTA.

introduced the following Resolution and
WHEREAS, The City Council of the City of Hastings previously adopted Resolution Nos.
04-13-05, 04-14-05, OS-OS-OS, OS-06-O5, and 10-04-OS granting preliminary plat, special use permit
for impervious surface, special use permit allowing first floor residential use, site plan approval, and
final plat approval, respectively for Three Rives Place, a one lot subdivision containing 49 residential
units legally described as the North Half of Block 2, TOWN OF HASTINGS, Dakota County,
Minnesota; and
WHEREAS, City Council Resolution Nos. 04-13-05, 04-14-05, OS-OS-OS, OS-06-O5, and
10-04-OS were subject to certain conditions of approval including a sunset clause requiring
"significant progress" towards completion within two years of City Council approval; and
WHEREAS, Robert Abdo, owner of the property seeks an extension to the city approvals to
allow for future construction.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF HASTINGS AS FOLLOWS:
That the City Council hereby modifies Resolution Nos. 04-13-05, 04-14-05, OS-OS-OS, OS-06-O5, and
10-04-OS as follows:
1) Approval is subject to a sunset clause. Approval is null and void if significant work has not
commenced by July 31, 2008.
NOW THEREFORE BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HASTINGS AS FOLLOWS:
1) All other conditions of Resolution Nos. 04-13-05, 04-14-05, OS-OS-OS, OS-06-O5, and 10-04-
05 shall remain in effect.
Council member moved a second to this resolution and upon being put to a
vote adopted by present.
