SUBJECT: Public Hearing and 2"" Reading: Ordinance Amendment Relating
to the Method of Adjusting Residential Solid Waste Collection and
Recycling Rates
RECOMMENDED CITY COUNCIL ACTION
It is recommended that the City Council take action approving the 2"d Reading, after
completion of the Public Hearing, of an Ordinance amendment relating to the method of
adjusting residential solid waste collection and recycling rates.
BACKGROUND
At the City Council meeting on Monday February 5, 2007 the City Council approved
four actions regarding the residential solid waste collection license request for proposal
process, including directing: "City Staff to prepare the necessary Ordinance amendments
for City Council consideration at a future meeting, that properly reflect the method for
implementing residential solid waste collection rate adjustments, based on a consumer
price index and fuel clause adjustment factor." The February 5, 2007 City Council
meeting also included action that resulted in Waste Management being awarded the
residential solid waste and recycling collection license. The ls` Reading of the Ordinance
amendment was approved by the City Council at the meeting conducted on March 5,
2007.
Current ordinance does not allow a rate adjustment the first year of the license, with
future adjustments approved by the City Council. As the City Council will note, the
ordinance amendment essentially states that rate adjustment provisions will be
incorporated in the written agreement between the City and the licensed hauler (Waste
Management). Thus, should fuel prices reach certain levels, both increases and decreases,
the rates will adjust accordingly. Furthermore, there may also be an annual adjustment
based on the CPI.
Staff rec~nmends approval of the 2"d Reading of the attached Ordinance Amendment.

PUBLIC HEARING NOTICE
Notice is hereby given that the Hastings City Council will conduct a public
hearing on Monday Apri12, 2007 at 7:00 PM in the Council Chambers at the Hastings
City Hall, 101 East 4`h Street for purposes of hearing public comment on a proposed
ordinance changing the City Code relating to the method in which adjustments maybe
made to the rates charged for residential recycling service and residential solid waste
collection. All persons who wish to offer public comment on the proposed ordinance will
be given an opportunity to do so at the public hearing.

H. The city shall establish the rates for residential solid waste
collection. The council shall establish the rates by written
agreement with the licensed hauler. Such rates may
include an automatic price increase or fuel surcharge when
based on an ascertainable standard described in the written
agreement. A residential hauler cannot request a rate
adjustment during the first year of a residential hauler's
license.

Section 5.44 RECYCLING HAULERS
Subd. 2. Licensed Required. It is unlawful for any person to pick
up recyclable materials from residences or commercial buildings without a
license from the city. There shall be issued by the city one residential
recycling license until such time as the council determines, by ordinance
approved by a 2/3 majority of the entire city council, that additional
residential recycling licenses are necessary. The holder of a residential
recycling license shall be able to collect recyclable material from residential
or commercial buildings as part of an authorized recycling program.
Application shall be made in the same manner as required by ordinance for a
garbage and refuse hauler in the city.
