HomeMy WebLinkAbout20070416 - Minutes 20070402Hastings, Minnesota City Council Minutes April 2, 2007 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, April 2, 2007 at 7:00 PM in the Council Chambers at the Hastings City Hall, 101 East 4`n Street, Hastings, Minnesota. Members Present: Mayor Hicks, City Councilmembers Alongi,Hazlet, Hollenbeck, Schultz, Slavik, and Riveness Staff Present: City Administrator Dave Osberg Assistant City Administrator Melanie Mesko Lee City Attorney Shawn Moynihan Planning Director John Hinzman Associate Planner Kari Barker HRA Director John Grossman Approval of Minutes: Mayor Hicks asked if there were any corrections to the minutes of the regular meeting of March 19, 2007. There was a correction on one of the votes. Hearing no other changes, the minutes were approved as amended. Consent Agenda Moved by Councilmember Riveness, seconded by Councilmember Hazlet to approve the Consent Agenda as presented. 1. Pay Bills as Audited 2. Public Hearing -Vacation of Easement #2007-13: Freitag Property Planning Director Hinzman provided a brief overview of the proposed easement, which staff recommends approving. Resolution-Vacation of Easement #2007-13: Freitag Property Moved by Councilmember Riveness, seconded by Councilmember Slavik to approve the resolution as presented. 7 Ayes, Nays, None. Public Hearing-Ordinance Amending City Code Relating to the Method in Which Adjustments may be made to Rates Charged for Residential Recycling Service and Residential Solid Waste Collection City Administrator Osberg stated that the proposed change allows for rate adjustment provisions to be incorporated into the written agreement between the City and Waste Management. Should fuel prices reach certain levels, both increases and decreases, rates will be adjusted accordingly. Furthermore, there may also be an annual adjustment based on the CPI. Mayor Hicks opened the public hearing at 7:06 pm. Hearing no comments, Mayor Hicks closed the public hearing at 7:06 pm. Authorize Signature-Development Agreement #2007-9: Crossroads Center East Planning Director Hinzman requested no action on this item at this time, as the development agreement was not quite finalized. risk and to be removed. Mr. Simmons requested consideration for waiving Resolution-Approve Development Extension: #2005-07: Three Rivers Place Planning Director Hinzman stated that the developer is seeking to extend the approval for the Preliminary Plat; SUP-Impervious Surface Coverage; SUP-151 Floor Residential Use; Site Plan-49 Unit Condo Building; and Final Plat approval until July 31, 2008. All conditions of the approvals would remain in place. Councilmember Alongi stated that he supports the extension following discussion with the developer and based on the fact that this is a private development proposal. Moved by Councilmember Alongi, seconded by Councilmember Slavik to approve as presented. 7 Ayes, Nays, none. Copy of resolution on file. Recommendation from Planning Committee regarding Downtown Redevelopment Project HRA Director Grossman stated that the Planning Committee of the Council met with the Loren Bruggemann of Sherman Associates on March 26 to discuss the existing market and financial feasibility of the condominium and townhouse proposals for Block 1. The Committee recommended that staff clarify the public and private costs under the terms of the agreement, and prepare language to terminate the agreement for consideration by the City Council and HRA in May, 2007; and that the council and HRA take time to review downtown redevelopment issues and goals and not consider new proposals during that time. Grossman also noted that Sherman Associates has also requested being granted redevelopment rights to the downtown areas determined to be redeveloped following the downtown review. Councilmember Alongi stated that this review is different because the area to be redeveloped is publicly owned. He also stated that this property has unique City of Hastings City Council Minutes April 2, 2007 Page 3 of 4 _ characteristics, including proximity to the rail. Alongi stated that circumstances may have changed as far as what will make downtown work and he felt no compelling reason to give any developer a head start in the process. Alongi stated that he respected Sherman's participation in the process. Councilmember Schultz stated that the goals for open space were not realized with this development and the city will need to reevaluate those needs. Councilmember Hollenbeck stated that this is an opportunity to step back and reevaluate the needs for downtown. Councilmember Slavik asked what the HRA felt about the committee's recommendation. Grossman stated that it is a consistent recommendation. Slavik stated that this is an opportunity examine the entire use of the riverfront, including issues related to the Red Rock Corridor and a new bridge. Councilmember Riveness stated the sometimes projects are extended too far in the excitement of redevelopment. Mayor Hicks stated that this illustrates that redevelopment is hard and he supports a review of the goals for the downtown. Hicks also stated that the council has held up to its commitments regarding this project, including developer approvals, TIF, etc. Hicks encouraged other developers to look at the downtown for redevelopment options. He also stated that Sherman is a good developer; it just didn't work out at this time. Moved by Councilmember Riveness, seconded by Councilmember Alongi to approve the committee's recommendations as presented, and to deny Sherman's request for redevelopment rights. 7 Ayes; Nays, none. Second Reading-Ordinance Amending City Code Relating to the Method in Which Adjustments may be made to Rates Charged for Residential Recycling Service and Residential Solid Waste Collection Moved by Councilmember Schultz, seconded by Councilmember Hazlet to approve the ordinance as presented 7 Ayes; Nays, none. Copy of ordinance on file. Approval of Agreement with Waste Management for residential Solid Waste and Residential Recycling Collection City Administrator Osberg stated that the agreement will include, in addition to other items, a method for calculating rate adjustments, based on a fuel clause adjustment and consumer price index. Osberg stated that fuel costs may increase or decrease, based on the actual cost of fuel, throughout the year. CPI adjustments will be reviewed annually. Moved by Councilmember Hazlet, seconded by Councilmember Riveness to approve the agreement, with the understanding that associated attachments will be included in the final agreement with Waste Management. 7 Ayes; Nays, none. Reports from Council Councilmember Alongi noted that the Comprehensive Plan committee has been meeting and the public is encouraged to become involved. Mayor Hicks announced upcoming Sesquicentennial Events, including the Generations of Brides event at the LeDuc Estate on April 14, and the wedding gowns on display at City Hall.
