VIII-B-1 Preliminary and Final Ptat, Site Plan Approval - Riverwood 9th Addition -Siewert Construction City Council Memo -May 7, 2007 Page 1 Memo To: Mayor Hicks and City Council Members From: Kari Barker, Associate Planner Date: May 7, 2007 Subject: Preliminary and Final Plat, Site Plan Approval #2007-11 -Riverwood 9th Addition - South Pointe Drive -Siewert Construction REQUEST Siewert Construction seeks the following: 1) Preliminary and Final Plat approval to replat Outlots B, C, and D, Riverwood 8th Addition to three outlots, forming Riverwood 9th Addition. There will be 461ots with 41 units. The remaining three lots will be commonly owned by the association. Two outlots will be created for future development. 2) Site plan approval to construct 3 three-unit townhome buildings and one four-unit townhome building. Site plan approval is not needed for the 14 two-unit townhome buildings. The site is generally located offSouth Pointe Drive between 31~` and 36t'' Streets West. UPDATED INFORMATION At the April 16, 2007, City Council meeting, the developer inquired about the Park Land Dedication fees proposed for the development. Upon further research, staff determined that the proposed fees were incorrect. When Riverwood 4th Addition was preliminary platted, one of the conditions was that 8 acres of land for a park be dedicated, and the developer and the City decide the amount of cash required at a later date. The Council meeting minutes of the June 5, 1989, reflect the approval of a cash-in-lieu figure set at 34% of the current park dedication fees. It was rationalized that the 8-acre park satisfied 66% of the overall required park dedication, and therefore, the remaining dedication would be paid at a rate of $612 per unit, which is 34% of $1,800.00. Existing Condition The site is predominately flat and open. The property gradually slopes upward to the north. An intermittent stream flows along the eastern extent of the property. Mature trees provide a buffer between the single family homes and the townhomes. Crrading work began in the spring of 2003. The City performed work on street and utility construction in 2003 and 2004. The developer performed work on street and utility construction in 2004 and 2005. History In the 1980's, Development Plans were reviewed and approved for the Riverwood Development. The plans for Riverwood 9~' Addition are generally consistent with these plans. The density of the proposed units has decreased from its original platting as part of Riverwood 7`~ Addition. The townhome units were originally platted to be mainly four-unit buildings. The townhor~s are now mainly two-units with one four-unit building. In April 1998, a Special Use Permit was granted to allow grading and residential development in a General Flood Plain District as part of Riverwood 7~' Addition. The azea of the grading and residential development in Riverwood 9`n Addition appears to be within the bounds of the Special Use Permit. A letter from the engineer of record will be required certifying that the grading work of Riverwood 9`n Addition does not encroach into the Floodplain beyond the approved limits established in the 1998 Special Use Permit. PRELIMINARY AND FINAL PLAT REVIEW Request Sievert Construction requests preliminary and final plat review for Riverwood 9"' Addition. Riverwood 9`n Addition would be formed by dividing Outlots B, C, and D in Riverwood 8`n Addition to three outlots. Streets South Pointe Drive will extend north and south from the existing Riverwood Drive, connecting with the existing South Pointe Drive, south of Woodland Drive to 36`n Street. All access drives will be publicly owned and maintained. Per the Public Works director, surmountable curb is acceptable in the development. Preliminary and Final Plat, Site Plan Approval - Riverwood 9"' Addition - Sievert Construction City Council Memo -May 7, 2007 Vehicular Access and Circulation Access and circulation will be further reviewed as a part of Site Plan approval. Pedestrian Access Pedestrian access will be further reviewed as a part of Site Plan approval. Grading, Drainage, Erosion Control, and Utility Plan The City's consultant engineer has reviewed the Grading, Drainage, Erosion Control, and Utility Plans. Approval of the Preliminary and Final Plat is subject to approval of the Grading, Drainage, Erosion Control and Utility Plans by the Public Works Director, and reimbursement for any fees involved in plan review. Interceptor Sewer Fee Sewer interceptor fees shall be paid as follows: 1) Sewer interceptor fees in the amount of $15,785 (41 units x $385 per unit) shall be paid prior to recording of the Final Plat. Public Laud Based on the prior agreement between the applicant and the City Council, the applicant needs to only pay $561.00 per 2-unit building and $374.00 per 3-unit unit, which is 34% of the amount normally required. The per unit fee for 2-unit buildings is normally $1650/unit and for 3-unit buildings is $1,100. The park land dedication fees are calculated as follows: Residential Development Fees # of type of unit Total $561/unit for 2 unit building 28 $15,708 $374/unit for 3 or more unit buildings 13 $4,862 Public Land is acceptable subject to the following: 1) Park land dedication fees in the amount of $20,570.00 shall be paid prior to the recording of the Final Plat. 2) Boulevard trees must be planted within the right-of--way. Pedestrian Access A trail must be constructed along South Pointe Drive between Riverwood Drive and the existing trail stub east of South Pointe Drive, as approved by the Public Works Director. _. SITE PLAN REVIEW Zoning Setbacks Setbacks aze determined at Site Plan Review. Proposed setbacks are acceptable and consistent with other homes in the area. Vehicular Access and Circulation South Pointe Drive will be fully extended to create improved circulation. Pedestrian Access The dead end trail connection between West 31~` Street and South Point Drive will be required to be connected as part of Site Plan Approval. Parking _ Parking is acceptable. All units would have a two stall gazage, plus a driveway capable of parking two additional vehicles. Architectural Elevations There are three elevations of the townhome units; each would house 2, 3, or 4, one story units. The building incorporates varying roof lines with heel trusses and extended overhangs to match the facade. Vinyl lap siding, vinyl shakes and stone would be used on all buildings. The architectural elevations are acceptable. Landscape Plan A landscape plan has been submitted and approved for Riverwood 9`h Addition. The plan provides a mixture of deciduous shade trees along the front of each unit, interspersed with a variety of shrubs and flowing plants surrounding each unit and boulevard trees along the streets. The landscape plan is acceptable subject to the following: 1) Any uncompleted site work (including landscaping) must be escrowed for at 125 percent of estimated valuation prior to issuance of a certificate of occupancy. 2) All landscaped areas must be irrigated. Preliminary and Final Plat, Site Plan Approval - Riverwood 9~' Addition - Sievert Construction City Council Memo- May 7, 2007 Page 6 Signage Signage has not been indicated on the site plan and will be administratively permitted under a separate sign permit application. Although sign permit review will take place after site plan approval, the following regulations are applicable: The monument sign is limited to 50 square feet in size and must be no greater than 5 feet high. Grading and Utility Plans Preliminary Grading and Utility Plans have been submitted for cursory review. The applicant must obtain formal approval of the Grading and Utility Plans by the Public Works Duector as a condition for approval. HASTINGS CITY COUNCIL RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HASTINGS GRANTING PRELIMINARY AND FINAL PLAT APPROVAL FOR RIVERWOOD 9m ADDITION Council member moved its adoption: introduced the following Resolution and WHEREAS, Siewert Construction has petitioned for Preliminary and Final Plat approval of Riverwood 9~' Addition, a townhome unit development consisting of 46 lots with 41 units, two outlots for future development, and three lots will be commonly owned by the association. The property is generally located between 31 ~` and 36~' Streets West legally descnbed as Outlots B, C, and D, Riverwood 8"' Addition; and WHEREAS, on March 26, 2007, review was conducted before the Planning Commission of the City of Hastings, as required by state law, city charter, and city ordinance; and WHEREAS, The Planning Commission recommended approval subject to the conditions of this resolution; and WHEREAS, The City Council has reviewed the request and recorrnnendation ofthe Planning Commission. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCH. OF THE CITY OF HASTINGS AS FOLLOWS: That the City Council hereby approves the Preliminary and Final Plat as presented subject to the following conditions: Conformance with the plans submitted with the City Council StaffReport dated May 7, 2007. 2. All disturbed areas on this property shall be stabilized with rooting vegetative cover to eliminate erosion problems. 3. Final approval ofthe grading, drainage and utility plans by the Public Works Director, and reimbursement for any fees involved in plan review. The owner assumes all risks associated with the grading and utility placement prior to formal approvals. 4. Approval is subject to a one year Sunset Clause; if significant progress is not made towards construction of the proposal within one year of City Council approval, the approval is null and void. 5. Sewer interceptor fees in the amount of $15,785 (41 units x $385 per unit} shall be paid prior to recording of the Final Plat. 6. Park Land Dedication Fees in the amount of $20,570.00 shall be paid prior to the recording of the Final Plat. 7. The proposed South Point Drive must be renamed to South Pointe Drive. 8. A trail must be constructed along South Pointe Drive between Riverwood Drive and the existing trail stub east of South Pointe Drive, as approved by the Public Works Director. 9. Boulevard trees must be planted within the right-of--way. 10. Submittal of a letter from the engineer of record certifying that the grading work of Riverwood 9`~ Addition does not encroach into the Floodplain beyond the approved limits established in the 1998 Special Use Permit. The letter must be submitted prior to recording of the plat. 11. That the developer shall have separate water meter and water line installed for all irrigation systems. 12. Execution of a development agreement to memorialize the conditions of the plat and to establish any applicable escrow amounts to guarantee the completion of site plan activities prior to issuance of any building permits. 13. Any uncompleted site work (including landscaping) must be escrowed for at 125 percent of estimated valuation prior to issuance of a certificate of occupancy. 14. The Final Plat must be submitted for recording with Dakota County within on year of City Council approval, or the approval is null and void. 15. Future construction of homes along the South Pointe Drive may also require additional FEMA review and approvals including a Conditional Letter of Map Revision (CLOMR) prior to building construction. 16. Driveways shall be constructed as depicted on the civil plans to include driveway separation. 17. Surmountable curbs shall be allowed on the streets in the development. 18. Approval is subject to a one year Sunset Clause. If significant progress is not made towards construction of the proposal within one yeaz of City Council approval, the approval is null and void. 19. A declaration of covenants, conditions and restrictions or the equivalent document shall be submitted for review and approval by the City before release of the final plat mylars for recording to ensure maintenance of open space, median plantings, cul-de- sac plantings, common drives, and common utilities. The declaration shall include, but is not limited to, the following: (a) A statement requiring the deeds, leases or documents of conveyance affecting buildings, units, parcels, tracts, townhouses, or apartments be subject to the terms of the declaration. (b) A provision for the formation of a property owners association or corporation and that all owners must be members of said association or corporation which may maintain all properties and common azeas in good repair and which may assess individual property owners proportionate shares of joint or common costs. The association or corporation must remain in effect and may not be terminated or disbanded. (c) Membership in the association shall be mandatory for each owner and any successive buyer. (d) Any open space restrictions must be permanent and may not be changed or modified without city approval. (e} The association is responsible for liability insurance, local taxes and the maintenance of the open space facilities deeded to it. (f) Property owners are responsible for their pro-rata share of the cost of the association by means of an assessment to be levied by the association which meet the requirements for becoming a lien on the property in accordance with Minnesota Statutes. (g) The association may adjust the assessment to meet changing needs.
