HomeMy WebLinkAbout20070604 - VIII-A-2 VIII-A-2 MEMO To: Honorable Mayor and City Council From: Tom Montgomery Date: May 30, 2007 Re: Approve Agreement with Dakota County for a Hastings Area Roadway System Study Council is requested to approve the enclosed agreement with Dakota County to conduct an area roadway system study for the Hastings area. The purpose of the study is to identify future County highway needs on the south and west sides of the City to accommodate future City growth and traffic volume increases in the area. I have enclosed a drawing illustrating the general scope of the study. This study was requested by the City to be included in the County's capital improvement program for the past four years as an analysis of a Hwy 316 bypass with a connection around the south of the City to CR 47 and CR 46. The transportation study proposals came in higher than expected at $100,000. Under the County's standard cost sharing policy. the City is responsible for 45% of the study cost or $45,000. The Engineering Department budget includes about $20,000 in consultant funding that can be applied towards this study in 2007, leaving $25,000 that will need to be budgeted in 2008 to meet the City's cost share for the project. COUNCIL ACTION REQUESTED Council is requested to approve the enclosed agreement for a Hastings area roadway study, recognizing that a commitment is also needed to budget $25.000 for this study in 2008. WHEREAS, Dakota County is requested to form a partnership with the City of Hastings, Marshan Township, MnDOT, the Metropolitan Council, and area property owners and take the lead in initiating an alignment study in 2004. WHEREAS, the City of Hastings intends to participate in costs associated with the proposed alignment study in accordance with applicable county cost sharing policies ~ and/or negotiated cost sharing agreements. NOW, THEREFORE BE IT RESOLVED, the City of Hastings hereby requests that the CSAH 47 alignment study be included in the Dakota County 2004 to 2008 Transportation CIP in 2004. Werner, Mayor ATTEST: llWfttu 1 ,,lUJ\krr1v_ Melanie Mesko Lee, City Clerk (Seal) DAKOTA COUNTY DEPARTMENT OF TRANSPORTATION AGREEMENT FOR PRELIMINARY ENGINEERING BETWEEN THE COUNTY OF DAKOTA AND THE CITY OF HASTINGS FOR DAKOTA COUNTY PROJECT NO. 97-65 AND CITY OF HASTINGS PROJECT NO. TO Conduct an area roadway system study within the City of Hastings and adjacent areas south and west in the City of Hastings, Marshan Township, and Nininger Township, Dakota County. Dakota County Project No. 97-65 April 5, 2007 THIS AGREEMENT, made and entered into by and between the County of Dakota, referred to in this agreement as "the County", and the City of Hastings, referred to in this agreement as "the City", and witnesses the following: WHEREAS, under Minnesota Statutes Section 471.59, subd. 1, two or more governmental units may enter into an Agreement to cooperatively exercise any power common to the contracting parties, and one of the participating governmental units may exercise one of its powers on behalf of the other governmental units; and WHEREAS, the County and the City seek to conduct an area roadway system study within the city of Hastings and adjacent areas south and west to identify arterial and collector roadway needs associated with future Hastings area growth identified by regional and local plans; and WHEREAS, the County and the City have included this study project in their Capital Improvement Programs and will fund the study costs as allocated in this agreement; and WHEREAS, the County and the City require professional services to conduct an area roadway system study as set forth in this Agreement to determine future arterial and collector roadway needs associated with future Hastings area growth. NOW, THEREFORE, It is agreed that the County and the City will participate in the study costs as set forth in this agreement: 1. Administration. The County will enter into a contract with the selected consulting firm after obtaining review and approval by the City as to qualifications of the firm and cost of the proposed study. The County will administer the contract with the professional consulting firm and will coordinate the area roadway system study work of the professional consulting firm. The 2 Dakota County Project No. 97-65 March 21, 2007 County and the City shall each retain final decision-making authority within their respective areas of responsibility. 2. HastinQs Area Roadwav System Study. The area roadway system study shall be defined as: a. Public Participation b. Agency Coordination c. Impacts and Evaluation of Identified Improvements d. Final Report and Presentation Materials e. Community Coordination The costs shall be cost-shared in conformance with the Dakota County Transportation plan in the amount of 55% by the County and 45% by the City. 3. Plans and Specifications. A Request for Proposals was developed to select a consulting firm to perform the area roadway system study. The deliverables for the study include: a. All agendas, minutes, agency comments, public open house comments, graphics, and presentation materials. b. Final report consisting of executive summary, report, findings, recommendations, impacts, appropriate graphics, presentation material, and appendices. c. Electronic file copies of final reports and maps. d. Consultant presentation of final report at final agency coordination meeting. 4. Payment. The County will act as the paying agent for payments to the consultant. Payments to the consultant will be made as the project work progresses and when certified for payment by the Dakota County Engineer. The County, in turn, will bill the City for their share of the professional services as specified in paragraph 2. Upon presentation of an itemized claim by one agency to the other, the receiving agency will reimburse the invoicing agency for its 3 Dakota County Project No. 97-65 April 5, 2007 share of the costs incurred under this agreement within 30 days from the presentation of the claim. If any portion of an itemized claim is questioned by the receiving agency, the remainder of the claim shall be promptly paid and accompanied by a written explanation of the amounts in question. Payment of any amounts in dispute will be made following good faith negotiation with the consultant and documentation of actual costs incurred in carrying out the work. 5. Rules and Reaulations. The County and the City shall abide by Minnesota Department of Transportation and Federal Highway Administration rules and State Statutes as applicable to carrying out the work contemplated in the agreement. 6. Waiver. Any and all persons engaged in the work to be performed by the County shall not be considered employees of the City for any purpose, including Worker's Compensation, or any and all claims that mayor might arise out of said employment context on behalf of said employees while so engaged. Any and all claims made by any third party as a consequence of any act or omission on the part of said County employees while so engaged on any of the work contemplated herein shall not be the obligation or responsibility of the City. The opposite situation shall also apply: the County shall not be responsible under the Worker's Compensation Act for any employees of the City. 7. Audits. Pursuant to Minnesota Statutes Sec 16 C. 05, Subd. 5, any books, records, documents, and accounting procedures and practices of the City and the County relevant to the Agreement are subject to examination by the City or the County and either the Legislative Auditor or the State Auditor as appropriate. The City and County agree to maintain these records for a period of six years from the date of performance of all services covered under this agreement. 4 Dakota County Project No. 97-65 March 21, 2007 8. Inteqration.
