Back2round Information By Resolution No. 05-13-05, approved on May 16,2005, the Hastings City Council authorized the City of Hastings to join the Metropolitan Regional 800 MHz Radio System. By Resolution No. 05-14-05, approved on May 16, 2005, the Hastings City Council approved the Dakota Communications Center Joint Powers Agreement for countywide dispatch services. In August 2006, Dakota County entered into a Cooperative Agreement with the MESB and Mn/DOT that outlines the rights and obligations of Dakota County as a member of the regional public safety radio communications system in the metropolitan area. A formal Subscriber Agreement must be entered into by each local government (city, township, volunteer fire department, etc.) that will be users of the Dakota County 800 MHz radio network before they are authorized to use the subsystem. Staff has worked with representatives of Dakota County in drafting the proposed Subscriber Agreement. A copy of the Subscriber Agreement is included in attachment A. The Subscriber Agreement defmes the terms and conditions between the local governments and the County for the use of the Dakota County subsystem. There are three main features to the agreement: 1) Subscribers must operate under the rules and policies ofthe MESB and the State Radio Board; 2) Subscribers pay a user fee on a per radio basis that is a pro rata distribution of the operating and maintenance costs incurred by the County and the MESB to support the Dakota County subsystem and the regional system; and 3) Other repair and maintenance services will be provided by the County as requested. An 800 MHz Policy Work Group has been established by the County for the purpose of making recommendations to the County Board regarding operating and financial policies for the County 800 MHz trunked radio subsystem under the terms of the Subscriber Agreement. The City will have a representative on the Policy Work Group. City of Hastings Resolution 06- -07 WHEREAS, by No. 05-13-05, approved on May 16, 2005, the Hastings City Council authorized the City to join the Metropolitan Regional 800 MHz System; and WHEREAS, Resolution No. 05-14-05, approved on May 16,2005, the Hastings City Council approved the Dakota Communications Center Joint Powers Agreement for public safety dispatch services; and WHEREAS, Dakota County has entered into a cooperative agreement with MESB and Mn/DOT for the purpose of defining the rights and obligations of each party with respect to the design, procurement, construction, ownership, operations, funding, and maintenance ofa County/Regional Integrated Subsystem the submission of the Dakota County 800 MHz Radio Plan to the Metropolitan Radio Board; and WHEREAS, the City of Hastings has promoted partnerships between units of government to facilitate the construction of the Dakota County 800 MHz Radio Subsystem; and WHEREAS, a Subscriber Agreement is needed to define the teoos and conditions between the City and tbe County for the use of the Dakota County subsystem; and WHEREAS, as part of the Subscriber Agreement the County has established an 800 MHz Policy Work Group for the purpose of making recommendations to the County Board regarding operating and financial policies for the County 800 MHz trunked radio subsystem; and WHEREAS, the City will have representation on the Policy Working Group. NOW, THEREFORE, BE IT RESOLVED, that the City of Hastings hereby approves the Subscriber Agreement between the City and Dakota County and authorizes the City Administrator to execute the Subscriber Agreement for City use of the Dakota County 800 MHz Radio Subsystem; and BE IT FURTHER RESOLVED, that the initial teoos of the agreement shall be from the effective on the date it is executed by both parties and will continue through December 31,2012 ("Initial Term") and will automatically be extended for additional one additional one (1) year terms unless teooinated.
