City Council Minutes
May 21, 2007
The City Council of the City of Hastings, Minnesota met in a regular meeting on
Monday, May 7,2007 at 7:00 PM in the Council Chambers at the Hastings City Hall,
101 East 4th Street, Hastings, Minnesota.
Members Present: Mayor Hicks, City Councilmembers Alongi, Hazlet, Hollenbeck,
Slavik, and Riveness
Members Absent: Councilmember Schultz

Approval of Minutes:
Mayor Hicks asked if there were any corrections to the minutes of the regular
meeting of May 7,2007. Councilmember Slavik offered a spelling correction. With
that addition, the minutes were approved as amended.
Proclamation-Steve Pederson Day
Councilmembers Hazlet and Riveness read the proclamation recognizing
Engineering Technician Steve Pederson, who was recently diagnosed with cancer.
Historic Preservation Commission Awards
Amy Martin and Kathy Sovik-Siemens of the HPC presented the following
awards to property owners who have made improvements to their historic properties:

Council Items to be Considered:
Moved by Council member Riveness, seconded by Councilmember Alongi to
add a resolution supporting funding for the replacement for the US Highway 61 bridge
to the consent agenda. If approved, the resolution will be presented to the City's
representatives in Washington DC later in the week.

Award Contract -Public Dock Access Construction
Moved by Council member Hollenbeck, seconded by Councilmember Riveness
to award the contract to Otto in the amount of $26,465 as presented.

Moved by Councilmember Hazlet, seconded by Councilmember Slavik to
award the contract to MN Asphalt Maintenance in the amount of $27,774.25 as

Resolution-Vacation of Easement #2007-17: Hastings Family Housing/Pleasant
Acres 2n Addition
Moved by Councilmember Slavik, seconded by Council member Hazlet to
approve the resolution as presented.

Remembering with Dignity-Thomas Avenue Access Request
Public Works Director Montgomery introduced the item, which is for a request
for the City to remove barricades from the north end of Thomas Avenue and extend a
gravel drive approximately 75 feet north to connect to the existing State Hospital
Cemetery access trail that runs along the perimeter of the DNR Wildlife Management
Area. Remembering with Dignity has received a grant to place headstones on
approximately 500 of the 900 unmarked grave sites and would like to open up the
cemetery site to public visitation. Montgomery stated that RWD distributed a flyer to
the neighborhood explaining the plans and goals. The DNR is also proposing to
convert the area to a Scientific and Natural Area, which would result in a hunting
prohibition and more restrictions on motorized vehicle use. Montgomery stated that
the main comments he has received focus on higher accessibility for ATV/snowmobile
use and partying.
Jill Schmoda, 549 Tuttle Drive, stated a concern that the DNR site is not
patrolled and use of ATV's and bikes in the cemetery and that it should be protected.
Burt LeBray, 447 Tuttle Drive, stated that there is already a lot of ATV and
snowmobile use and that and crime will increase with better access.
Carla Brown, 503 Tuttle Drive, suggested that a trailless wide be considered.
Jim Fassett-Carmen, from Remembering with Dignity, stated that the goals are
to try to improve state hospital cemeteries and by improving desirable traffic visiting
the cemetery site, that undesirable uses, such as A TV and snowmobile use in
protected areas will decrease.
Patrick Lippert, 553 Tuttle Drive, stated that removing the barricade at Thomas
Avenue will invite more ATV use. He also questioned who will maintain the cemetery.
Lisa Sieben, resident and parent of a child with a disability, supported the
improvements, as the current access site is generally locked. She stated that
additional funds are being sought to further improve the site through possible fencing
or planting.
Ear Karsakis, 8257 High Avenue, Cottage Grove, stated that his grandfather is
buried in this site and is one of four graves currently marked, courtesy of RWD. He
stated support for increased access.
Kris Porrez, 529 Tuttle Court, said she doesn't want cars driving to the site;
concern with where cars will park when visiting.
Terry Ecker, 351 Tuttle Drive, stated concern with higher access and increased
partying.
Tom O'Brien, stated he lives two houses west of Thomas Avenue, stated that
the current barricades have reduced A TV traffic. He suggested putting a gate up and
adding a walking path.
Mr. Fassett-Carmen spoke again and stated that state law provides that there
must be an access to a state cemetery.
Councilmember Alongi commented on where visitors would park, he reiterated
that no additional development is proposed as part of this request, consideration of
establishing hours to be open and gate it off when the site is closed.
Councilmember Hollenbeck stated that there may be consideration of
establishing hours and accessibility access.

Mayor Hicks stated that access to the site is important, but details such as
hours and gates still need to be resolved. The Thomas Avenue access is the best
location, the site needs to be protected.
Moved by Councilmember Alongi, seconded by Mayor Hicks to approve a 10'
bituminous trail with bollards from Thomas Avenue to the existing city limits and work
with the state to provide additional access on the state trail to the cemetery itself.
Councilmember Slavik expressed concern with the additional cost of paving
and installing bollards, which have not been budgeted for.
5 Ayes; Nays, one. Councilmember Slavik voting against.

Session
Moved by Councilmember Hazlet, seconded by Councilmember Hollenbeck to
approve rescheduling the June 18 Council meeting to June 19 at 7:00 p.m., with a
special workshop also to be scheduled at 5:00 p.m. on June 19, 2007.

First Reading/Order Public Hearing for June 4, 2007-Recodified Code of
Ordinances
City Attorney Moynihan stated that Council is requested to have a first reading
and order a public hearing to consider adopting the recodified code of ordinances.
Moved by Council member Slavik, seconded by Councilmember Hollenbeck to
approve the first reading and order the public hearing as presented.

Comments from the Audience
Paul Kane, 1604 Ashland, stated that he has received a lot of phone calls
about the recently terminated police officer and asked for an explanation. He stated
that the public wasn't permitted to speak at the recent Police Civil Service Commission
meeting. He asked when the information would be made public.
City Attorney Moynihan stated that the officer waived rights under the PCSC
and thus no comments were taken to protect the officers' rights. The City is unable to
comment further as the information is protected under the Minnesota Data Practices
act.
