REQUEST
Bruce Jorgenson seeks to extend the one year Sunset Clause for the Preliminary Plat of
Jorgenson Addition, consisting of 3 single family lots and one outlot along Tierney Drive.
Mr. Jorgenson seeks an additional one year extension. Please see attached letter.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HASTINGS
AMENDING CITY COUNCIL RESOLUTION NO. 06-18-06 GRANTING
PRELIMINARY PLAT APPROVAL FOR JORGENSON ADDITION, A RESIDENTIAL

WHEREAS, on June 19,2006 The Cily Council of the City of Hastings adopted Resolution
No. 06-18-06 granting Preliminary Plat approval to Bruce Jorgenson for JORGENSON ADDITION,
a residential subdivision consisting of three lots and one outlot generally located along Tierney
Drive, legally described as follows:

WHEREAS, said City Council Resolulion was subject to 11 conditions of approval,
including Condition No.8 as follows:
Approval is subject to a one year Sunset Clause; if significant progress is not made towards
construction of the proposal within one year of City Council approval, Ihe approval is null
and void; and
WHEREAS, Bruce Jorgenson seeks to extend the Sunset Clause provision by an additional
one year.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF HASTINGS AS FOLLOWS:
That the City Council hereby approves the modification to said Resolution granting Preliminary Plat
approval as presented to the City Council subject to the following conditions:
1. Outlot A shall have a covenant between the adjoining parcel at 1690 Tierney Drive (Lot 1,
Block 4 of Dakota View First Addition) as to be one parcel. Outlot A cannot be sold as an
individual lot.
2. All disturbed areas on this property shall be stabilized with rooting vegetalive cover to
eliminate erosion problems.
3. The disturbed areas of the site shall be maintained to the requirements ofthe City's property
maintenance ordinance.
4. Final review of the stormwater plan. The developer shall be responsible for any costs
incurred by the city as a result of consultant review of the stormwater plan.
3. Cash in lieu of land in the amount of $6,600 ($2,200 x 3 lots) shall be paid to satisfy park
dedication requirements. Payment must be made before release ofthe Final Plat Mylar for
recording.
4. Sewer interceptor fees of$I,155 ($385 x 3 lots) are payable prior to the release of the final
plat mylars.
5. Final approval of the development grading and ulility plans by the City of Hastings. The
applicant shall be liable for any costs involved in consultant review of the plans.
6. Any uncompleted site work (including landscaping) must be escrowed for prior 10 issuance
of a certificate of occupancy.
7. Submission of an eleclronic copy of all plan sets (TIF, PDF, or similar format) prior to
issuance of certificate of occupancy.
8. Approval is subject 10 a one year Sunsel Clause; if significant progress is not made towards
conslruction of the proposal within one year of Cily Council approval, the approval is null
and void.
9. A landscape plan must be submitted showing boulevard trees every 50 feet along Tierney
Drive. The applicant shall be responsible for planting the trees.
10. One front yard tree per lot must be planted.
II. All boulevard and front yard trees must be a minimum of 2.0 caliper inches at Ihe time of
planting.

RE: Jorgenson Addition
Dear Mr. Hinzman:
The sunset clause on the Jorgenson addition will be coming into effect very soon and I
am requesting a one year extension to get this completed. I would hope to get this
compleled by late fall but would appreciate an extension to get us to next spring if needed
plus there are several issues from John Stewart that need to be resolved. Also I would
like to get together with you at some point to discuss these issues, as I never had a copy
of that letter and had only seen it briefly when John Dwyer had it and now he has retired
and I will be looking for another surveying firm to complete the project. Thank-you for
considering this request.
