1st Reading\Order Public Hearing - Ordinance amending 155.32 (C) (5)
(a) of City Code allowing temporary auto sales in C-4 district
REQUEST
The City Council is asked to consider first reading and order a public hearing to amend
Section 10.21, Subd. 3 (old code) or 155.32 (C) (5) (a) of the Recodified City Code
pertaining to Temporary Auto Sales in the C-4 District. The change would remove the
one year temporary ordinance provision to make the auto sales provision permanent.
The public hearing and final action would be scheduled for the July 16, 2007, City Council
Meeting upon action by the City Council.
RECOMMENDATION
The Planning Commission voted 5-0 to recommend approval of the amendment at the
June 11, 2007 meeting with limited discussion. No one from the public spoke for or against
the request.
BACKGROUND INFORMATION
On August 7,2006, the City Council voted to change Section 10.21 C-4 Regional Shopping
Center, Subdivision 3, Uses by Special Permit. The change allowed temporary auto sales
in the C-4 district by a special use permit. The provision to Section 10.21 expires on July
31,2007.
The ordinance change was prompted by a request from Hastings Automotive to hold a
temporary auto sale at the Westview Mall. Upon the ordinance change, a sale was held at
the Westview Mall in September 2006. Staff did not have any concerns nor were any
complaints received from the public.

155.32 (C) (5) (a) Temporary auto sales may be allowed to support the activities of a
non-profit community organization (Le. fundraiser for a sports team or school). Each
auto dealership may be allowed 1 sale per year, with the sale not to exceed 14 calendar
days per year. Each parcel of land in the C-4 district is allowed 1 sale per year. If a
business consists of more than 1 parcel, only 1 sale may be allowed. V......m____m....________.......
(b) The following shall be considered in granting a special use permit:
1. The affect on the total number of parking spaces at the
business the sale is held.
2. The affect of the ingress and egress at the parking lot.
3. The affect on accessibility of emergency services.
4. The affect on neighboring businesses or residential areas from
an increase in traffic.
