HomeMy WebLinkAbout20070716 - VIII-B-3VIII-B-3 Memo To: Mayor Hicks and City Council Members From: John Hinzman, Planning Director Date: July 16, 2007 Subject: Resolution - Adopt Findings of Fact for Denial: Minor Subdivision #2007-24 -Creation of a new residential lot - 3605 Redwing Blvd. REQUEST The City Council is asked to adopt the attached resolution substantiating findings of fact for denial of Minor Subdivision #2007-24 at 3605 Redwing Boulevard. HISTORY The City Council voted 7-0 to deny the request at the July 2, 2007 meeting based on the recommending findings of the June 11, 2007 Planning Commission recommendation as follows: 1) Lot size inconsistent with neighborhood 2) Traffic Safety in the vicinity of Maher Avenue and Red Wing Blvd. 3) Concern about the close proximity of the detached garage to home 4) Location of the split is not in character with the neighborhood. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HASTINGS DENYING THE MINOR SUBDIVISION REQUEST OF GARY HESELTON TO SUBDIVIDE PROPERTY LOCATED AT 3605 REDWING BOULEVARD, HASTINGS, MINNESOTA Council member its adoption: introduced the following Resolution and moved WHEREAS, Gary Heselton has submitted an application for minor subdivision to subdivide a +/- 10,350 s.f. parcel from a +/- 30,000 s.f. parcel owned by Columbus Freiermuth generally located at 3605 Redwing Boulevard, legally described as Lot 6, WINDY ACRES, Dakota County, Minnesota; and WHEREAS, on June 11, 2007, a public hearing and review of the request was conducted before the Planning Commission as required by state law, city charter and city ordinance; and WHEREAS, the Planning Commission voted 6-0 to recommend denial of the request based on the following reasons: 1) Lot size inconsistent with neighborhood 2) Traffic Safety in the vicinity of Maher Avenue and Redwing Blvd. 3) Concern about the close proximity of the detached garage to home 4) Location of the split is not in character with the neighborhood. WHEREAS, on July 2, 2007 the City Council concurred with the recommendation of the Planning Commission and voted 7-0 to deny the minor subdivision request. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HASTINGS AS FOLLOWS: That the City Council further memorializes its action to deny the minor subdivision request ofGary Heselton based on the following findings of fact: 1) Lot size inconsistent with neighborhood. The predominant lot size of the neighborhood is much larger than the minimum size requirements of the R-2 Zoning District. Approval of the subdivision would create a new lot of nearly half the size of lots in the immediate vicinity of the property. 2) Traffic Safety in the vicinity of Maher Avenue and Redwing Boulevard. Redwing Boulevard (TH 316) is a congested roadway. The City Council has taken action in the past to reduce the traffic impact of new development by conditioning prior approvals on traffic improvements or secondary means of access in order to reduce traffic impact on Redwing Boulevard. 3) Concern about the close proximity of the detached garage to home. Dakota County Document No. 252354 establishes covenants for the use of property within the WINDY ACRES subdivision. Recorded development covenants prohibit the erection of "unattached out buildings or other structures". 4) Location of the split is not in character with the neighborhood. The City Council recognizes the inconsistency of the subdivision to the predominant lot size in the immediate vicinity and has directed City Staff to prepare an amendment to the zoning ordinance to increase the minimum lot size to better match the existing average lot sizes of the area. Council member moved a second to this resolution and upon being put to a vote it was unanimously adopted by all Council Members present.
