HomeMy WebLinkAbout20070716 - VII-2VII-2 Memo To: Mayor Hicks and City Council From: John Hinzman, Planning Director Date: July 16, 2007 Subject: Public Hearing -Ordinance Amendment #2007-26 -Non-Conforming Signs REQUEST The City Council is asked to hold a public hearing and consider 2"d reading to amend Chapter 155.08, Subd. F(3) of the City Code (Chapter 10.08, Subd. 6C of otd City Code) pertaining to Non-Conforming Signs. The change would allow for the replacement of non- conforming sign faceplates with smaller sized signs. The City Council considered 1St reading of the ordinance and scheduled the public hearing at the July 2, 2007 meeting. RECOMMENDATION The Planning Commission voted 5-0 to recommend approval of the amendment at the June 25, 2007 meeting with limited discussion. No one from the public spoke for or against the request. BACKGROUND INFORMATION History In 2001 the City amended sign height and size requirements rendering many existing signs non-conforming. A provision was added to the amendment to allow for general maintenance of existing signs through the replacement of faceplates. Request to Replace Faceplate Lamar Signs has submitted a sign permit to replace the faceplates of two billboard signs located near 418 and _ 3075 Vermillion Str-.eet with smaller faceplates. The existing ordinance would allow replacement of faceplates of the same size only. Please see attached drawings for further information. F OF THE CITY OF HASTINGS, MINNESOTA CODE OF ORDINANCES PERTAINING TO: NON CONFORMING AND ILLEGAL SIGNS BE IT ORDAINED by the City Council of the City of Hastings as follotivs: Chapter 155.08, Subd. F of the City of Hastings, Minnesota Code of Ordinances is hereby amended as follows: (F) Nonconforming and illegal signs. (1) Any sign legally existing on the effective date of this section that does not conform to the requirements set forth in this section shall become a nonconforming use and/or structure. Except as otherwise provided in this section, nonconforming signs shall be allowed to continue, but shall not be rebuilt, relocated, replaced, or altered without being brought into compliance with all the requirements of this section. Furthermore, nonconforming signs are subject to the provisions contained at § 155.06. (2) Any sign that is in violation of this section shall be removed or altered to comply with this section. (3) Maintenance of existing signs, including the replacement of faceplates of the same size, or smaller shall be permitted on nonconforming signs. (4) Temporary ribbons, banners, pennants, and similar devices that are in_use as of the adoption of this section must comply with the provisions of division (C)(11) above. (Prior Code, § 10.08) (Am. It took longer than I thought to get a check cut from my corporate office. You had requested more information about the structural aspects of the two signs. The sign at 418 Vermillion St. is made up of an "A" frame that attaches to the top of the building and then attaches to the sign faces below. I have enclosed a diagram which outlines the structural components of those two faces. I apologize for the hard to read print, it is the best I had. The sign at 1600 building corp. is much simpler. It consists of a mono-pole structure secured in the ground with cement. The overall height of the structure is 20'. I have enclosed asign/component parts diagram showing the makeup of this sign.
