Frontage Road - Wal-Mart Hastings Addition REQUEST Wal-Mart Real Estate Trust seeks the following: Preliminary and Final Plat approval to replat Lot I, Block 1, Dakota Summit. The replat will consist of two lots that will form Wal-Mart Hastings Addition. Lot 1 will be 884,700 square feet, or 20.31 acres. Lot 2 is being platted for future retail use and will be 27,968 square feet, or .64 acres. The site is generally located north of Highway 55 and west of General Sieben Drive on North Frontage Road. RECOMMENDATION The Planning Commission met on August 13,2007, to discuss the Preliminary and Final Plat for Wal- Mart Hastings Addition. The Planning Commission voted to recommend approval of the Preliminary and Final Plat. Zoning Classification The subject property is zoned C-4, Regional Shopping Center. Adjacent Zoning and Land Use The following land uses abut the property: Direction North East South West Existint! Como Plan R-3 PRO P-Public P-Public Institution P-Public C-4, Regional Shopping Ctr C-Commercial Nininger Township Nininger Township Existing Condition Lot 1 is the site of the current Wal-Mart store. A gas station was located on the proposed Lot 2 which was recently tom down. Lot 2 will be 27,968 square feet, or .64 acres. In comparison, the Pizza Hut Restaurant at 1330 South Frontage Road is .71 acres and 30,768 square feet. History In 2001, the preliminary and final plats for Dakota Sununit were approved, This plat included 2 commercial lots and one outlot. The Site Plan and Special Use Permit for Murphy Oil were approved in July 2002. PRELIMINARY AND FINAL PLAT REVIEW Access and Circulation The site is accessed from General Sieben Drive and North Frontage Road, Per the Public Works Director, "No access should be permitted to the E/W North Frontage Road as this will create problems with the street intersection to the west (N/S North Frontage Road and the EfW North Frontage Road). Access to the existing/future collector street on the west side of Lot 2 (N/S North Frontage Road) should be limited to the north 50 feet of Lot 2 to avoid congestion and safety issues with turning vehicles so close to a future busy intersection. An ingress/egress easement with Lot 1 should also be required so that access from the parking lot is made available and vehicles coming from Lot 1 are not required to utilize City streets to access Lot 2." Preliminary & Final Plat - Lot 1, Block 1, Dakota Summit - WaJ-Mart Real Estate Business Trust City Council Memo - August 20 2007 Page 3 Easements Per the City's consultant engineer, drainage and utility easements must be recorded over all facilities that are an extension of the City's utility systems onto the Wal-Mart property. These easements must be shown on the plat. Grading, Drainage, Erosion Control, and Utility Plan The City's consultant engineer has reviewed the Grading, Drainage, Erosion Control, and Utility Plans. Approval of the Preliminary and Final Plat is subject to approval of the Grading, Drainage, Erosion Control and Utility Plans by the Public Works Director, and reimbursement for any fees involved in plan review. Interceptor Sewer Fee Sewer interceptor fees shall be paid as follows: I) Sewer interceptor fees in the amount of $400 shall be paid prior to recording of the Final Plat. Public Land Park Land Dedication fees were previously paid with the recording of Dakota Summit. Signage Signage has not been indicated on the site plan and will be administratively permitted under a separate sign permit application. Although sign permit review will take place after site plan approval, the following regulations are applicable: For a multiple occupant building, the monument sign is limited to 50 square feet in size and must be no greater than 6 feet high, Site Plan Review Site Plan Approval is required prior to any building constructions. Issues such as zoning setbacks, parking, architectural elevations, landscaping, lighting plans, and grading and utility plans will be reviewed at that time. HASTINGS CITY COUNCIL RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HASTINGS GRANTING PRELIMINARY AND FINAL PLAT APPROVAL FOR W AL-MART HASTINGS ADDITION Council member moved its adoption: introduced the following Resolution and WHEREAS, Wal-Mart Real Estate Business Trust has petitioned for Preliminary and Final Plat Approval for Wal-Mart Hastings Addition, consisting of two lots. The property is located north of Highway 55 and west of General Sieben Drive on North Frontage Road, legally described as Lot I, Block I, Dakota Summit; and WHEREAS, on August 13, 2007, review was conducted before the Planning Commission of the City of Hastings, as required by state law, city charter and city ordinance; and WHEREAS the Planning Commission recommended approval of the request to the City Council subject to the conditions contained herein; and WHEREAS The City Council has reviewed the request and concurs with the recommendation of the Planning Commission. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HASTINGS AS FOLLOWS: That the City Council hereby approves the Preliminary and Final Plats as presented to the City Council subject to the following conditions: I. Conformance with the City Council Staff Report and plans dated August 20, 2007. 2. All disturbed areas on this property shall be stabilized with rooting vegetative cover to eliminate erosion problems. 3. Final approval of the grading, drainage and utility plans by the Public Works Director, and reimbursement for any fees involved in plan review, The owner assumes all risks associated with the grading and utility placement prior to formal approvals. 4. Sewer interceptor fees in the amount of $400 shall be paid pnor to recording of the Final Plat. 5. Any uncompleted site work (including landscaping) must be escrowed for at 125 percent of estimated valuation prior to issuance of a certificate of occupancy. 6, The Final Plat must be submitted for recording with Dakota County within one year of City Council approval, or the approval is null and void. 7. Site Plan Review is required before the construction of a building on Lot 2. 8. Access to the existing/future collector street on the west side of Lot 2 (N/S North Frontage Road) is restricted to the north 50 feet of Lot 2. Access to the east/west section of North Frontage Road shall be prohibited, 9. A joint access easement shall be recorded upon all lots to ensure joint ingress/egress access. 10. Drainage and utility easement must be recorded over all facilities which are an extension of the City's utility systems onto the Wal-Mart property, These easements must be shown on the plat. II.
