Resolution - Order Quiet Zone Improvements
The public hearing on the proposed quiet zone improvement project was held at
the August 6th Council meeting, but action ofthe proposed improvements was tabled as
the resolution ordering the improvements requires 6 of 7 Councilmembers support and
not all Councilmembers were in attendance at the August 6th meeting.
I have enclosed a copy of the Council minutes noting that two area residents
spoke in support of the quiet zone at the public hearing. I have also enclosed a copy of
City Engineer Nick Egger's August 1 memo to the Council.
Council Action Requested
Council is requested to adopt the enclosed resolution ordering the Quiet Zone
Improvements, approving the improvement plans, and authorizing the City to enter into
an agreement with CP Rail for the relocation of a rail crossing signal.

RESOLUTION ORDERING THE IMPROVEMENTS, APPROVING PLANS AND
SPECIFICATIONS, AND AUTHORIZING THE SOLICITATION OF QUOTES FOR
PROJECT No. 2007-3
QUIET ZONE IMPROVEMENTS
WHEREAS, a resolution of the City Council adopted the 16th day of July, 2007, fixed a date
for a Council hearing on the proposed improvements, and
WHEREAS, ten days mailed notice and two weeks published notice of the hearing was
given, and the hearing was held thereon on the 6th day of August, 2007, at which all persons
desiring to be heard were given an opportunity to be heard thereon,
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF HASTINGS AS FOLLOWS; that
1. Such improvement is necessary, cost-effective, and feasible as detailed in the
feasibility report.
2. Such improvement is hereby ordered as proposed in the feasibility report
dated July 11, 2007.
3. Plans and specifications for the Quiet Zone Improvements prepared by the
Hastings City Engineer are hereby approved.
4. The July 6, 2007 agreement proposal from CP Rail for relocation of the
west signal ann is hereby approved and City staff are authorized to sign the
agreement.
5. The City Engineer shall contact several qualified contractors to obtain
proposals for the work, and thereby recommend one of said proposals to
the Hastings Council at a future meeting for their consideration.
ADOPTED BY THE CITY COUNCIL OF HASTINGS, MINNESOTA, TillS 20th DAY
OF AUGUST, 2007.

Award Bid-City Ban Stone Step Repair
City Administrator Osberg requested that bid be awarded to A&M Construction in the
amount of $60,800.
Moved by Councilmember Slavik, seconded by Councilmember Riveness to award the
contract as presented.

Donation from Hastings Rotary
The Hastings Rotary was present to give a check to the City in the amount of$I,040 to
be used for trailhead markers. The Council accepted the gift and thanked the Hastings Rotary.
Public Hearing-Downtown Quiet Zone Improvements
Mayor Hicks opened the public hearing at 7:14 p.m.
Mayor Hicks suggested that the action be tabled until the August 20, 2007 meeting
when the full Council would be present to address the issue.
Bess Freeman, 522 Lea Street, stated support for the quiet zone.
Lee Erickson, 613 East 2nd Street, stated SUpport for the quiet zone.
Hearing no further comments, Mayor Hicks closed the public hearing at 7:19 p.m.

Moved by Councilmember Slavik, seconded by Councilmember Hazlet to table this
issue to the August 20, 2007 Council meeting.

City Project 2007-3, Quiet Zone Improvements
Council received the feasibility report for the proposed Quiet Zone Improvements at the July 16th
meeting. The public hearing for this project has been scheduled for the August 6th Council
meeting. A neighborhood meeting was held on July 24th to receive comments and input from
affected residents.
The proposed Quiet Zone Improvements project is a City initiated project, and will require the
votes of m Couneil members to approve the project.
PROPOSED IMPROVEMENTS
The proposed Quiet Zone Improvements would include the removal of existing turnaround
islands west of the 2nd Street railroad crossing, construction of concrete medians on both
sides of the railroad crossing, relocation of the railroad signal and crossing arm on the west
side of the tracks, and installation of a vehicle gate on each side of the 3rd Street railroad
crossing. Prior to the installation of the quiet zone items, extensions would be made to the
City's water distribution system beneath 2nd Street on the west side of the tracks in
preparation for trunk watermain connections that will be made in the near future north and
south along Bailly Street.
SUMMARY OF IssUES AND COMMENTS
Comments from about 15 residents were received at the July 24th neighborhood meeting, with
mixed sentiments about the concept of the Quiet Zone. Staff clarified with meeting attendees
that the decision to move forward with the installation of the Quiet Zone was made by the
City Council earlier in the year, and that the purpose of the neighborhood meeting was to
explain what, when, and where improvements would be made in order to create the Quiet
Zone. Staff also explained that the costs are being assessed to lIRA owned property on
Block 1 of the future redevelopment parcel located north of 2nd Street, as this property is the
prime beneficiary of the improvements. A tabulation of the comments received. along with
staff responses, has been included for reference.
COUNCIL ACTION REQUESTED
Council is requested to adopt the enclosed resolution ordering the improvements and
approving the plans for the project, and authorizing staff to obtain quotes from contractors.

RE: PROPOSED QUIET ZONE I SIGNAL RELOCATION

Hastings, Minnesota
This will aCknowledge receipt of HDR's final plan set dated June 26,
2007 concerning the proposed roadway reconstruction and improvement
project schedule along 2nd Street and the installation of emergency
swing gates at 3rd Street in Hastings. Copy of final plan set attached.
To accommodate this roadway project Canadian Pacific Railway (CPR) will
be required to relocate the existing warning devices that consist of
flashing light signal and half roadway gate from the west side of the
main line track.
CPR has reviewed the plans and has no objections to the city's roadway
project as proposed provide all cost associated with this project is at
loot city expense. CPR will furnish labor, material and equipment to
relocate the warning devices in conjunction with city's assigned
contractor. The agreed upon lump sum cost for CPR signal relocation
work is Twenty-Five Thousand ($25,000),
Please noted that any cost incurred by CPR for flagging service,
repairing damage to tracks, including disturbance of their alignment
and surface, interlocking or other facilities which it maintains,
caused by or resulting from the city or its assigned contractor for
this roadway improvement project, will be submitted to the city for
payment. Any flagging protection or watchman service required by the
railroad for the safety of railroad's operations because of the work
being performed by the city or its assigned contractor or work
incidental thereto, shall be provided by the railroad and submitted to
the city for payment.

P~ease arrange to notify this office at least three (3) working days
{excluding weekends and holidays} in advance of any field work
occurring within 25 feet of the track. CPR does maintain fiber optic
cable and railroad signal facilities throughout our rail system. Please
arrange to contact CPR "ONE CALL" at 888-625-8702 for cable locations.
This letter is being furnished in duplicate. If City of Hastings
concurs with these terms, please arrange to sign both copies and return
one to my attention along with check made out to Canadian Pacific
Railway in the amount of $25,000 dollars. This will be considered one
time lump sum payment for work required by CPR forces to relocate the
warning devices
