HomeMy WebLinkAbout20070917 - VIII-C-2 September 11, 2007 VIII-C-2 TO: The Honorable Mayor and Council FROM: John Grossman RE: Soldiers & Sailors Cemetery REQUEST: A Hastings resident and Minnesota National Guard member has requested permission to bury ashes and place a military headstone in the cemetery if she does not return from active duty in Iraq. See the attached memo from Maj. Patricia Baker to David Osberg, City Administrator. BACKGROUND: The City has been maintaining this cemetery at the comer of Featherstone and Nininger Road (1st Street and CH 42) for more than 20 years. Staff has not been able to determine if the City ever took an action accepting responsibility for the cemetery. It was established in 1905 by the local Peller Post of the GAR (Civil War veterans). The last member of the post died in 1933. Three Civil War veterans and six of their family members were buried in the cemetery between 1905 and 1973. Dan Fluegel, City Attorney, advises that the Council would have to take steps to establish City ownership and management of the cemetery prior to granting this request. Mr. Fluegel believes ownership can be established but it would take up to 90 days. Major Baker is willing to wait for this process to be completed. In order to permit additional burials, the City would get into the business of operating a cemetery. State law permits Cities to accept ownership of a cemetery located in the jurisdiction. If ownership is established and accepted, the Council could form a committee for management and adopt rules for the maintenance and operation of the cemetery. The specific conditions of Major Baker's request seem appropriate for a small cemetery established for veterans and maintained by the City. The number of potential requests is likely to be small, but these conditions might be applied to them as well. a. Permission for the time related to active service b. Hastings resident c. Baker for Entry into the Soldiers and Sai lors Cemetery 1. I fOffilally ask the city of Hastings to grant me permission to place a military headstone in the Soldiers and Sailors Cemetery of 1905, if and only if, I become a combat fatality while serving in suppOli of Operation Iraqi Freedom. 2. This request would be for ashes and a headstone only. This request would be for the duration of October 2007 through December 31,2009. I am a Hastings resident and homeowner in good standing with the city. My interests lie in the sentimental desire to be placed next to a fellow Minnesota Militiaman who fought and died with the 15t Minnesota in the Civil War and who resides in perpetuity in the Soldiers and Sailors Cemetery. 3. All aspects of this request pertain only to my individual request for consideration in light of upcoming active duty deployment in support of Operation Iraqi Freedom 10-08. There would be no cost to the city due to the military death benefits and gratuities which cover the costs of funeral and interment honors. 4.
