Prescription Drug/Over the Counter Drug Policy for TRAC
Council Action Requested:
Adopt the attached Prescription Drug/Over the Counter Drug Policy for TRAC.
Background Information:
The National Transportation Safety Board (NTSB) issued a directive to the Federal Transit
Administration (PTA) to educate transit agencies, like TRAC, on the potential safety risks
associated with prescription and over-the-counter medications by employees who perform safety
sensitive duties. TRAC is under the general authority of the FT A, and has adopted applicable
drug and alcohol use and testing policies as required. This additional directive is to provide
guidance on the use of prescription and over the counter drugs and employees who perform safety
sensitive functions- TRAC drivers and dispatchers_
It is not the City's intent, nor the intent of the policy, to force employees to unnecessarily submit
confidential medical information. Instead, it provides guidance on when employees ought to seek
medical assistance on the potential impact on any prescription drugs or over-the-counter
medications on their safety sensitive functions as TRAC employees and when that information is
to be shared with the City, as the employer.
This policy has been reviewed by Met Council and they. recommend City approval of the policy_
If approved, the policy will be distributed to aU impacted employees.

Over the Counter & Prescription Drug Policy
Purpose
The purpose of adopting an Over the Counter (OTe) & Prescription (Rx) Drug Policy is to act as
a reminder for safety sensitive employees and their health providers to balance treating illnesses
with the requirements of performing safety sensitive functions. The National Transportation
Safety Board (NTSB) issued a directive to the Federal Transit Administration (FTA) to educate
transit agencies, like TRAC, on the potential safety risks associated with prescription and over-
the-counter medications by employees who perform safety sensitive duties.
It is not the City's intent to force ill employees to work, nor to force employees who are eligible
to work while being treated for an illness to stay off the job. The determination of eligibility to
work will generally rest with the employee's physician and how the medication impacts the
employee's ability to perform his or her job safely. The City of Hastings reserves the right to
remove an employee from safety sensitive functions and obtain a second opinion if there are
concerns about the employee's ability to perform.
Applicability
This policy applies to all employees designated as safety sensitive, and is in addition to the
Transit Drug and Alcohol Testing policy adopted by the Hastings City Council. Employees must
comply with the regulations outlined in each policy; and this policy has been adopted as an
addendum to the Transit Drug and Alcohol Testing policy.
Prescription Medications can be prescribed only by a licensed physician. If you are ill and plan
to see your physician, you should:
I. Advise your physician of the safety-sensitive nature of your job;
2. Provide your physician with the Medical Authorization Form (a copy of which is
attached to the policy and which can be obtained from City Hall).
3. After prescribing medication, your physician must complete the authorization form.
On the form, your physician will indicate if you are or are not permitted to work
while taking the prescribed medication
Over-the-Counter Medications
· It is the responsibility of all safety sensitive employees taking over-the-counter
medications to read all warning labels before selecting it for use while on working
status.
· Medications whose labels indicate they may affect mental functioning, motor skills,
or judgment should not be selected.
· If no alternate medication is available, employees should consult their physician for
assistance.
Employees have personal responsibility for assessing their fitness for duty when taking an Rx or
over-the-counter medication. They should not report for duty, or remain on duty, if they are
being adversely affected by a medication, even if they have a Medical Authorization Form or if
the OTC label has no warning.
Medical Authorization Form
1. Employees must have a completed Medical Authorization Form for each Rx
medication prescribed for use while in working status, indicating whether they should
be medically disqualified from performing safety sensitive functions while taking the
medication.
2. Employees who are disqualified from performing their safety sensitive duties are to
immediately inform the Assistant City Administrator (or designee) to explain their
absence, the duration of the absence, and any other relevant information.
3. Absences as a result of medical disqualification will be categorized as sick leave.
Employee attendance will be reviewed as part of the City's sick leave policy.
4. Employees who are not disqualified from performing safety sensitive duties while
taking a prescribed medication may report to work. Employees must carry the
physician's completed Medical Authorization Form with them while performing
safety sensitive job duties the duration they are taking prescribed medication.
5. Employees who had previously been disqualified from performing safety sensitive
duties and who are later released to work while taking a prescribed medication may
report to work, as long as they submit the Medical Authorization Form to the
Assistant City Administrator, indicating their ability to perform safety sensitive
functions, at least 3 working days prior to their frrst scheduled shift back.
6. This form must be completed immediately when being prescribed a medication.
Side Effects-Employees who experience side effects or who do not feel fit for duty, regardless
of medications or previous approvals, must consult their physician and immediately refrain from
performing hazardous activities, including driving and working with machinery.
Confidentiality-Medical authorization forms will be kept in a confidential personnel medical
file in the office of the Assistant City Administrator.
Prohibited Behaviors
The following behaviors are prohibited:
· Using a prescription (Rx) medication that is not legally prescribed to the employee;
· Using an Rx medication in excess of the prescribed dosage;
· Using any medication which contains alcohol within 4 hours before performing
safety sensitive functions;
· Using any medication that adversely impacts the employee's ability to safely perform
hislher safety sensitive job functions.
Violations
· Employees who violate section( s) of this policy will be immediately removed from
safety-sensitive functions and may be subject to discipline, up to an including
termination.
· Once removed from duty, an employee may not be returned to performing safety
sensitive duties until evaluated by a physician chosen by and paid for by the City of
Hastings.
· If the employees use of a prescription or over-the-counter drug has endangered the
employee, other employees, or the public, or has contributed to an accident, the
employee may be subject to discipline, up to an including termination.

and return to Assistant City Administrator.
Considerations
The following is a list of medications of concern if used while performing safety sensitive functions as an
employee of the City of Hastings, TRAC transit department. This list is taken from Federal Transit
Administration guidelines, and is not definitive nor all-inclusive. It is provided as a starting point for your
consideration when evaluating if an employee is able to perform safety sensitive functions while taking a
prescription medication.

Adopting an Amendment to the Transit Drug and Alcohol Policy
Addressing Over the Counter & Prescription Drug Use by Safety Sensitive
Employees in the TRAC Department
Whereas, the National Transportation Safety Board (NTSB) has issued a directive to the
Federal Transit Administration (FT A) to educate transit agencies, like TRAC, on the potential
safety risks associated with prescription and over-the-counter medications by employees who
perform safety sensitive duties; and
Whereas, Hastings TRAC provides transit service to the general public, and as such, is
regulated by the FT A; and
Whereas, annually, the City of Hastings reviews its drug and alcohol testing policy in
compliance with FT A and other applicable federal and state regulations; and
Whereas, the City has developed an addendum to that drug and alcohol testing policy to
include policies regulating prescription drugs and over-the-counter medications, in compliance
with FT A and other federal and state agency regulations.
Now therefore, be it resolved, that the City Council of the City of Hastings hereby
adopts and incorporates the Over-the-Counter and Prescription Drug Use Policy and forms as
prepared by the City.
