REQUEST
The City Council is asked to consider the request of John and Nancy Iverson to move a
pre-built home to 110 Chestnut Street. The home would replace a recently demolished
residential structure on the site.
RECOMMENDATION
The Planning Commission voted 5-1 to recommend approval of the request at the
September 24, 2007 meeting with limited discussion. One resident spoke in favor of the
request. Please see the attached minutes for further information.

BACKGROUND INFORMATION
Comprehensive Plan Classification
The 2020 Comprehensive Plan designates the property as U-I, Urban Residential.
Zoning Classification
The subject property is zoned R-2, Medium Density Residential.

Existing Condition
The existing site consists of a house and garage that are attached by a breezeway.
SITE PLAN REVIEW
House Condition
Included with the Staff report are elevations of the new pre-built home that will be
moved to this site.
Surrounding Homes
The median property value (property value = building value + land value) of the
surrounding homes (within 150') is $190,000 while the proposed property value of the
new house would be $142,300. The property value of the existing home is $127,700.
The area homes were all constructed between 1856 and 1999 with a median year of
1918. The proposed house is new and would have been constructed in 2007. The
style of the proposed home is a plain rectangle more similar to the house to be replaced
rather than the surrounding homes. The size of the home is similar to the surrounding
homes at 1,549 Sq Ft.
Zoning Setbacks
The proposed placement of the home on the lot will meet all setback requirements of
the R-2 zoning district. This includes a provision allowing homes to be as close as 10'
from the front property line if existing homes in the area are within the same distance to
the front property line.
Building Permit Review
The Building Official is in the process of reviewing the house plans. The applicant will
be required to obtain a building permit before the house may be moved. At that time, a
certificate of survey must be submitted, and grading issues will be reviewed at that time
by the Engineering Department.
ROLE OF THE BOARD OF DESIGN CONTROL:
The Planning Commission acting as the 'Board of Design Control' has the following
responsibilities:
1. Call of Hearing: The Board is required to hold a hearing to consider the
application papers. Notification of the hearing date and time must be given to the
applicant and other persons deemed appropriate by the Board Secretary.
2. Hearings & Findings: Before or during the hearing, each member may view the
premises upon which the structure is located or to be located, and at the hearing
the Board shall examine the application papers and hear the applicant. It may
also hear any members of a citizens' committee and any other persons who
request to be heard. The Board may adjourn from time to time, but within forty-
eight (48) hours of the close of the hearing the Board shall, pursuant to a majority
vote of all the members of the Board, file written findings of the fact that the
exterior design, appearance and functional plan of such structures is or is not at
variance or so dissimilar with the exterior design, appearance and functional
plans of structures constructed or in the course of construction in the
neighborhood of said proposed structures, which are in the same zoning district
as the proposed structures, as to cause material depreciation generally to
property in said neighborhood. The Board shall further make a recommendation
that the application be accordingly granted or denied. The action of the Board
will then be presented to the City Council at its next regular meeting. Further
action with respect to the granting or refusing of a permit with respect to such
application shall be held in abeyance pending order and direction of the Council.
Neighborhood Response
Letters were sent out on Monday September 17, 2007 to neighboring property owners.
One comment was received in support of the house move as of the date of this report.
Staff Findings
The median property value of the homes within 150' of the site is $190,000 with a range
from $133,000 to 250,200. The median year the surrounding homes were built is 1918
with a range from 1852 to 1999. The housing stock in this neighborhood is uniquely
diverse. The value of the proposed home (142,300) is lower than the median value of
the surrounding homes (190,000), but higher than the value of the existing home
(127,700). All of the surrounding homes have more architectural detail than the
proposed home, which appears relatively plain. However, the existing home is also
plain and has no significant architectural detail.

APPROVAL TO MOVE A HOME TO 110 CHESTNUT STREET

WHEREAS, John and Nancy Iverson have petitioned for Board of Design Control approval
to move an existing pre-fabricated home to 110 Chestnut Street, legally described as follows:
The South Half of Lots I and 2, Block 109, TOWN OF HASTINGS, Dakota County,
Minnesota; and
WHEREAS, on September 24,2007, the request was reviewed by the Planning Commission
of the City of Hastings, serving as the Board of Design Control, as required by state law, city charter
and city ordinance; and
WHEREAS the Planning Commission recommended approval of the request to the City
Council subject to the conditions contained herein; and
WHEREAS The City Council has reviewed the request and concurs with the
recommendation of the Planning Commission.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF HASTINGS AS FOLLOWS:
That the City Council hereby approves the request as presented to the City Council subject to the
following conditions:
I) A permit certified by the building official to move/build the house, and that the building
be consistent to building codes.
2) Applicant must apply for a building permit within one year of approval by the City
Council.
3) The new house must meet all Residential District Lot Regulations.
4) A Tree Preservation Plan along with approval of the City Forester or Parks
Superintendent will be required prior to approval of the application.
5) Approval is subject to a one year Sunset Clause; if significant progress is not made towards
construction of the proposal within one year of City Council approval, the approval is null
and void.

Motion by McInnis to approve the August 27, 2007, meeting minutes. Seconded by Stevens;
motion passed unanimously.
Public Hearings
3. John and Nancy Iverson - House Move Permit #2007-43 - 110 Chestnut Street
Associate Planner Fortney gave a staff report.
Chair Truax allowed time for the public to provide input at 7:08. Sandy Davis spoke to the
issue. She stated that she lives across the street and moving the proposed home on to this lot
would be a great improvement to the neighborhood.
John Iverson, applicant said that he owns this home and it is a rent property for them. He
added that in the past the property has barely passed City rental inspections and it is too
costly to fix-up. He stated that his son and another person rent the property and may want to
buy the home from them one day. Iverson also said that he grew-up just west of this
property.
Commissioner Stevens asked staff which side elevation was the left side, as both are labeled
as right. Fortney replied, the side elevation without a window is the left. The right elevation
that has a window will be facing Chestnut Street. Stevens then asked if it is allowable for a
home to face the alley rather than the street. Fortney replied, their mailbox would have to
face Chestnut Street. Commissioner Schmitt said that the lot is two half lots and the home
could not face Chestnut due to the shape of the lot. He added that this configuration is
common for the area.
Commissioner Peine asked the applicants if they knew of other types of homes that could
face the street. The applicants were unsure. Peine stated that the proposed home varies in
appearance from the surrounding homes. He added that there is a variety of home styles in
the area and this would add to that.

Motion by Schmitt to approve the House Move Permit for John and Nancy Iverson.
Seconded by Stevens.
Upon vote taken, Ayes 5, Nays 1 (Peine). Motion passed with the following conditions:

be congruent to building codes.
2. Applicant must apply for a building permit within one year of approval by the City
Council.
3. The new house must meet all Residential District Lot Regulations.
