REQUEST
Al Sieben is proposing to divide a developed twin home lot into two separate parcels. Both units of
the twin home would be on separate lots.
RECOMMENDATION
At the October 8, 2007, Planning Commission meeting, Commissioners voted 6-0 to recommend
approval ofthe minor subdivision request based on the staff recommendation.

MINOR SUBDIVISION REVIEW
Background
A twin home has recently been built on the existing parcel where a greenhouse once stood. Ifthe
parcel is split so both twin home units are on their own lot, they can be sold separately. The two
twin home units were constructed with separate utilities. In addition, the units have the fire
separation that would have been required if they were built on separate lots from the beginning.
Ifthe twin home was ever removed, the redevelopment ofthe two parcels would be limited to
another twin home or one single-family home with a covenant recorded at that time to bind the
parcels together.
Minor Subdivision Provisions
Section 154.10 of the Hastings City Code regulates the Minor Subdivision (Waiver of Platting
Requirements) as follows:
· A minor subdivision is limited to one division of a parcel of land per twelve month period which
results in no more than three lots provided no new road is required and all lots created meet the
requirements of the Zoning Ordinance.
· The minor subdivision shall not necessitate any additional public investment in new roads nor
utilities to serve the lots.
Minimum Lot Size
The R-2 Zoning District allows twin homes as a permitted use provided the following is met:
· 9,700 s.f. minimum lot size
· 66 foot minimum lot width
The existing property meets the minimum R-2 Twin Home requirements. The City has allowed
subdivision of twin home properties to establish individual ownership in the past, provided the
combined total of both properties meet the R-2 Twin home requirements.
Sewer Interceptor Fee
The developer shall pay $400 in sewer interceptor fees for the additional unit added through the
minor subdivision.
Park Dedication
The developer shall pay $1,800 in park dedication fees for the additional unit added through the
minor subdivision.
Neighborhood Comments
Notice ofthe proposed minor subdivision has been sent to neighboring property owners. Staff
has not received any comments at this time.
RECOMMENDED ACTION
Motion to recommend approval ofthe minor subdivision of 1112 and 1116 Oak Street into two
lots to the City Council with the following conditions:
1) Approval is subj ect to a one year Sunset Clause; if significant progress is not made towards
recording ofthe proposal within one year of City Council approval, the approval is null and
void.
2) Payment of park dedication fees for one unit in the amount of$1800.
3) Payment of sewer interceptor fees for one unit in the amount of $400.
4) Recording of development covenants to ensure complementary and consistent maintenance of
the entire twin home building.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HASTINGS
APPROVING A MINOR SUBDIVISION OF LOT 1, AND THE EAST 70' OF THE NORTH
14' OF LOT 2, BLOCK 4, HANCOCK THOMAS AND COMPANY ADDITION

introduced the following
WHEREAS, AI Sieben has initiated consideration of a minor subdivision on property
to split a +/- .10 acre parcel from a .22 acre parcel generally located on the west side of
Oak St between 11 th St Wand 1 ih St W, legally described as Lot 1 , and the east 70' of the
north 14' of lot 2, Block 4, HANCOCK THOMAS AND COMPANY ADDITION, Dakota
County, Minnesota as follows:
Parcel A: The north half of Lot 1, together with the east 70' of the north 14' of Lot 2,
all in Block 4, containing 5,367 sq. ft. (0.12 acres)
Parcel B: The south half of Lot 1, Block 4, HANCOCK THOMAS AND COMPANY
ADDITION, Dakota County, Minnesota, containing 4,386 sq. ft. (0.10 acres)
WHEREAS, on October 8th, 2007, a review of this minor subdivision was held before
the Planning Commission of the City of Hastings, and
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
HASTINGS AS FOLLOWS:
That the request to subdivide Lot 1, and the east 70' of the north 14' of lot 2, Block 4,
HANCOCK THOMAS AND COMPANY ADDITION is hereby approved, with the following
conditions:
1) Approval is subject to a one year Sunset Clause; if the recording of this proposal is
not made within one year of City Council approval, the approval is null and void.
2) Payment of park dedication fees for one unit in the amount of $1800.
3) Payment of sewer interceptor fees for one unit in the amount of $400.

Council member moved a second to this resolution, and upon
being put to a vote it was unanimously adopted by all Council members present.
