HomeMy WebLinkAbout20071015 - Minutes 20071001 Hastings, Minnesota City Council Minutes October 1, 2007 The City Council of the City of Hastings, Minnesota met in a regular meeting on Monday, October 1,2007 at 7:00 PM in the Council Chambers at the Hastings City Hall, 101 East 4th Street, Hastings, Minnesota. Members Present: Mayor Hicks, City Councilmembers Alongi, Hollenbeck, Schultz, Slavik, and Riveness Members Absent: Councilmember Hazlet Staff Present: City Administrator Dave Osberg Assistant City Administrator Melanie Mesko Lee City Attorney Dan Fluegel Planning Director John Hinzman Approval of Minutes: Mayor Hicks asked if there were any corrections to the minutes of the regular or special meetings on September 17, 2007. There was a correction to the roll call and start of the meeting. With those changes, the minutes were approved. Consent Agenda Moved by Councilmember Riveness, seconded by Councilmember Slavik to approve the Consent Agenda as presented. 1. Pay Bills as Audited 2. Resolution-Accepting Donation from Hastings Sno-Mos for Memorial Bench 3. Resolution-Set Sales of Bonds 4. Amendment to Pandemic Flu Planning-Policy on Meeting by Telephone or Other Electronic Means 5. Approval of Unpaid Leave of Absence 6. Resolution-Temporary Liquor License for American Legion 7. Amend Request by DBA for Oktoberfest, October 12 and 13,2007 8. Resolution-0rder Feasibility Study-Downtown Watermain Extension 9. Declare Excess Property-Police 10. Resolution-Declare Excess Property-Public Works 11. Resolution-Extend Site Plan Approval #2005-62: Office Building at South Frontage Road & Westview Drive 12. Resolution-Accepting Donation from Mary Ann Amelse for a Memorial Bench 13. Resolution-Payment for Project 2006-2, North Frontage Road Water System Improvements 6 Ayes, Nays, None. City of Hastings City Council Minutes October 1, 2007 Page 2 of3 Public Hearing-Civil Penalty for Liquor License Compliance Check Assistant City Administrator Mesko Lee provided the background on the compliance check failure. The licensee failed a liquor license compliance check on September 12. As part of the compliance check failure, the sale was made by a 16- year-old employee; employees must be 18 years old to sell alcohol. An administrative penalty in compliance with the City's guidelines was issued for the illegal sale to a minor. Staff recommends additional penalties for the licensee for the sale by a 16 year old employee, in violation of liquor license laws. Mayor Hicks opened the public hearing at 7:08 p.m. Michael St. John, 308 9th Street West, stated support for a significant fine for this violation. Hearing no further comments, Mayor Hicks closed the public hearing at 7:09 p.m. Councilmember Schultz stated support for an additional civil penalty. Mesko Lee stated that the next step in the Council's guidelines call for a civil penalty of$750 and a two day license suspension. Moved by Councilmember Schultz, seconded by Councilmember Alongi to administer a $750 civil penalty and a two day license suspension to be held on October 19 and 20, 2007. 6 Ayes; Nays, none. Resolution-House Move #2007-43: 200 Chestnut Street (Iverson) Moved by Councilmember Alongi, seconded by Councilmember Schultz to approve the resolution as presented. 6 Ayes; Nays, none. Copy of resolution on file. Comprehensive Plan Update Councilmember Alongi thanked the committee members and staff for their work over the last several months. Planning Director Hinzman provided an update on the recent committee meetings. There was some discussion over a design/density model being discussed, park locations, street design and collector streets, sidewalks, greenways, population projections, Original Hastings Design Standards, and Red Rock/transit. Approve Plans and Authorize Advertisement for Bid: City Hall Lobby Project Moved by Councilmember Slavik, seconded by Councilmember Riveness to approve the plans as presented and authorize advertisement for bid. 6 Ayes; Nays, none. Approve Supplemental Agreement with TKDA Moved by Councilmember Riveness, seconded by Councilmember Schultz to approve the agreement as presented. 6 Ayes; Nays, none. Copy of resolution on file. Comments from the Audience Michael St. James, 308 9th Street West, spoke about a recent interaction with the Hastings Police Department. Reports from City CounciImembers The Fire Department will hold their open house on Tuesday, October 9. The Utility Committee of the Council will meet on Friday, October 5. The Downtown Business Association will be hosting an Oktoberfest event on Friday, October 12 and Saturday, October 13. Moved by Councilmember Riveness, seconded by Councilmember Alongi to adjourn to a closed door session at 7:55 p.m. 6 Ayes; Nays, none. Closed Door Session-Labor Relations Mayor Hicks called the closed door session to order at 8:00 p.m. Moved by Councilmember Alongi, seconded by Councilmember Schultz to adjourn the closed door session at 8:35 p.m. Mayor Hicks reconvened the regular City Council meeting at 8:35 p.m. Adjournment Moved by Councilmember Hollenbeck, seconded by Councilmember Slavik to adjourn meeting at 8:35 p.m. 6 Ayes, Nays, None.
