vT-4 MEMO To: Honorable Mayor and City Council From: Tom Montgomery Date: February 5, 2008 Re: Resolution -Alternate Dissemination of Bids Last year, the City Council authorized the use of the City's web site for "alternate dissemination of bids" rather than placing advertisements for hid in the Hastings Star Gazette. The Council action required dual posting of ads through the end of 2007. The State Statute that permits advertising on the City's web page requires the City to designate the City's web page as an official publication site and post a notice in the official newspaper. Advertisements for bids would alsa continue to be placed in the Construction Bulletin, and official notices would continue to be published in the Star Gazette. COUNCIL ACTION REQUESTED Council is requested to adopt the enclosed resolution designating the City's web page as the official publication site for ads for bid in accordance with State Statute requirements. :~ _ ~- ~. ~ r CITY 0~ ~ST~~ CITY OF HAS'T`INGS DAKOTA COUNTY, MINNESOTA Resolution No. RESOLUTION DESIGNATING USE OF THE CITY OF HASTINGS WEB SITE AS AN ALTERNATE METHOD FOR DISSENHNATING BIDS AND REQUESTS FOR PROPOSALS WHEREAS, State Statute 331A.12 permits the use of the City of Hastings' web site as an alternate method for disseminating bids and requests for proposals, and WHEREAS, the Hastings City Council has previously authorized the use of the City's web site as an alternate method for disseminating bids and requests for proposals, and WHEREAS, State Statute 331A.12 requires an annual designation of the City's web site as the publication method for disseminating bids and requests for proposals. NOW, THEREFORE BE TT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HASTINGS AS FOLLOWS; The City of Hastings' web site is hereby designated as the publication method for disseminating bids and requests for proposals. Definitions. (a) The terms defined in this subdivision and section 331A.OI apply to this section. (b) "Web site" means a specific, addressable location provided on a server connected to the Internet and hosting World Wide Web pages and other files that are generally accessible on the Internet all or most of the day. Subd. 2. Designation. At the meeting of the governing body of the local public corporation at which the governing body must designate its official newspaper for the year, the.governing body may designate in the same manner publication of transportation projects on the local public corporation's Web site. Publication on the Web site maybe used in place of or in addition to any other required form of publication. Each year after designating publication on the Web site for transportation projects, the local public corporation must publish in a qualified newspaper in the jurisdiction and on the Web site, notice that the local public corporation will publish any advertisements for bids on its Web site. Subd. 3. Form, time for publication same. A local public corporation that publishes on its Web site under this section must post the information in substantially the same format and for the same period of time as required for publication in an official newspaper or other print publication. Subd. 4. Record retention. A local public corporation that publishes notice on its Web site under this section must ensure that a permanent record of publication is maintained in a form accessible by the public.
