Extend interim protection~ to the end of the designation study
process.
REQUEST
The HPC's Designation Study is proceeding as scheduled. As anticipated, the 4-month interim
protection will expire prior to the completion ofthe project. The protection will expire on May 15th.
A 4-month extension to the interim protection would last until September 15th when the project is
completed.
Although the research will be completed in May, the timeline for completing the project will last until
September. Interim protection treats properties as if they are preservation sites during the time they
are being researched for designation. This does require owners to apply to the HPC for approval for
changes to the appearance of the property. Since January several owners of properties under
consideration have been approved for work on their property. If the research determines a property
does not meet the criteri~ it is removed from the protected list at that time. The property owners
have been notified of the extension request. The following is the project timeline from May to
completion:
May 9th- Notify Owners
May 20th - Final report from consultant to the HPC
The report to be reviewed by SHPO (State Historic Preservation Office) for 60 days.
Planning Commission to determine if proposed designations are in conformance with
the Comprehensive Plan.
August 12~ NotifY owners
August 19tb_ HPC reviews State, Planning Commission, and public comments and provides a
recommendation to the City Council
September 4th - Publish notice of public hearing and notifY owners
September 15th - City Council public hearing

(D)(8) Interim protection. Interim protection is established to protect a nominated property from
destruction or inappropriate alteration during the designation process. The owner shall be notified of
the interim protection when a decision has been made about commencing a designation study. A
designated study shall be initiated by action of the Commission in a public meeting after .10-days'
written notice to the owners of properties considered for designation. Interim protection shall be in
effect from the date ofthe Commission's action to begin a designation study decision regarding the
designation of the property until Council action or for 4 months, whichever comes first. Prior to the
expiration of the 4-month period, the Commission may request Council approval to extend the interim
protection for an additional 4 months, not to exceed a total of 8 months. The Commission shall
provide grounds for the request for an extension of time to decide on the designation. The owner
must be notified of the recommendation to extend the interim protection prior to the Council meeting
to decide on the extension oftime. Interim protection means that during the designation process, the
provisions of this section apply to the property as ifit were designated.
