REQUEST
Lakeside Association Board seeks Site Plan Approval to construct a garage at 920 Nininger
Road, legally described as Lot 16, Block 3, Addition No 13.
RECOMMENDATION
At the July 14, 2008, Planning Commission Meeting, the Planning Commission met on the
aforementioned item. Planning Commission members modified staff's recommendation
that the front and two sides be sided with vinyl clad steel siding to instead require vinyl
siding due to cost concerns expressed from the applicant. !n addition, an eighth condition
was added to state that the structure must have a concrete floor if fuel powered equipment
was going to be stored in the garage.
After researching the Minnesota State Building Code, it was determined that all
commercial garages must have a floor surface that is "concrete or similar
noncombustible and nonabsorbent materials." Further, "asphalt parking surfaces are
permitted at ground level."
Therefore, the garage floor in any commercial garage must be of these surfaces,
regardless if fuel powered equipment will be stored in the garage. Thus, the eighth
condition has been modified to reflect the Building Code.
The Planning Commission voted 5-0 to recommend approval of the request subject to the
following conditions of the attached resolution.

Comprehensive Plan Classification
The 2020 Comprehensive Plan designates the property as P-Public. The proposed use is
consistent with the plan.
Zoning Classification
The subject property is zoned A-Agriculture. The nature of the garage and the equipment
stored at the site are consistent with the allowed uses within the Agriculture District.

Existing Condition
The garage will built in the northwest corner of the property on open land.
Proposed Improvements
The garage will be 26' wide and 36' feet long with a 12' x 10' overhead door.
SITE PLAN REVIEW
Proposed Building Setbacks
Zoning Setbacks are acceptable. Setbacks in the Agriculture District are not specified.
Vehicular Access and Circulation
Access to the area will not be affected and thus is acceptable.
Pedestrian Access and Circulation
Pedestrian access and circulation is acceptable.
Parking
Parking will not be affected and thus is acceptable.
Architectural Elevations
Industrial and warehouse buildings are required to have the front facades composed of at
least 75 percent of Class 1 or Class 2 materials, with Class 1 materials comprising at least
25 percent of the total fagade. Side and rear facades visible from public right(s)-of-way,
parks, public view from adjacent properties, or residential uses or district must be
composed of at least 25 percent of Class 1 of Class 2 materials. Side and rear facades not
visible from public right(s)-of-way, parks, public view from adjacent properties, or residential
uses or district may use any combination of Class 1, 2, or 3 materials.
The applicant is proposing that the primary exterior materials will be a horizontal vinyl clad
steel siding on the front of the building that will be very similar to the cemetery office. All
other sides would be covered with vertical steel panels.
Staff originally recommended that the front and two sides be sided with the horizontal vinyl
clad steel siding due to the building's visibility from County Road 42. However, due to cost
concerns, staff was acceptable with the applicant's request to use vinyl siding on three
sides.
Though vinyl siding does not meet the Class 1 or Class 2 materials requirements, the City
has previously accepted alternative materials for accessory storage buildings, particularly
those that are less visually prominent.
Grading, Drainage, Erosion Control, and Utility Plan
The City's consultant engineer has reviewed the Grading, Drainage, Erosion Control, and
Utility Plans. Approval of the Site Plan is subject to approval of the Grading, Drainage,
Erosion Control and Utility Plans by the Public Works Director.
Setbacks
The Mississippi River Corridor Critical Area Interim Development Regulations states that
any new structure or road shall be placed no less than 40 feet from the bluff line. The City
of Hastings Shoreland Management Ordinance requires structures to be located 150 feet
from the ordinary high water level.

WHEREAS, Lakeside Association Board has petitioned for site plan approval to
construct a 26' x 36' foot long lean-to addition to a pole barn located at 920 Nininger Road
described as Lot 16, Block 3, Addition No 13, Dakota County, Minnesota; and
WHEREAS, on July i4, 2008, the Site Plan was reviewed by the Planning Commission
of the City of Hastings, as required by state law, city charter and city ordinance; and
WHEREAS the Planning Commission recommended approval of the request to the City
Council subject to the conditions contained herein; and
WHEREAS The City Council has reviewed the request and concurs with the
recommendation of the Planning Commission.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF HASTINGS AS FOLLOWS:
That the City Council hereby approves the Site Plan as presented to the City Council subject to
the following conditions:
1) Conformance with the City Council Staff Report and plans dated July 21,
2008.
2) Approval is subject to a one year Sunset Clause; if significant progress is
not made towards construction of the proposal within one year of City
Council approval, the approval is null and void.
3) Final approval of the grading, drainage and utility plans by the Public
Works Director, and reimbursement for any fees incurred in review of the
development- The owner assumes all risks associated with the grading
and utility placement prior to formal approvals.
4) Any uncompleted site work (including landscaping) must be escrowed
for prior to issuance of a certificate of occupancy.
S) Submission of an electronic copy of all plan sets (TIF, PDF, or similar
format) prior to submittal of a building permit.
