SUBJECT: Fireworks Ordinance
Description•
At the July 21, 2008, City Council meeting, action was introduced and a first reading was
held of the proposed change to update the City of Hastings Ordinance, Chapter 13,
Fireworks. This update is to be compliant with recent changes in Minnesota State
Statute.
Back~round•
In 2004, the City of Hastings adopted a fireworks ordinance regulating the sales, storage
and use of legalized fireworks. During the 2006 Minnesota Legislative Session, the state
statute pertaining to fireworks was amended to include language that municipalities could
not be more restrictive than state statute.
Recent legislative sessions again resulted in language changes to the state statute. The
changes relate to the amount of explosive product in each firework and to the amount of
sales space the display may occupy within a store.
Attached are proposed changes to the City of Hastings Ordinance, Chapter 13.
Requested Action:
Staff is recommending proposed language change to the City of Hastings Ordinance,
Chapterl3, to be compliant with Minnesota State Statute.

NOTICE OF MEETING-
PROPOSED CHANGE TO ORDINANCE
CHAPTER 113, FIREWORKS
Notice is hereby given that the Hastings City Council will meet at 7:00 p.m. on Monday,
August 4, 2008 in the City Council Chambers located in the Hastings City Hall, 101 East
Fourth Street, Hastings, Minnesota to consider the following changes to City Ordinance,
Chapter 113, Fireworks:
Chapter 113.02 (Consumer Fireworks)
New Will have the same definition as contained in M.S. 624.20, Subdivision 1 (c), as it
maybe amended from time to time. Wire or wood sparklers of not more than 100 grams
of mixture per item, other sparkling items which are non -explosive and non -aerial and
contain 75 grams or less of chemical mixture per tube or a total of X88 500 grams or less
for multiple tubes, these include:

(2) Cone Fountains
New The effect is the same as that of a cylindrical fountain. When more than one cone
mounted on a common base, total pyrotechnic composition may not exceed X99 500
grams.

113.07 Terms and Conditions of Fireworks License
New (G) In buildings without an approved, automatic fire sprinkler system throughout,
consumer fireworks will be limited to
. 1251bs. net of pyrotechnic composition or
25 % of gross package weight if pyrotechnic mixture weight is not known.
New (H) In buildings with an approved automatic fire sprinkler system throughout,
consumer fireworks will be limited to

25 % of retail floor space or 600 sg. ft, which ever is less and authority having
iurisdiction apuroves the increase.
Before the date of the public hearing, persons may contact the Hastings Fire Department
between 8:00 a.m. and 4:30 p.m. Monday through Friday with any questions.
All persons are welcome to attend this hearing and make comment.
